All I am a homeowner in Springmill Crossing Subdivision soliciting your thoughts relative to the removal of a 10 -ft wide
easement on lot 121 (see attached graphic). I would appreciate a letter response appropriate to present with a Secondary
Plat Amendment petition to remove the easement.
I intend to ask my neighbors if they are interested in joining the petition, so it would be very helpful if you would provide a
separate response for lots 118, 119, 120, 122 123.

I have looked at the GIS information. It does not appear to me that drainage.relies on the 10 -foot easement to move
runoff laterally within the rear yards. Drainage based on the contours (although very, very flat) appears to drain from
the rear of the yards to the front and into the streets via the side yard swales. I did not notice any poorly drained areas
or ponding water in the rear yards when I visited the site yesterday.
I expect that the only water that moves laterally within the easement is runoff from the property's themselves (a given
property does not rely on the easement to convey runoff through another property). The Hamilton County Surveyor's
Office does not believe that there is a sub surface drain within the 10 -foot easement. I would still feel better if we
inspected the manhole two lots to the east for evidence of a rear yard, sub surface drain. I will plan to schedule this as
soon as possible.
If there does not appear to be a sub surface drain in the easement, Engineering would not oppose vacating this
easement. With the existing encroachment, I expect that any function this easement served or was intended to serve
has long since been void.

1 will try to answer some of your questions. Based on the preliminary feedback from the TAC members, I think you can
95% assume that there are no utility lines in that 10 -ft wide easement in your back yard. If you include a neighbor in the
replat application, they will need to have their parcel included in the replat /secondary plat document, which will
probably involve some extra surveying by the land surveyor /engineer that you hired.

Carmel Utilities does not have any facilities in this area so we do not have any objections or concerns. Please note

to the pipeline, it is a good question (fyi; Greg Noyes responded that this easement contains no Hamilton County
regulated drain so there are no rights to the easement Duke Energy has also expressed no objection).
Can you advise if a source exists that will describe the original purpose for the easement? If not, I would appreciate your

Scott: We don't have the construction plans for Section 3 of this subdivision but do have Section 2. The D.E. along the
same line as this section is showing SSD lateralsfrom the homes along this easement, I would think this owner wants to
use that strip something which could disrupt the laterals for other homes connected to the same pipe. If there is a
defined swale'n this easement and he fills it in there could be possibility of blocking water on other lots. Did he state
why he wants the easement vacated? As far as the L.E., I assumed this is for landscape which could be a required buffer
at time of submittal, that is likely your call on that. Maybe Gary will have additional input.

From the information I have, no Regulated Drain facilities exist within that easement, so we have no easement rights to
that easement. With that said, I will also agree with Gary that permanent structure within a easement cause issues like he
said, but they also cause deed issues when a title company finds the structure within the easement.

It is an option Angie; however, we typically do not support CTE agreements for structures, or any portion of them
including equipment like HVAC units, into easements. The structure represents such a significant portion of the property
value and it is too much to have at risk in the event that the easement holders exercise their rights to the easement. Of
course, I cannot speak for the Carmel BPW or the HCDB ....they might want to go this route....

All I am a homeowner in Springmill Crossing Subdivision soliciting your thoughts relative to the removal of a 10 -ft wide
easement on lot 121 (see attached graphic). I would appreciate a letter response appropriate to present with a Secondary
Plat Amendment petition to remove the easement.
I intend to ask my neighbors if they are interested in joining the petition, so it would be very helpful if you would provide a
separate response for lots 118, 119, 120, 122 123.
