Legal Counsel Report, John Molitor: The Executive Session of the Carmel Plan Commission Executive Committee scheduled for this evening has been postponed. A meeting is now scheduled for Tuesday, October 28, 2008 at 5:30 PM in the Caucus Rooms, prior to the Comprehensive Plan meeting. Rick Ripma, Vice President called the meeting to order. Leo Dierckman joined the meeting in progress. Motion: Carol Schleif to "Re -order the Agenda to hear New Business Item 08080020 ADLS, Hotel Indigo as the first item of business," seconded by Sue Westermeier, Approved 8 -0. Motion Carried. Angie Conn reported that Items 1 -2H, Docket No. 08070022 DP Amend/ADLS and 08070023 ZW, St. Vincent Sports Performance Center were Tabled to November 18, 2008. J. New Business 1J. Motion Carried. 11. Docket No. 08080003 OA: Amendment, Contributing Buildings The applicant seeks approval to amend Zoning Ordinance Chapter 23D.02.B.5, Old Town District Overlay Zone, in order to prevent the demolition of contributing building in Old Town without consent of the Director. Filed by the Department of Community Services, on behalf of the Carmel Plan Commission. Present for Petitioner: Mike Hollibaugh, Director Department of Community Services. Overview: Amended Ordinance came out of Subdivision Committee Document would amend Zoning Ordinance regarding Demolition of Contributing Buildings Contributing Buildings have characteristics in keeping with historical construction in Old Town Currently, property owners in Old Town Character sub -areas can demolish a structure without consent of City Amendment will prevent demolition of any contributing building unless consent granted by Director Document establishes additional criteria for placement, removal and different types of what is and is not to be demolished Criteria for demolition has been added Ordinance would expand authority of Director to review Currently Old Town Overlay only has ability to affect historic homes in Old Town sub -area Document would provide for review and perhaps prevent demolition of buildings Ordinance defines significance Ordinance provides a sunset clause —added at the request of Committee Committee Report, Carol Schleif: Unanimous vote to forward to Commission with a positive recommendation Department Report, Angie Conn: Recommend forwarding to City Council with a favorable recommendation Commission Concerns /Comments: What is considered reasonable to furnish to Director to make a decision? Reasonable cost of additional documents Director may impose? Scaled streetscape —what is needed? On qualifying structures— possible to repair rather than replace? Why is this being done? How will owners of those structures be notified? (other than publishing in the paper) Protects theme of neighborhood Essence of Old Town overall is preserving character and structures Preserving only because of age of building? Area has "Old Urban" flavor Possibly create conservation district within the area with homeowners developing their own guidelines Map displayed of structures that might currently qualify to be on National Register S:/P1anCommission/Minutes/PC- 2008 /oct21 4 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571 -2417 John Molitor Comments: Ordinance would apply in situations where someone is seeking demolition and replacement with a building to better fit the neighborhood Mike Hollibaugh Clarifications: Case -by -Case review basis Would review as a whole if it were a garage /accessory structure rather than contributing Being done out of concern for some structures along First Avenue NW Also being done in response to the "Applegate" tear -down Currently a lot of speculative interest in Old Town Additional guidance and specificity needed in Old Town regarding structures of historical significance and contributing to character of Old Town. Notification to owners of structures not yet contemplated currently there are 2 stop -work orders on structures in Historic area Motion: Sue Westermeier "To forward Docket No. 08080003 OA, Amendment, Contributing Buildings to the City Council with a favorable recommendation," seconded by Jay Dorman, approved 9 -0. Motion Carried. 2I. Docket No. 08080016 OA: Amendment, Carmel Clay Schools; Partial Exemption The applicant seeks approval to add Zoning Ordinance Section 28.08: Carmel Clay Schools; Partial Exemption, in order to lay out approval requirements and procedures for new facilities and buildings proposed by the Carmel Clay Schools. Filed by the Department of Community Services, on behalf of the Carmel Plan Commission. Present for Petitioner: Angie Conn, Department of Community Services. Committee Report, Rick Ripma: No valid reason to change procedure No reason to grant exemption to school Schools should go through the same process as residents and developers Educators do not necessarily make planners Schools have direct impact on adjoining residences /neighborhoods Committee voted a negative recommendation John Molitor: BZA reviews school proposals School Board meets same night as BZA Motion: Susan Westermeier, "To forward Docket No. 08080016 OA, Amendment, Carmel Clay Schools, Partial Exemption to the City Council with a negative recommendation," seconded by Carol Schleif, approved 9 -0.
