The plat was approved but was not recordered. At the time the road was under construction and they had a
prospective buyer who wanted the entire parcel but then 2008 happened. I have the signed plat and I think that
most but not all of the fees have been paid. I will bring it in tomorrow along with the file and we can see what
needs to be done. I spoke with the client about this project two weeks ago and asked what they wanted to do and
they want to plat it. Boy it must be a slow day to find this old project. I was thinking about it as well. Can you
meet tomorrow?

Our office is following up on old secondary plats. Carlson Corner was a proposed 4 -lot subdivision for the southeast
corner of 141s St. Towne Rd. It does not appear that this plat was ever approved and /or recorded; do you know why?
Per the subdivision control ordinance regulations, we might have to void this secondary plat application due to lack of
prosecution and your client would have to file a whole new Secondary Plat application when they are ready to move
forward.... Please let me know the status.

Dear Mr. Badger:
We have received the most current construction plans on November 14, 2007 based upon the City review
of August 28, 2007.
The Department rescinds the following previous comments:
1. Previous Comment 12. The City is requesting widening, milling, and resurfacing of the 141st
Street frontage per Department policy. Such work may be credited against any road improvement
commitments. Due to the upcoming road improvement project, the Department rescinds this
previous comment.
2. Previous Comment 16. Portions of proposed driveways and access drives within the proposed
right -of -way shall be concrete per City standards and shall meet all City dimensions and width
standards (see comment 22 however). As we have discussed, the City will allow the pavement
section per Detail 10/10 to be temporarily installed in the right -of -way for the Towne Road
entrance in anticipation of a permanent entrance being constructed with the City's road
project. The Department rescinds this previous comment.
3. Previous Comment 41. Detail 10/10. This detail is not applicable. Portion of driveways and
aprons in right -of -way shall be 6" minimum concrete per City standards. As we have discussed,
the City will allow this pavement section to be temporarily installed in the right -of -way for
the Towne Road entrance in anticipation of a permanent entrance being constructed with
the City's road project. The Department rescinds this previous comment.
4. Previous Comment 48. Please add City Paving Policy to a sheet in the plan set. Due to the
temporary nature of the paving in the right -of -way, the Department rescinds this previous
comment.
5. Previous Comment 49. Sheet 12, street and pavement note 2D. This note shall be revised to
require conformance with paving policy for work in the right -of -way. Due to the temporary
nature of the paving in the right -of -way, the Department rescinds this previous comment.
6. Previous Comment 50. Sheet 12, street and pavement section 7. Field quality control in right -of-
way shall conform to paving policy. Due to the temporary nature of the paving in the right-of-
way, the Department rescinds this previous comment.
The Department requires written verification/clarification of the following items:
7. Previous Comment 4. Water stubs have been provided per an e -mail from John Duffy dated
February 8, 2005. Do the lateral/service crossings require open pavement cuts? If so, BPW &S
approval must be obtained. City street cut patch detail shall be added to plans and minimum cover
standards will apply. Please verify that it is intended to install such laterals under the existing
pavement of Towne Road by trenchless method. Such trenchless methods were not noted on
the plans submitted. Please verify that the stubs are either already installed to the opposite

