AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
AMENDING CHAPTER 8, ARTICLE 3, SECTION 8 -25 OF THE CARMEL CITY CODE
WHEREAS, the City of Carmel, Indiana, has the authority to establish speed limits on multi -use
trails located within its corporate boundaries; and
WHEREAS, the Common Council now finds it necessary and in the interests of public safety to
establish the 15 m.p.h. speed limit on the Hagen Burke Trail.
NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1. The foregoing Recitals are incorporated herein by this reference.
Section 2. Chapter 8, Article 3, Section 8 -25, of the Carmel City Code should be and the same is
hereby amended to read as follows:

"8 -25. Speed Limit Designations.
(a) No person shall operate any vehicle, as that term is defined in I.C. 9 -13 -2 -196, as amended, in
excess of 20 miles per hour along the length of the Monon Greenway, excepting:
(1) The Monon Greenway from its intersection with 111th Street to its intersection with 136th
Street, where the speed limit shall be 15 miles per hour.
(2) Reserved.
(b) No person shall operate any vehicle, as that term is defined in I.C. 9 -13 -2 -196, as amended, in
excess of 15 miles per hour along the length of the Hagan -Burke Trail.
(c) Reserved.
(d) Any person who operates a vehicle in violation of this Section shall, upon conviction thereof, be
fined in an amount not less than $50 nor more than $500 for each such violation."
Section 3. It is directed that appropriate signage be promptly installed consistent with this request.

Section 4. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance
are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance.
However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or
liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance.
Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under
such repealed or amended ordinance as if this Ordinance had not been adopted.
Section 5. If any portion of this Ordinance is for any reason declared to be unconstitutional or
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as
enforcement of same can be given the sane effect.
Section 6. This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.
