The Committee met at 6:00 PM in the Caucus Rooms of City Hall, Carmel, Indiana. Members present: Kevin Heber, Steve Stromquist, Madeleine Torres, Susan Westermeier. DOCS Staff in attendance: Christine Barton- Holmes,Rachel Boone. Also present, John Molitor, Legal Counsel. The Special Studies Committee considered the following items: 1. Docket No. 07030035 DP: Pro -Med Lane Holiday Inn The applicant seeks site plan approval for a proposed full- service hotel. ADLS is under another docket no. below. The site is located at 136th Street and Pro -Med Lane, and is zoned B- 6/Business within the US 3I/Meridian Street Overlay. Filed by Stacey of DeBoy Land Development Services, Inc. for Justus Home Builders, Inc. TABLED TO JAN 8, 2008 2. Docket No. 07070009 ADLS: Holiday Inn at Pro Med Ln The applicant seeks architecture /design approval for a proposed full- service hotel. The site is located at 136"' Street and Pro Med Lane, and is zoned B6, within the US 3I/Meridian Street Overlay. Filed by Dave Coots of Coots, Henke Wheeler for Midwest Hospitality Group, Inc. TABLED TO JAN 8, 2008 3. Docket No. 07110016 ADLS Amend: Parkwood Crossing West Firestone The applicant seeks approval for 2 new wall signs. The site is located at 250 W 96"' St. It is zoned PUD /Planned Unit Development. Filed by Paul Reis of Bose McKinney Evans for Bridgestone Firestone Diversified Products. Paul Reis, attorney, Bose McKinney Evans appeared before the Committee representing the applicant. Also present: Steve Granner, Bose McKinney, and John Viscutta, Firestone. The petitioner is requesting two new wall signs for Building C within the Parkwood Crossing West development located at 250 West 96"' Street. One sign will be located on the north fagade, one on the east ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571 -2417 fagade. Each sign will not exceed 90 square feet in area. The Signs will show "Firestone" in red, with a white background. Department Comments, Rachel Boone: Parkwood Crossing West is a PUD and the signs have been approved by Duke Realty. The Department suggests that the signs show white at night, and white or black during the day. There was discussion regarding the red "Firestone." However, Duke has approved the red. Madeleine Torres made formal motion to approve Docket No. 07110016 ADLS Amend Parkwood Crossing West Firestone wall signs as presented, seconded by Susan Westermeier, Approved 4 -0. 4. Docket No. 07110019 ADLS Amend: Floor Crafters Signage The applicant seeks approval for 1 new ground directory sign and 1 new wall sign. The site is located at 12345 Old Meridian St. It is zoned OM /O Old Meridian District /Office. Filed by Aaron Wilson of Floor Crafters. Aaron Wilson, Floor Crafters, 12345 Old Meridian Street appeared before the Committee representing the applicant. The petitioner is seeking approval for one new ground sign and a wall sign on the building. The ground directory sign will be landscaped at the base. The wall sign will be internally lit; the sign measures 29.9 square feet of sign area. The petitioner is also requesting a four -foot directional sign on Old Meridian Street. Note: BZA approval is required for the wall sign that would not be oriented toward the right -of -way. Department Comments, Rachel Boone: The directional sign is considered a part of the sign package and is allowed. The wall sign on the north facade does not face a public right -of -way and a variance would be required from the Board of Zoning Appeals. The Department recommends approval after all concerns have been addressed. There was discussion among the Committee members regarding the difficulty of this siteit is owned by John Kirk, behind the "John Kirk Boats" facility, and has no frontage. There is a need for the directional sign. Sue Westermeier made formal motion to approve Docket No. 07110019 ADLS Amend, Floor Crafters Signage, subject to BZA approval, seconded by Kevin Heber, Approved 4 -0. 5. Docket No. 07110020 ADLS Amend: River Oaks Community Church (ROCC) Sign The applicant seeks approval for 1 new wall sign. The site is located at 13200 Old Meridian St. It is zoned OM/SU Old Meridian District /Special Use. Filed by Dominic Francese of ROCC. Rick McKinney, Deacon of River Oaks Community Church appeared before the Committee in lieu of Dominic Francese. The applicant is seeking approval for a wall sign that measures 72.22 square feet in area with dimensions of 13.3 ft X 5.4 ft. The sign consists of a panel with dimensional letters, oriented towards Main Street. 2 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571 -2417 The proposed sign has the website address for the Church. The sign colors were displayed. The Church did not want to put a lot of money into a sign that could not be taken with them if they were to relocate to another area. Departrment Comments, Rachel Boone: The Departrment is recommending that the website address be removed from the sign. The Ordinance does not cover websites as a part of signage and this probably needs to be addressed with the revision of the Sign Ordinance. The sign would be better located on the brick fagade of the building or changed to a smaller ground sign located closer to the street. The Department recommends this item be approved after all comment and concerns have been addressed. Committee Discussion: Definitely the Sign Ordinance needs to be looked at with website addresses now in being. The website was not that obtrusive, and it is questionable whether it is discernable as people drive by the Church. The colors displayed were not to the Committee's liking —the colors did not show enough contrast. Perhaps the final approval of the sign colors would be better from the Department. Susan Westermeier made formal motion for approval of Docket No. 07110020 ADLS Amend, River Oaks Community Church (ROCC) Sign, subject to final approval by Rachel Boone, DOCS, of the sign colors, seconded by Kevin Heber, APPROVED 4 -0. 