proposed right -of -way or that such installations will be by trechnless method such that there
will be no open trench in the proposed right -of -way. In the event that open trenching is
required within the proposed right -of -way, the portion of the trenches within the proposed
right -of -way shall be backfilled with granular material in accordance with the City's final
backfill policy and any notes or details shall be revised to require such backfill specifically.
8. Previous Comment 8. The entire site shall drain north to the Stutz Almond drain if the county
will allow the connection. Some portions of the site still drain to the south and will not be
detained or treated. What was discussed during our recent meetings?
9. Previous Comment 20. The proposed landscaping berms shall not block or inhibit existing
roadside drainage and shall adequately accommodate such drainage. Please add a note to this
affect to the plans. It appears that the berms are to be located outside of the right -of -way. A
drainage ditch is indicated along Towne Road. There is not a drainage ditch indicated along
141'` Street. Even though these areas will likely be regraded with the City improvements,
please verify that the installation of the landscape mounds will not create any low, undrained
areas in the right -of -way. The City would expect an opening of the landscaping mounds to
facilitate drainage of any areas that cannot be accommodated by the road project.
10. Previous Comment 21. Proposed grading shall accommodate future road project grading and shall
be graded as if the proposed roadway grades were already existing. Please refer to Items 9 and
11 of this letter.
11. Previous Comment 24. How is existing right of way drainage being addressed? Thank you for
indicating the drainage swale between the existing pavement edge and the proposed path
along the Towne Road frontage. The Department cannot determine if a similar swale is
necessary along 141'` Street as the contours are not clear on the plans that were submitted.
The proposed grading plans shall accommodate the future grading elevations of the roadway
the same as if such improvements were already installed and existing. Are any low areas
being created that will not be allowed to drain into the City's new road drainage piping
network or need to drain into the site but be blocked by the landscaping mounds?
12. Previous Comment 25. Drive culverts shall be adequately sized to convey the 10 year storm event
and meet minimum size standards. As these culverts are outside of the right -of -way, please
confirm my recollection that these pipes were sized to convey the watershed draining
through them and that the City waived the minimum 18 -inch diameter drive culvert
requirement.
13. Previous Comment 30. General site note 5. Pavement patching shall meet City standards. Please
revise on all sheets that contain this note. The Department rescinds this comment if no open
pavement cuts are required. Please verify.
14. Previous Comment 33. Sheet 3. Has the temporary right of way for utility extension been
obtained? Why is this temporary? Has this easement been obtained? I cannot recall what we
discussed at previous meetings.
15. Previous Comment 46. Sheet 12. Street and pavement note 3E. Please delete this section. Please
verify if any curbing is to be installed with this project. If no curbing is to be installed, the
Department rescinds this comment.
16. Previous Comment 47. Sheet 12. Street and pavement note 1. All curbing shall meet City
standards. If curbing is to be installed, please delete this reference to curbing and include City
curbing policy. Must also be revised to indicate streets, parking and asphalt path outside of City
right way. Please verify if any curbing is to be installed with this project. If no curbing is
to be installed, the Department rescinds this comment
The secondary plat comments from the City review have been satisfactorily addressed with the following
exceptions. A written response as to how each of these items has been addressed is required.
17. Previous Comment 5. Please add a note to all sheets that no earth disturbing activity may take
place without an approved storm water management permit. The Department restates this
comment.

