THIRD AMENDMENT
TO
THE COMMONS AT CITY CENTRE CONDOMINIUM DECLARATION
Pedeor Residential, LLC (the "Successor Declarant successor to the rights of the
original Declarant, Kosene Investments, LLC, "Kosene pursuant to a transfer and assignment
of rights by Kosene to the Successor Declarant, does hereby amend that certain Commons at City
Centre Condominium Declaration (the "Declaration recorded as Instrument No. 2004 -80918 in
the office of the Recorder of Hamilton County, Indiana on December 1, 2004, which has
subsequently been amended, as follows:
1. The purpose of this amendment is to expand the condominium as permitted by the
Declaration to add more land by the recording of a revised legal description and the recording of
revised floor plans.
2. The original. Exhibit A is hereby amended to add the additional land described in the
expanded legal description attached hereto as Exhibit A.
3. The original Exhibit A -1 site plan is hereby deleted in its entirety and the amended
Exhibit A -1 site plan is hereby substituted in its place.
4. The reference to floor plans in the Declaration is hereby amended to add the floor
plans that have been recorded as Instrument No. with even date herewith.
5. Except as amended by this Third Amendment to The Commons at City Centre
Condominium Declaration (the "Third Amendment the Declaration as previously amended
shall remain in full force and effect.
