HomeMy WebLinkAboutD-2001-10 Collection of User Fees/Parks & Recreation/As AmendedORDINANCE D- 2001 -10 (AS AMENDED) SPONSOR(S): Councilors Snyder Sharp AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, REGARDING COLLECTION OF USER FEES AS ESTABLISHED BY THE CARMEL /CLAY BOARD OF PARKS AND RECREATION WHEREAS, the Carmel /Clay Board of Parks and Recreation (the "Park Board is a governmental entity created and authorized to administer the Carmel /Clay Department of Parks and Recreation (the "Department pursuant to that certain agreement entitled "I Cooperation Agreement" signed by the respective authorized officials of Clay Township, Hamilton County, Indiana (the "Township and City of Carmel, Indiana (the "City on July 30, 2002 and effective January 1, 2003, as the same has been amended from time to time; and WHEREAS, the Park Board has established certain user fees "User Fees pursuant to Indiana Code 36- 10 -3 -22 for the provision of services through its Extended School Enrichment Program and various other programs offered at the Monon Community Center or at other Department facilities; and WHEREAS, the Department has taken all steps necessary and appropriate to determine the amount of the User Fees to be charged and the methods and means by which to receive payment of same; and WHEREAS, the Department has experienced and continues to experience an increase in the number of returned checks related to the payment of User Fees; and WHEREAS, the Department has incurred and will continue to incur expenses from its User Fee collection process which it would like to recoup from those responsible; and WHEREAS, it is in the public interest for the Department to recover its User Fees and their related collection expenses. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Cannel, Indiana, as follows: Section 1: The foregoing Recitals are incorporated herein by this reference. Section 2: Chapter 5, Article 1 Section 5 -4 should be and the same is hereby added to the Carmel City Code and shall read as follows: Page One of Two Pages This Ordinance was prepared by Douglas C. (a) The Carmel /Clay Board of Parks and Recreation may, as permitted by law, establish user fees for its programs and services provided. mU O cer Presiding The Carmel /Clay Department of Parks and Recreation "Parks Department may submit its delinquent user fee accounts to the Carmel City Attorney for collection. Submission of same for collection shall entitle the Parks Department to recover the amount of the delinquent user fees plus reasonable attorney's fees, court costs and any other expenses incurred by the Parks Department and /or the City Attorney in the collection process. An action to recover delinquent user fees may be tiled in any court of competent jurisdiction. (c) All monies recovered pursuant to this Section shall be first used to reimburse any collection costs and expenses incurred by the City Attorney, and the remainder may be used by the Parks Department for any lawful purpose."