18. Previous Comment 11. Non access easements are required along the perimeter road frontages
outside of the proposed ingress /egress easements per the February 16, 2005 TAC meeting. The
Department restates this comment.
19. Previous Comment 17. All subsurface drains shall be double wall smooth wall perforated pipe,
Hancor Hi -Q or equivalent. Please delete Detail 11/10.
20. Previous Comment 31. General site note 12. Work shall meet City of Carmel details. Please
revise on all sheets that contain this note. Any work in right -of -way shall be indicated on the
plans and shall meet City standards. Please revise D.O.T. to be City of Carmel.
21. Previous Comment 32. General site note 19, sheet 2 and general site note 17 on sheet 3. The
Department requires a specific plan to be developed and approved for all work that requires a
maintenance of traffic plan. Such plan shall conform with Indiana Department of Transportation
Work Zone Safety Manual. The Department restates this comment.
22. Previous Comment 34. General site note 20, Sheet 3. Is any walk planned? If so, it shall be 5'
minimum and shall meet City standards. If no walk is planned with this development, please
delete this note.
23. Previous Comment 36. Please delete details 1 /10 and 2/10. The Department restates this
comment.
24. Previous Comment 38. Detail 12/10. If this detail is applicable to installation within City right -of-
way, the backfill note under paved areas shall be revised to conform to City standards. Per Item 7
of this letter, this detail will need to be revised if there is any open trenching in the proposed
right -of -way. If there is no such open trenching, the Department rescinds this comment.
25. Previous Comment 39. Is detail 7/10 applicable? The Department restates this comment. If this
detail is not applicable, please delete the detail.
26. Previous Comment 44. Sheet 12. Storm sewer note 2D. Please revise to require pipe meeting the
same AASHTO and ASTM specifications as the Hancor, HI -Q pipe. Please verify that the
current note is appropriate for the Hancor, Hi Q pipe and make any necessary corrections.
27. Previous Comment 45. Sheet 12. Storm sewer note 3G. Revise to require backfill per City
standards where in right way. The note shall be revised to conform to the requirements of
Detail D23 on Sheet 10.
28. Previous Comment 52. Have MFPG been established for each lot based on MWSE of the
detention areas? The Department restates this comment.
The following Items are required prior to final plan approval:
29. Incorporation of the outstanding items outlined above into the final plans.
30. Previous Comment 6. Please verify if a variance or subdivision waiver of the requirements of
section 6.03.19 was obtained for this project. Please verify that this variance or waiver was
obtained.
31. Previous Comment 15. The Department will not approve the construction drawings until all
BPW &S approvals are obtained, all off -site easements are obtained, all fees are paid, all bonds are
provided, and proper digital files are submitted. The Department restates this comment.
32. Previous Comment 28. Please provide confirmation that road improvement commitments per
original TAC meeting have been formalized. The City will accept an Agreement for such
Thoroughfare Plan commitments that includes payment terms on a per lot basis at such time
as the lot is transferred to the purchaser. This Agreement needs to be formalized.
33. Previous Comment 29. Please refer to letter from this office dated February 9, 2005 as it relates to
required BPW &S approvals, bonding, number of plan sets, and fees. Some of these requirements
may have changed since the date of the letter which may result in higher fees and additional
bonding requirements. The Department restates this comment.
34. Previous Comment 37. Detail 13/10. Path section does not meet City standards. Please revise to
require the following section: 1 inch HMA #11 surface on 2 inches HMA #8 binder on 5 inches
#53 stone. As we have discussed, the developer has indicated that the financial commitment

We will support the current plan to use the two existing cuts on Towne and the planned
third one on 141st Street as far east as possible.

Mike and I are still evaluating the median opening on Towne for Carlson Corner. If we
provide a break, it will be as we discussed: a median opening with no deceleration taper
or lane.
We are also evaluating extending the project to the east line of the Carlson property.
As it relates to establishing the commitment, I was in error in stating that it is
materials only. The commitment needs to reflect the installed cost for the improvements.
Did we also discuss having the City construct the multi -use path? As this is required by
the Alternative Transportation Plan and is not a part of the Subdivider Agreement being
used as the basis for the road improvement commitment, the commitment would need to
include the installed cost of the path across each frontage if the Carlson's opt to have
the City construct the path.

Dear Mr. Badger:
We have received your comment letter and drawings dated June 22, 2007 based upon the City review of
February 9, 2005.
The secondary plat comments from the City review have been satisfactorily addressed with the following
exceptions:
COMMENTS
15. Towne Road is classified a primary parkway according to the 20 -Year Thoroughfare Plan and
therefore the required right -of -way width is 140 feet (70 -foot half). Please increase the half right
of -way width for Towne Road that is shown on the proposed plat as 60 feet to 70 feet. Restate
comment.
16. Will the I. E.E. between lots 3 and 4 will serve multiple lots or be the subdivision entrance?
The Department of Engineering requests this to be located at least 500 feet from the Towne
Road/141 Street intersection unless it will be considered a'common driveway for lots 3 and 4.
The plans indicate a distance of 482 feet. Please locate 500 feet from intersection.
Based on additional review, the City provides additional comments:
1. Sheet 8 Please remove the landscape plan from the set of plans to be approved by the
Department of Engineering and remove the title of the Landscape Plan from the index on the title
sheet. Please assure that the correct numbering order is maintained on both the index and the
individual sheets.
2. After all secondary plat comments are resolved, the Department of Engineering will review the
construction plans.
3. Please locate the 14I u Street curb cut at the approved distance of 525 feet from the intersection.

