Buckhorn Estates, lot 6 Vasuta Garage Addition The applicant seeks the following development standards variance approval: Docket No. 10100003 V Zoning Ordinance Chptr 5.04.03.A: 40 ft front yard setback The site is located at 14039 Brookstone Dr. It is zoned S 1 /Residence. Filed by John Vasuta, owner. Findings of Fact: Encroachment into the 40 ft BSL General Info: The petitioner requests approval to construct a garage addition that will encroach 10 feet into the 40 -foot front building setback. In essence, this would create a 30 -ft front yard building setback. Analysis: This is a corner lot with frontage on two streets. The house face is oriented west toward Brookstone Drive. The south end of the lot is planted with evergreen trees which screen the view of the garage year round. This tree line will be maintained. The building addition will match the existing house architecture, colors, and materials. 1. The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: this corner lot's size is close to the same size as other lots in the area that only have one frontage, yet this lot has 2 front yard setbacks which restrict the buildable area even more. The building addition, which will match the existing structure's materials and architecture, will add to the value of the property and the neighborhood. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the building addition, which will match the existing structure's materials and architecture, will add to the value of the property and the neighborhood. The existing tree line will remain and continue to screen the view of the garage(s). 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the garage addition could not be placed near the existing garage. It would have to be placed to the rear of the lot, which could affect the usability of the structure. Or, the garage addition could not be placed on the lot at all. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 1010003 V after all concerns have been addressed.
