Docket No. 10 -02 Z; Village of West Clay Rezone The petitioner seeks approval to rezone an area on the West side of Towne Road (within the existing PUD) from Secondary Area to Primary Area. Docket No. 11 -02 OA; Village of West Clay PUD Text Amendment Petitioner seeks favorable recommendation of a text amendment to a PUD /planned unit development district. The site is generally located at the southeast corner of West 131 Street and Towne Road. The site is zoned PUD /Planned Unit Development. Filed by Jose Kreutz of Brenwick TND Communities, LLC. The Department Report for the above two items has been consolidated. Both the rezone and the text amendment pertain to the proposed changes within the existing PUD. The applicant is proposing modifications to the areas, where the "Village" type of homes are permitted, within the existing WestClay Village Planned Unit Development District, to permit a church on a portion of the real estate, and to further define the Primary Area designation. Please refer to the informational booklet provided by the applicant. In addition to the explanation outlined in the informational booklet, the Department has asked the applicant to provide a section -by- section breakdown similar to the approach taken last fall in explaining the proposed amendments. The Department views the proposed amendments and rezone as positive changes in the evolution of the development. Brenwick is proposing necessary changes that will allow more of the development to truly reflect the character that the Village represents that could not be accommodated by the existing secondary area designation on the west side of Towne Road. This in turn will enhance the quality of the unique village setting established within the area south and west of the Meetinghouse (the Primary Area). The Department would like some additional explanation by the petitioner in order for the Commission to evaluate their overall implications. The petitioner should be prepared to address the following: 1. Outline the proposed new language for specific sections of the ordinance and provide the rational for each change. (section -by- section, excluding changes approved last fall) 2. Illustrate for the Commission where, within the development, the primary area will be applied and the distinction between the proposed "SF" and "MU" designations within the Primary Area. 3. How will the proposed rezone and text amendments change the character of the development as originally proposed? Explain the new vision for the area at the southwest corner of 131 Street and Towne Road. The Department is in support of the amendments proposed by Brenwick Development. Unlike the amendments approved by the Plan Commission last fall, regarding development standards, the amendments proposed today, as well as the rezone, will require final action by the City Council. The applicant's goal should be to provide the Plan Commission with an accurate picture of how the proposed amendments and rezone will further build on the character of the development established within the Primary Area. The Department recommends that these items be forwarded to the Subdivision Committee on April 9 for further discussion.