9. Per Greg Hoyes e-mail dated June 1, 2007, the drainage is subject to review by both the City and
the County. Please submit plans to Crossroad Engineers, PC if this was not done for the TAC
meeting. As a TAC member, Crossroad Engineers, PC should have been provided plans and
calculations.
10. Due to the date of the initial filing of the primary plat, the City is not requesting the provision for
detention of the fully developed thoroughfare plan right -of -way of each frontage.

responsibility of the Developer. Poles in the right -of -way shall be relocated to the back edge of
the proposed right -of -way in accordance with City and utility company policies.
15. The Department will not approve the construction drawings until all BPW &S approvals are
obtained, all off -site easements are obtained, all fees are paid, all bonds are provided, and proper
digital files are submitted.
16. Portions of proposed driveways and access drives within the proposed right -of -way shall be

adequately accommodate such drainage. Please add a note to this affect to the plans.
21. Proposed grading shall accommodate future road project grading and shall be graded as if the

22. Please coordinate right -of -way needs with the future road project. Please contact Sam Balog at
American Structure Point. Please also coordinate drive locations and construction within the
proposed right -of -way by this development with this road project. The Department is willing to
consider temporary installations within the right -of -way in anticipation of the future road project
dependent upon the timing of this project and the road project.
23. Have all comments per Hamilton County Surveyor's Office letter of October 12, 2004 been
addressed?
24. How is existing right -of -way drainage being addressed?

Angie,
Chris Badger came in today about Carlson Corners and was upset because engineering is requesting to see their revised
drainage plans. He said that since this project was reviewed a couple of years ago, the drainage plans from then should
still be sufficient and that new plans (and review) should not be required. I wasn't sure what was approved in the project's
last review so I told him I would look into it and notify you of his issue.

The following letter represents comments for this project specifically addressing the area of alternative
transportation. I have reviewed the drawings dated August 6, 2007 and offer the following comments:
ALTERNATIVE TRANSPORTATION REVIEW COMMENTS
1) The Carmel Clay Alternative Transportation Plan requires the construction of 10' asphalt path along
141 St and Ditch Rd. These paths should be located 1' from the edge of the right -of -way and should
include ADA compliant ramps at all sidepath and sidewalk crossings.
Please revise the plans to show ADA compliance for all crossings.
We request that all responses to our comments be provided in writing. Failure to provide written responses may
result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re- submitted, particularly if
any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans
indicating all revisions. Please notify us of any changes and specifically state any changes, including changes
resulting from Plan Commission, Special Studies or other committee meetings.

Concerning you comments and questions in a letter dated February 14, 2005 for
Secondary Plat Application for Carlson Corner Subdivision, I offer the following
response:
The following must be indicated on the plat:
1.) Docket Number 05010041 SP.
The new Docket Number 07030034 SP has been added.
2.) Please add the source of title of ownership.
Source of Title has been added to the secondary plat: Instr. No. 2000 -43576
3.) Please provide a copy of restrictions or covenants (if applicable).
We have asked the client to provide any restrictions or covenants.
4.) Please add monumentation for lot corners.
Monumentation has been added to the secondary plat.
5.) The half right -of -way for Towne Road is 70 feet. Please revise accordingly.
The right -of -way has been revised per TAC meeting and discussions in trying to meet
turn lane and roundabout requirements. The right -of -way for Towne Road and 141S
street has been agreed upon as shown.
6.) The half right -of -way for 141 Street is 40 feet. Please revise accordingly.
The half right -of -way for 141 Street has been revised to 50 feet half to accommodate the
10' multi -use path as discussed in a TAC meeting.
7.) The plat shows a 20 foot "W.E." Please identify "W.E." in the legend.
The 20' Waterline Easement "W.E." has been removed as the lots will be serviced by
individual service lines from water mains in Towne Road and 141 Street.
8.) There appears to be an extra line through Lot #1. Please remove or identi.
I think the sanitary sewer line is being interpreted as a lot line. We have changed line
types and lineweights to try and make this easier to identify.

