The site is located at 10575 N Michigan Rd. and is zoned B -3 /Business within the US 421 Overlay. Filed by Charlie Frankenberger of Nelson Frankenberger for Yum Brands, Inc. Charlie Frankenberger presented for the petitioner. He was accompanied by Joe Boyle of Yum Brands, Inc. Charlie distributed an aerial photograph with a conceptual site plan superimposed on the photo. This project will be going forward to both the BZA and Plan Commission meetings on June 23 and July 15 This building will replace the Ritter Ice Cream building. Alexia Donahue Wold, DOCS, no comment at this time. David Lucus Hamilton Co. Highway Dept. sent a comment letter approximately 1 month ago. This affects state road and internal streets therefore we currently do not have any comments, this could change. Jerry Liston, County Surveyors Office indicated that Greg Hoyes had sent a letter and asked if they had any questions. Joe Boyle indicated he expected to have the response to the comment letter tomorrow. He has no further questions. Chris Ellison, Carmel Fire Department, he has done a drive by the structure and noted that there is an existing Knox Box on the building. He recommended that when they begin to demo the existing building please call Chris and he will come out and unlock the box so that the contractor can remove it and it can be reused. Chris asked how many sq. ft. the building will be. Joe indicated approximately 3,000 and the occupant load is in the 80's. Chris informed Joe that the City of Carmel has adopted the 2006 International Fire Code on Monday. Some of the codes will be much more restrictive than in the past. Ryan Hartman CTRWD he sent out a comment letter on June 2 and once those comments have been addressed he will have no further issues. Scott Brewer DOCS indicated he has been working with the petitioner and as of June 5 when final landscaping plans were submitted, Scott has approved the project. David Littlejohn -DOCS, a letter has been sent regarding bike parking and a pedestrian connection from Michigan Road to into the front door. David reviewed on the aerial photo The National City Bank building and this is how the path should look. Joe explained to David that directly in front of the building there is a ditch that runs directly in front of the building with cattails, etc., so the access to their facility will be from the side sidewalk, they will be providing handicapped access and showed where the bike parking will be. David responded that this would be fine if the bike parking adhered to the ordinance. Docket No. 08050019 TAC: Carmel East Salt Barn The applicant seeks approval for a salt barn, incinerator, sweep dump, and retention pond. The site is located at the southeast corner of 106th St. and Gray Rd. It is zoned S1 /Residence. Filed by Dave Huffman of the Carmel Street Dept. Graham Lewis of Cripe Engineering presented. He was accompanied by Dave Huffman and David Lovell of the Street Department for the City of Carmel. END Docket No. 08050020 SP: Camden Walk, Section 2 The applicant seeks secondary plat approval for 36 lots on 22.829 acres. The site is located northwest of 96th St. and Towne Rd. It is zoned S -1 /Residence ROSO I. Filed by Brett Huff of Stoeppelwerth Associates for James Caito of Camden Walk, LLC. Brett Huff presented. He was accompanied by James Caito. Brett stated that this is the final section of Camden Walk. The utilities and sewerage will be extended from Section I. It is located between 106 street and 96 street and Towne Rd. and is completely surrounded by existing subdivisions. Joanie Clark, Vectren Gas, distributed info regarding contact numbers. Highway Dept., sent a comment letter on June 12 he has no further comment at this time. Jerry Liston Hamilton County Surveyor's Office, Greg Hoyes sent a comment letter around June 12 Jerry stated that this will be a regulated drain as is Section 1. Brett asked about the item relating to no discharge into rear yard swales. He stated that IDEM is requiring them to treat the water before it enters the lake. Jerry indicated that Brett should work with Greg on this issue. There are other methods of treating that water and Greg will work with you on this issue. Chris Ellison, Carmel Fire Department, no comment. Ryan Hartman CTRWD, sent a comment letter in May and has no further comments at this time. Scott Brewer DOCS, there was a landscape plan approved with the primary plat, but he has not received an updated section of the plan for the second section and he needs that for the secondary plat and it needs to be on a construction document, so it will fit in with a regular plan set. It needs to be on an engineered plat so he can check against utility lines for the complex. Brett stated that most of the landscaping has already been done with the original section, he asked for clarification. Scott stated that a lot of the landscaping is not in, and that some of the trees, i.e. ash, are not permitted. Scott will be making species suggestions. This project will need to come up to code. END Docket No. 08050034 Z: Meadows Three PUD The applicant seeks approval to rezone 7 acres to PUD /Planned Unit Development for a dog park, chapel, and single family homes. The site is located at 212 W 136th St. and is zoned R -1 /Residence, partially within the US 31 Overlay. Filed by Ron Bussell of Bussell and Bussell for Meadows Three, LLC. Ron Bussell presented. He gave an overview of the project. This will be combination of areas. There will be a residential area south of Little Cool Creek, and on the north of Little Cool Creek will be a dog park and very north point will be memory gardens for pet cremains to be put into a columbarium. There will be an office building and