The minutes of the November 18, 2008 meeting were approved as submitted by Unanimous Consent
Legal Counsel Report— Executive Session canceled for tonight. The balance of the Legal Counsel
Report will be heard at the end of the meeting.
Department Report, Angie Conn: The Ordinance Amendment amending the Old Town District Overlay
Zone has been further amended by City Council and returned to the Plan Commission for consideration.
John Molitor noted that the Commission has 45 days to consider the amendment; the Commission may
also take action this evening.
Motion: Woody Rider "to approve Z- 523 -08 as Amended," (Amendment to the Old Town District
Overlay Zone Ordinance text, seconded by Rick Ripma, approved 8 -0. Motion Carried.

The applicant seeks site plan and design approval for an automobile repair facility. The site is
located north of 11055 Michigan Rd. and is zoned 13- 2/13usiness within the Michigan Rd
Overlay Zone. Filed by Jamie Shinneman of Weihe Engineers for Firestone Service Center.

The applicant seeks site plan and design approval for a mortuary. The site is located at 11411
N Michigan Rd. and is zoned B-5/Business. Filed by Charlie Frankenberger of Nelson

Pole Lights petitioner agreed to extend shielding of light poles along northern part of acorn fixture
Shielding of light poles would remain intact when bulbs changed and fixture maintained
Parking Lot Lights petitioner agreed to turn on at sundown, off at 10:00 PM —except pole light on
front elevation of building that faces south

northeast of 116"' St Guilford Rd and is zoned PUD /Planned Unit Development. Filed by E.

J. New Business
None
Legal Counsel Report, John Molitor: (continued)
1) City Council last evening approved the settlement agreement with Martin Marietta, BZA, and
the Mayor, bringing a conclusion to litigation in the 1999 -2000 era.
2) Molitor is working with a Committee on State Bar Association up- dating legislation regarding
planning and zoning; John has arranged for newly elected representative Joe Pearson from
Kokomo to introduce legislation during General Assembly. Carmel could perhaps review
legislation in a seminar.
3) No further activity on pending litigation regarding Holiday Inn matter.