9.) The line weight of the area inside the right of way should be lighter than the subdivision
bounds. Please revise.
We have revised line weights in the drawing.
10.) This property is within the City of Carmel corporate bounds. Please replace the Hamilton
County Commissioners signature block with a corrected City of Carmel Board of Public
Works signature block.
The signature block has been changed on the secondary plat.
11.) The south and east boundaries of this subdivision are required to have a type `B" buffer.
Please provide and indicate.
The south and east boundaries have been buffered with type `B" buffers. The most
southern boundary (south line of Lot 1) will have a platted landscape easement for future
but it is intended to have the existing trees and vegetation act as the buffer. If it is
removed in the future, the easement will be available to place a new buffer within.
Concerns and Comments are as follows:
1.) As per the Alternate Transportation Plan, a 10 foot multi use path is required along Towne
Road and 141 Street. You are required to commit to this improvement at a future date when it
becomes a desired link in the pedestrian system.
We have added the 10' multi -use path to the this set of plans for construction during this
development per letter from the City of Carmel, Alternate Transportation Coordinator.
2.) Please indicate how these parcels will access Towne Road and /or 141 Street.
Lot 1 is currently served by driveway off of 141s Street. Lots 2, 3 4 will be served by
a single curb cut by a common driveway off of Town Road.

Here are my TAC review comments on Carlson Corner Subdivision:
1. Please provide me with a full size set of plans, not 11x17"
2. The subdivision is covered under the perimeter bufferyard requirements (Section 26.04). Therefore you must
provide buffering on all four sides of the subdivision, not just two.
3. The landscape plan must have a planting schedule included that specifies the species of the plants, along with
the graphic planting details, and any landscape notes or conditions.
4. The graphic planting details must include a note that says "Root Flare must be planted at or near grade level" not
root ball and stakes and wires must be removed within one year. Please do not cap the plantings with 2 -3" of
clay. The conifer planting detail should show a conifer.

Dobosiewicz: The northwest comers drive land bank parking on Sheet C2 -2. I believe the design needs
changing. This would be cost prohibitive for a Homeowner's Association to maintain.
The Plan Commission will have an issue with this at this current grading. Get with
Engineering for design construction of the on- street parking. On the "exit only" onto
Range Line we want to see the proposed signage for that.
Hoyt: Is that something the City proposed? In an emergency we will use it as ingress.
Shinaver: Because of the location of the sub station mature trees have been maintained as a natural
buffer. We would like to maintain those trees but designed this "exit only" wide enough
with emergency traffic in mind.
Dobosiewicz: Can you design it to accommodate future widening to both ingress/egress?
Duncan: Engineering has looked at this and we do not want full access due to the proximity to the
intersection.
Dobosiewicz: Okay. We will need full elevations sent. Are the materials all brick, all four sides?
Sullivan: Yes.
Dobosiewicz: The window with shutters and rowlock over the door, I do not like it.
Feltner: No comments.

The Petitioner seeks to construct four lots on 10.616 acres. The site is located at 2345 West 141 Street
and is zoned S 1 /Residential.
Carlson: We are dividing ten acres into four.
Hoyes: I sent C. Badger a comment letter October 12, 2004 those issues have not been addressed.
The relocated Regulated Drain is not in the correct location on the Plat.
Griffin: 1 sent you a letter on February 14. Issue with Alternate Transportation Plan requires a ten
feet (10') path installed along Towne Road and 141" Street you will need to install or
commitment to install, Mow is this accessed out there?
Carlson: The four (4) acres off of 141' Street and the other three (3) have a common drive off
Towne Road.
Dobosiewicz: Put a non access easement on the Plat. We also need a Legend on your Plat. We would
like you to install the path now, get with Engineering on cost.
Duncan: I mailed a letter to you. There is a sixty feet (60') half right-of-way indicated before the
intersection is that cxisting?
Carlson: Yes.
Duncan: We need that to be seventy feet (70') to be consistent with the City's Thoroughfare Plan.
We will need more room for the roundabout the corner cut needs to be one hundred and
twenty feet (120') radius minimum. Ingress /egress easement will serve more than one (1)
lot and how wide is it?
Carlson: Yes, thirty feet (30') at the entrance and twenty live feet (25') to Lot two.
Duncan: Your full access to the drive may be cut off due to the roundabout. We are making you
aware of the splitter island to the roundabout similar to what is on Hazel Dell Parkway.
Our standard is entrances to be 500 feet from the centerline of the intersection.
Hoyt; Sent letter, no further.
Brewer: 1 did not get a Landscape Plan.
Badger: (passing full set of plans S. Brewer).
Dobosiewicz: Provide Engineering with the cost estimate for the commitment to install or funds to
install the ten feet (10') asphalt path. Then supply the Department with a commitment
letter. We will look for revisions on the plan and we will look for the addition of the two
feet (2') wide non access easement where the drives are not located. This will be a BPW
approval.
Feltner: Sanitary Sewer Construction Plans need to be submitted for rcvicw by the District's
Engineers please submit two sets of plans to CTE. The District has not received plans.
District Project Application needs to be completed and sent to the District. An IDEM
Construction Permit will be needed. All 1DEM submittal information should be provided
following CTE's review and approval of final plans.

