Docket No. 10 -02 Z; Village of West Clay Rezone The petitioner seeks approval to rezone an area on the West side of Towne Road (within the existing PUD) from Secondary Area to Primary Area. The site is generally located at the southwest comer of West 131 Street and Towne Road. The site is zoned PUD/Planned Unit Development. Filed by Jose Kreutz of Brenwick TND Communities, LLC. 4i. Docket No. 11 -02 OA; Village of West Clay PUD Text Amendment Petitioner seeks favorable recommendation of a text amendment to a PUD /planned unit development district. The site is generally located at the southeast comer of West 131 Street and Towne Road. The site is zoned PUD/Planned Unit Development. Filed by Jose Kreutz of Brenwick TND Communities, LLC. The Department Report for the above two items has been consolidated. Both the rezone and the text amendment pertain to the proposed changes within the existing PUD. Please refer to the information submitted by the applicant at the time of the Public Hearing and Committee meetings. The Subdivision Committee has forwarded a favorable recommendation to the full Plan Commission by a vote of 4 -0 on Docket No. 10 -02 OA, the Rezone. The Subdivision Committee has forwarded a favorable recommendation to the full Plan Commission by a vote of 4 -0 on Docket No. 11 -02 OA, the Text Amendment, with the following conditions exemptions: 1. That the PUD not permit an inn, with up to 100 rooms, within the area designated Primary Area (MU) west of Towne Road, 2. That the PUD not permit attached dwellings (not exceeding four family use), within the area designated Primary Area (SF) west of Towne Road, and 3. That the applicant not permit automobile repair as part of an automobile service station. As the Commission may recall, automobile repair was included as part of the amendments approved by the Commission last fall. The applicant has provided the Subdivision Committee with an accurate picture of how the proposed amendments and rezone will further build on the character established within the village. The committee voted 4 -0 in favor of the Rezone. The rezone addresses the designation of the three areas within the PUD. There is the Secondary Area where primarily detached single family uses area permitted. There is also the Primary Area. The applicant proposes to split the existing Primary area into two sub sections, the Primary Area (SF) where residential and recreational uses are permitted and the Primary Area (MU), where in addition to the above listed uses, civic and commercial are permitted. Please refer to the current and proposed zoning exhibits contained under tab two of the informational booklet dated March 27 As noted above the Committee differs on three points with the proposed text amendments. One can see from the proposed zoning exhibit that the area on the west side of Towne designated Primary Area (MU) is relatively small, centrally located, and serves a means to tie the development on the west side of Towne Road into the concept and feel of the village on the east side. This area could accommodate a larger use such as an inn to serve as a termination to the view down Gleeb Street that ends at the Meeting House to the east. The intensity of uses permitted within Primary Area (MU) west of Towne Road are understated and serve as a connecting elements, tying the east side of the village to the west. In addition, surrounding residentially zoned properties to the north, west, and south are buffered by residential uses proposed within the Primary Area (SF). The Department is in support of the changes to the development as currently proposed and are confident they will continue to enhance the quality of West Clay and build on the unique character of the area. The Department recommends that the Plan Commission forward Docket No. 10 -02 OA, the Rezone, on to the City Council with a Favorable Recommendation as proposed. The Department recommends that the Plan Commission forward Docket No. 11-02 OA, the Text Amendment, on to the City Council with a Favorable Recommendation, as amended, in the form proposed under version dated 5/7/02 (version reviewed by the Subdivision Committee on May 14th).
