They have not responded at all. This is their typical way to do things, and it seems to be a major problem. They, it seems to me, propose a design that has significant problems, and ask that we just approve it and they'll fix the problems when they have to (before the approval), and then blame their client for wanting something that does not work, or for not providing the information. The same thing happened on Pinnacle Point and the Fineberg Building, and probably several more that I could name. It appears to be a pattern with the DeBoy firm. I would guess that Engineering has problems with the design that have not been resolved. I have not even gotten plans that show the right -of -way lines, and there are significant trees both in the right -of -way and in their set backs that they are required to preserve in the 31 Overlay.. These were the TAC Comments I sent to Mr. DeBoy last month, and I have heard nothing. During my initial review of the site plans for this submittal, I noticed a few problems. 1. No where can 1 find on the existing conditions site plan, the landscape plan, or the site plan any.visible indication of where the right -of -way lines are. They must be shown. 2. Even on the utility plan there is no indication of drainage or utility easements. These easements and the right -of -way must be included on the plans so that 1 can be made aware.of potential conflicts. 3. In the US 31 overlay zone there are requirements for tree preservation. There are no indications of any tree preservation at all. There are also many trees in the right -of -way, they must also be preserved. These need to be shown on the existing conditions plan. Grade changes need to be taken into consideration as well. 4. This site is covered by the US 31 overlay and Section 26.04 bufferyard requirements. A chart should be prepared and submitted on the landscape plans, which shows the amount of plant material that is required, and the amount that is proposed. 5. There is no landscape buffer on the east side of the building. Unless a buffer is proposed to be provided and committed to remain on the adjacent property, that does not meet the ordinance. Required parking is 1 space per room, which means you must provide 103 parking spaces. Variance approval will be needed to reduce the number of required parking spaces (8S). However a 1990 document of commitments shows a site plan for the site as one whole parcel and no split of the to tax id parcels. The split of land for tax purposes occurred between 1990 and 2005, as a best guess. Go to http: / /www.co.hamilton .in.us /gis /framecounty.html . You can zoom in and right click on a selected parcel for info. -- The initial rezone of the parcel also shows the initial development plan for this overall area. It was well over 5 acres. After the initial rezone, the land can be divided up and sold as smaller parcels. Fell free to contact Mike Hollibaugh, DOCS director, for additional clarification at 571 -2417. See below. Regarding your question about requiring a minimum tract size of 5 acres in the us 31 overlay — read the following zoning ordinance excerpt: 23B.07 Minimum Tract Size: A. Except as provided in Paragraph C, below, the minimum area covered by a DP within the U.S. Highway 31 Overlay Zone must be 217,800 square feet (5 acres). B. If a Parent Tract (Tract) is located both inside and outside of the U.S. Highway 31 Overlay Zone, a DP shall be submitted to the Commission for the entire tract. Wherever there exists a conflict between the requirements of the underlying zoning and those of the U.S. 31 Overlay Zone, the requirements for the U.S. 31 Overlay Zone shall prevail. C. If a parcel of land or subdivision lot was recorded prior to April 21, 1980 (the "Effective Date"), and said parcel or lot does not contain the minimum area required by this Paragraph, said parcel or lot ( "Undersized Lot ") may be used for any use permitted in the U.S. 31 Overlay Zone provided that: (1) At the time of recordation of the Undersized Lot or on the Effective Date, the Undersized Lot met the requirements for minimum lot size then in effect for a lot in the underlying primary zoning district(s); (2) The owner of the Undersized Lot must include any adjoining vacant land (not separated by a street or public way) owned or owned by an affiliate on or before the Effective Date or at the time of application which, if combined with the Undersized Lot would create a parcel which conforms, or more closely conforms, to the requirements of this Paragraph: and, (3) All other requirements applicable to the U.S. 31 Overlay Zone can be met. D. Section 238.07 does not preclude the sale or other transfer of any parcel of land within a Parent Tract after the approval of a Development Plan (DP) for the entire tract. However, the development of the parcel must still conform to the DP for the Parent Tract as approved or amended by the Commission, and all other applicable requirements contained in the Zoning Ordinance. Regarding your question on lot coverage percent and green area: 23B.08.06 Maximum Parcel Coverage and Density_ A. Maximum Parcel Coverage shall be sixty-five percent (65 %) of any parcel covered by a DP. B. Maximum Floor Area Ratio (F.A.R.) shall be 0.70, with the F.A.R. being calculated by dividing the total gross floor area of a building or buildings on any parcel by the area of such parcel. 5/14/2007 CARMEL 0000670 Page 2 of 2 Also, in the recorded commitments of 1990 for these parcels, it does give a maximum Height of 60 -ft or 4 stories whichever is less. I will bring this up at the Plan commission meeting tomorrow. Traffic: the engineering dept is still reviewing this item. I will make sure they know your comments. Due to the fact that the planned use for each of these parcels was not likely what was anticipated when Pro -Med Lane was initially approved and developed, I feel that a traffic study is warranted to identify if improvements are necessary on Smokey Row Road (a dedicated left [not likely] or making the existing auxiliary lanes longer) or out at the intersection of Old Meridian and Smokey Row.