9. Upon initial review, it appears the following bonding requirement will apply to this project:
Performance Guarantee
Asphalt Paths (in dedicated right awa of Towne Road/141 d Street)
Please provide a detailed (materials, quantities, sues, unit costs, etc.) Certified Engineer's
Estimate for 100% of the cost of labor and materials to construct 10 -foot wide asphalt paths in
the dedicated right of way of Towne Road and 141" Street. Post a Performance Guarantee in
the amount of the Engineer's Estimate. Three -year Maintenance Guarantees, in the amount of
10% of the Performance Amount, will he required upon release of the Performance Guarantee
by the Board of Public Works and Safety.
Right of Way Permit and Bonding
Any work in the dedicated right of way of Towne Road or 141" Street, other than the construction
of the asphalt paths, will require a Right of Way Permit and appropriate bonding. The bond is a
License Permit type bond. The bond amount will be determined by the number of instances of
work in the right of way (curb cut, water sanitary -storm work, etc.) $2,000.00 per instance.
Open pavement cuts in dedicated streets require Board of Public Works and Safety approval.
Contact Fred Glaser of our office for details. Fred is our Right of Way Manger /Inspector.
COMMENTS
10. This project was originally submitted for TAC review on December 17, 2003. At the time, this
office did not provide comments because we did not receive plans to review. it is our
understanding that 10 -foot asphalt paths arc required as a condition of approval. In addition, the
platted area would be allowed two curb cuts, one on 141" Street and 1 on Towne Road to serve the
proposed lots. The B oard of Public Works and Safety approved the 141" Street curb cut for lot
µlop March 3, 2004. Will this curb cut also serve lot #2?
11. Are there existing residences on lots #2, #3 or #4?
12. Since this is within the City of Carmel jurisdiction, please change the approval/signature block
from the Board of Hamilton County Commissioners to The City of Carmel Board of Public Works

13. Lot li I appears to consist of two parcels. Why is the lot divided'?
14. What does the 20' W.E. designation represent?
15. Towne Road is classified a primary parkway according to the 20 -Year Thoroughfare Plan and
therefore the required right -of -way width is 140 feet (70 -foot half). Please increase the half right
of -way width for Towne Road that is shown on the proposed plat as 60 feet to 70 feet.
16. Will the 1.& E.E. between tots 3 and 4 will serve multiple lots or be the subdivision entrance?
The Department of Engineering requests this to be located at least 500 feet from the Towne
Road/141 Street intersection unless it will be considered a common driveway for lots 3 and 4.
17. The Department requests that the right -of -way corner cut at Townc Road and 141' Street be
located to accommodate a 120 -foot radius roundabout centered on the apparent centerline

We have reviewed the plat submitted to the Hamilton County Survey'or's Office on Jaamiary 25,
2005 for this project and have the following comments:
1, The Hamilton County Sur'veyor's Office still has outstanding comments on
project from the letter dated October 12, 2004. This c onus

Almond Regulated Drain is incorrectly shown the ROW of
location was shown, Z believe we will rated drain easements as called out in LC. 3b.9-
141 Street to meet the statutory regulated
27 -33. This will push the 15' L.E. back behind this easement and will require
revisions to the presented plat. This must be done before we will present any
reduction of the regulated drain easement to the Hamilton County Drainage
