HomeMy WebLinkAboutCorrespondence: County Highway Dept CommentsJune 6, 2008 Mark Obergfell TLF Consulting Engineers 8675 Purdue Road Indianapolis, IN 46268 HAMILTON COUNTY HIGHWAY DEPARTMENT RE: LA Fitness Weston Park Block "A" Replat Secondary Plat S of 106th Street W of Michigan Road Clay Township Dear Mr. Obergfell: This letter serves to acknowledge receipt of a transmittal received 05/27/08 containing the Secondary Plat for review. After reviewing the plat the Highway Department has the following comments: 1. An Application for Project Review must be completed and the appropriate review fees paid prior to any approvals from this office. The application is available on the County Website. 2. Please include this statement on the Plans: Decorative signs, sprinkler systems, trees, landscaping mounds, fences, light poles or other such amenities are not permitted within the Right -of -Way. 3. The Right -of -Way along 106 Street must be clearly labeled. 4. Remove the statement: All public streets and alleys shown and designated as such and not heretofore dedicated are hereby dedicated to the public. Other public lands shown and not heretofore dedicated are hereby dedicated for the purposes designated hereon. 5. Replace the statement in comment #3 with: The Right -of -Way along 106 Street is hereby dedicated to the public. 6. Please include this statement on the Plat: The owner and any and all successors and assigns hereby waive all rights to petition the Hamilton County Highway Department, the Hamilton County Board of Commissioners, or Hamilton County, or the successor unit of government to be responsible for the maintenance of the ingress- egress easement, or to have the easement considered a public road necessitating maintenance by any unit of government. 7 Please include this statement on the Plat: Where common drives are shown on this plat, those lot owners abutting such drives shall own equal and undivided interest in such drives as tenants in common, and it shall be the obligation of each owner in common with the other lot owners abutting such a drive to contribute an equal share of the cost of the maintenance of such drives. Where a majority of lot owners served by a private drive elect to repair the private drive and one or more lot owners fails to pay their allocable share of such repair, then the owners paying such cost may file a lien for the reasonable value of labor performed and materials furnished a prescribed by the lien 1700 South 10 Street Office (317) 773 -7770 Noblesville, In. 46060 www.co.hamilton.in.us Fax (317) 776 -9814 laws of the State of Indiana against any such lot and the owner thereof and recover the full assessment owed together with interest from due date and reasonable attorney's fees. The private drive may contain utilities to serve said lots in which event the several property owners shall maintain the utilities not otherwise maintained by the respective utility in the same manner as set out for drives. All private drives shall also be a utility easement. 8. Further comments may be needed at a later date.
