Re: Shelbourne Estates, Landscape Buffer modification
Recently, a compliance determination was made by the Director of the Department of
Community Services regarding an agreement between the Shelbourne Estates Property
Owner Association and Boomerang Development LLC, the developer of the subdivision.
The agreement will reduce the number of plantings within the landscape buffer approved
by the Plan Commission in 2002, while allowing for installation of a landscape irrigation
system by the developer to assist with maintenance of a significant portion of buffer and
landscaped common area. A copy of the full Director's determination is attached.
The reason you are receiving this information is that you are an adjoining and affected
property owner. Pursuant to the Carmel Zoning Ordinance, Chapter 30.0, this
determination may be appealed to the Carmel Board of Zoning Appeals (BZA).
Should you disagree with the determination and wish to file an appeal to the BZA, please
contact Connie Tingley, Secretary to the BZA, at (317) 571 2419, or by emailing her at
ctingley @carmel.in.gov. Appeal requests must be filed with the BZA by July 11, 2008,
or, after which, this determination will be final.
