We understand that we will be scheduled for the August 16, 2006 TAC meeting and that this case
will be tabled at the August Plan Commission meeting. Please note that the parking spaces have
been removed from the drive between the proposed Pre -Owned Facility and the Train Express
Facility. It is still our intent for the Train Express Facility to receive TAC approval and to
proceed with construction prior to full DP /ADLS approval of the remainder of the site by the Plan
Commission.

Following please find our responses to your letter dated July 13, 2006
1. A copy of the landscape plan approval letter /e -mail from the Urban Forester is required
prior to approval.
Bill Estes and representatives from CSO, Schneider and Bingham McHale met with Mr. Scott
Brewer on July 13, 2006 to discuss the proposed landscape plans. His comments have been
incorporated into the revised plans enclosed in this submittal.
2/3. Please note that elevations must comply with the requirements of the US 421 /Michigan
Road Overlay. The use of EIFS may not exceed more than 20% of the total non window
facade area. Required materials include red brick, stone, or wood clapboard or bead board
siding. Buildings in the Overlay must be consistent or compatible with one of the following
styles of architecture: Federal, Georgian, Greek Revival, or Italianate. This includes all
elements of the structure, including windows.
It the goal of this petition to meet the spirit of the ordinance by incorporating Federal,
Georgian, Italianate or Greek Revival elements into the design of the new building.
However, there is an innate challenge in this task due to the fact that these building styles
were developed prior to the creation of car dealerships and the unique design needs this
building type creates. This challenge is heightened by the fact that Bill Estes' Chevrolet
dealership is located across the street in a modern-style building. It is important to the
identity of the Bill Estes name that the two facilities have a common identity. The use of the
EIFS material allows this connection through color while providing for the more traditional
design style that Carmel desires. The petitioner has applied for a variance for the EIFS
material to exceed 20% of the non window facade area.
The petitioner believes that the building design does reflect Italianate elements and welcomes
a chance to discuss with staff the proposed design of the building. The ordinance states that
new buildings are not required to be imitative of the aforementioned styles, but are to
incorporate the salient features of said architectural styles.

4. Please provide information on proposed signage.
The signage plan is shown on the elevation drawings submitted with the original plans. The
proposed signs are wall signs that read: "Bill Estes Pre -Owned Superstore The "Bill Estes"
and "Pre -Owned Superstore" are split into two signs with the "Bill Estes" located over the
archways and the "Pre -Owned Superstore" on the canopy on either street frontage. Variances
have been requested to allow the sign to be divided into the two components. The total sign
area is indicated on the application and is within the ordinance requirements.
S. A ten foot multiuse path is required along Michigan Road. Please indicate this path on the
revised plans.
There was some confusion as to whether this path was required along Michigan Road or
along 96 Street. A 10 -foot wide multi use path has been added to the plans along 96 Street
as requested by Karyn Ryg who indicated that a path already exists on Michigan Road.
Included in this submittal are the plans showing the changes detailed above. Should you have

Dear Ms. Ryg,
This letter is in response to the review comments dated July 7, 2006 for the above
mentioned project. The following are the actions we have taken in response to those
comments.
1. A 10' asphalt path has been added along the 96 Street frontage of the existing
pre -owned building. However, the project has added ;the existing Scuba
Building to the west. Due to the existing drainage structures within the ROW
and the close proximity of the roadway, ROW, existing drainage structures and
detention pond in this area the path was ended at the'Scuba driveway.
2. ADA ramps have been indicated at the crossings as required.

4. Mr. Bill Leonard will be the person responsible for designating a trained
individual for the installation, inspection and maintenance of erosion
control measures. At this time, a contractor has not been selected and
therefore the properly trained individual has not been designated.

7. Notes revised as requested to include Post Construction storm water
pollution prevention measures only.
8. Notes revised as requested.
9. C5 on C802 has been revised to require yearly inspection
maintenance of measure listed. Post Construction Structural BMP is
referenced to the Operations Maintenance Manual and the
manufacturer's recommendations.
10. Neither the existing or proposed buildings will be performing automobile
maintenance. The easternmost building will be offices only. The
western building will be remodeled to prepare automobiles. All vehicle
repairs will be handled at the new car facility on the south side of 96
Street. However, a separator is planned for the western building before
discharging internal floor drains to the sanitary sewer system.
Enclosed is an 11x17 Storm Water Pollution Prevention Plan as listed in the
review checklist. Please review the above responses and enclosed plans.