6. Docket No. 07070003 Z: 146th Gray Rezone (146th St Office Complex) The applicant seeks approval to rezone 11.6 acres from S -1 /Residence to B- 1/Business for an office /retail development. The site is located at the southeast corner of 146 St. and Gray Rd. Filed by Kelli Lawrence of Hearthview Residential, LLC. 7. Docket No. 07070004 PP: 146th St Office Complex The applicant seeks primary plat approval for 5 lots on 11.6 acres. The site is located at the southeast corner of 146"' St. and Gray Rd. and is zoned S -1 /Residence, pending a B -1/ Business rezone. Filed by Kelli Lawrence of Hearthview Residential, LLC Note: Items 6 and 7 were heard together. Joe Scimia, attorney, Baker Daniels, 600 East 96 Street appeared before the Committee representing the applicant. Also Present: Kelli Lawrence, Jim Thomas, and other representatives of Hearthview Residential. The petitioner is seeking a Rezone from S -1 Residence to B -1 Business and Primary Plat approval for a five, one -story professional office /retail buildings on 11.6 acres. Note: If approved, each building would return to the Plan Commission for Development Plan Amendment and ADLS review. Mr. Scimia said he had held meetings with the neighbors and they are at an impasse. The neighbors want the ground to remain as it is currently zoned. Members of the public: Amy Vandivier, north side of 146 Street, concern with well water and the stream, also traffic and curb cuts. Would like a commitment regarding hours of operation if retail is approved- 3 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571 -2417 would not want any type of drive -thru operation and no 24 -hour facility, would also like to see tree line preserved. Concern with noise generated from increased traffic and noise from the proposed development—cannot hear during Church Services on the north side of 146 Street. The neighbors would like more visual buffer and buffer from noise. A small park area would be appropriate for this project along the south side of 146 Street. Cesare Turrin, 5436 Woodfield Drive, president of Woodfield HOA. The HOA has the same issues that were stated at pubic hearing. The block is residential from Hazel Dell to Gray Road and this development is not congruent —does not fit with the neighborhood. There is no need for office space in this area. There are traffic issues and drainage issues, as well as shielding the neighbors on the southeast corner with the wooded area. The County Surveyor could remove the trees because of the Mitchner Legal Drain. Other concerns: Homeowners have invested a significant amount of money in their properties and feel that this proposal would adversely affect their property values. There is no independent analysis that says B -1 is the only option for this ground. The neighbors are flexible and can accept change in some zoning code, but not B -1. The neighbors and the developer are at an impasse. Consensus of the Committee: This is a difficult corner and the petitioner must be willing to work with the Department to get a product that is acceptable to the neighbors and everyone involved. Again, this is a difficult intersection. Joe Scimia thought the petitioner could meet a lot of the neighbors' concerns: tenants /occupants, traffic, buffer, etc. The petitioner will break down the grid even further. Docket No. 07070003 Z, 146 Gray Road Rezone (146 Street Office Complex) and Docket No. 07070004 PP, 146 Street Office Complex were CONTINUED to the January 8 Committee Meeting at 6:00 PM. 8. Docket No. 07090014 DP /ADLS: Weston Park, lot 2 Mike's Carwash The applicant seeks site plan and design approval for a car wash. The site is located at 10580 Michigan Rd. and is zoned I -1 /Industrial within the US 421 Overlay. Filed by Jim Shinaver of Nelson Frankenberger for Mike's Car Wash Inc. TABLED to Jan 8, 2008. 9. Docket No. 07090015 DP /ADLS: West Carmel Dr. Retail (Meijer Outlot A) The applicant seeks site plan and design approval for a multi- tenant retail building. The site is located at the northeast corner of Carmel Dr. Pennsylvania St. and is zoned OM/M Old Meridian District/Meijer Zone. Filed by Paul Reis of Bose McKinney Evans for Thomas English Retail Real Estate, LLC. Paul Reis, Bose McKinney Evans, 301 Pennsylvania Parkway, Suite 300 appeared before the Committee representing the applicant. Also present: Brian Cross, Architect, and Ken Kincaid, Tom English Real Estate. 4 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571 -2417 The applicant seeks site plan and design approval for a multi- tenant retail building consisting of 10,600 square feet located on 1.73 acres. The site is located within the Old Meridian District. The petitioner is currently seeking a development standards variance from the Board of Zoning Appeals. Note: Petitioner commits that signs will be consistent with the diagrams submitted and limited to one raceway. In sign criteria, petitioner will add signage to be located on the south and west facades, constructed upon one raceway, and limited to one sign on the east fagade. Petitioner also commits to no more than three colors per sign no colors specified at this time. Motion: Susan Westermeier to forward to Plan Commission with a positive recommendation, subject to approval from the City Engineer before anything is started on this parcel, seconded by Madeleine Torres. The vote was 2 in favor, 2 opposed (Torres and Heber) Motion Failed. Kevin Heber wanted a commitment from the petitioner as to a pedestrian cross -walk. Madeleine Torres wanted a commitment limiting the color palette for the signs. Paul Reis responded that the cross walk came up at TAC meeting —the cross walk would cross two aisles of parking. Also, the Ordinance does not have concrete, definitive standards regarding colors of signs. Madeleine Torres moved to reconsider the motion as previously stated, with the exception that the petitioner will eliminate all tenant signs on the north fagade of the building, seconded by Susan Westermeier, Approved 3 in favor, one opposed (Heber.) There was no further business to come before the Committee and the meeting adjourned at 8:50 PM.