a chapel. The PUD is in process. Joanie Clark, Vectren Gas distributed the name of the contact person along with paperwork. Nick Redden, Engineering, no comment regarding the rezone, however, we will need a complete set of construction plans when they become available. Alexia Donahue Wold, DOCS, no comment at this time. Chris Ellison, Carmel Fire Department, sent an email yesterday. He also sent out some information on piece of equipment today. Ron asked for clarification on whether this was a 40 ft. turning radius and the length is 48 ft. long, Ron would like to discuss this requirement further with Chris. END Docket No. 08050027 SP: Weston Park, Block A, Lots 1A -3A The applicant seeks replat approval for 3 lots on 10.14 acres. The site is located at the southwest corner of 106th St. and Michigan Rd. The site is zoned I- 1 /Industial and is within the US 421 Overlay. Filed by Mark Obergfell of TLF Inc. Mark Obergfell of TLF presented. He was accompanied by Scott Malafyte. This project has gone through TAC and ADLS approval last summer. This is the L.A Fitness project that is on Michigan Rd. The building will be opening in August. This is the subdivision of block A into 3 lots drawing a line between the L.A. Fitness building and the north end of the site for the future retail area. Also the creation of the 1 acre outlot on 106 street. Joanie Clark, Vectren Gas, gas has been connected to L.A. Fitness, she distributed contact info for future needs. Highway Dept., we have sent correspondence and asked if the petitioner had any further questions. Mark stated he had a check for them and signed form and will be making a couple of corrections of the plat after the meeting and will be sending this off to him. David stated that once the plat is ready and no more comments need to be addressed then at that point send out the subdivision review sheet and sign off sheets to all the county agencies and send the signed mylar to David. Once you have all the sign off sheets back send them over to the auditor and she will put it on the agenda. David Littlejohn -DOCS, he commented on the 10 ft. asphalt path and realizes it is included on the LA Fitness plan but he would like to see it on the new plat also. END Docket No. 08050024 PP Amend: Stafford Lane The applicant seeks primary plat amendment approval for 53 lots on 30 acres. The site is located along 146th St., west of Gray Rd. and is zoned R1 /Residence ROSO. Filed by Eric Batt of Schneider Engineering for The Drees Company. Eric Batt presented. This is an existing project that has already gone through the process for approval. The reason it is back in for further approval is that a 1 acre parcel in the approximate middle of the property has been acquired by the developer, Drees, so we are asking for the addition of 3 more lots and some minor reconfiguration of the layout. David Lucus Hamilton Co. Highway Dept., sent a letter out yesterday and also sent a follow up email regarding the approval process for the Board of Commissioners. We are waiting for clarification from them; they passed a verbal resolution on access on 146 Street, not allowing new accesses. However we have asked for clarification if they are going to allow accesses, i.e. no net gain access, taking one away and putting a new one in. There may be some additional requirements as far as a TIA required by the Commissioners. That may not or may not be a possibility since it was already in the process long before the verbal resolution. They will probably have clarification before the end of the month. David does not foresee any additional from what has already been done. Jerry Liston, Hamilton County Surveyors Office, Greg sent a letter earlier in June. The project falls within the Mitchner regulated water shed. He had no new comments on the plat, and is waiting for construction plans Ryan Hartman CTRWD outside of jurisdiction. Scott Brewer DOCS, indicated he had spoken to John Lapp regarding information on this subdivision on the tree preservation that was done by Vine and Branch, which Drees had committed to. However, on the newly submitted plans, the tree preservation is not committed to. Scott indicated that this is a problem, because it was committed to be done previously. The Department does to want to give this up. On the current plan, it shows construction plans in the tree preservation area, we previously were told these areas would be preserved. However, the planting plan shows plantings right over those existing trees. He asked why the addition of an area in the middle of the subdivision would change any of that. Eric will speak with John. He indicated that no tree preservation plans should have been changed. David Littlejohn -DOCS, sent a letter and has no additional comments at this time. Angie Conn, DOCS, I have sent a review letter, and has one additional comment: since you will be doing a new secondary plat, we ask that you either send a letter or email requesting to withdraw the 2006 primary plat. END Carmel Hope Fellowship: The applicant seeks the following development standards variance and special use amendment approvals: Docket No. 08050030 Section 26.02.08 Reduced setback, front yard Docket No. 08050031 Section 7.04.03 Reduced setback, side /front yard Docket No. 08050032 Appendix A, Use Table; special use amendment The site is located at 14535 Carey Road and is zoned R1 /Residential. Filed by Don Hawley of Carmel Hope Fellowship of Seventh -Day Adventists. Don Hawley presented. He indicated that the petitioner is requesting a Special Use Amendment that would allow a small 360 sq. ft. addition on to the existing building and then the petitioner is asking for two variances for setback reductions. Jerry Liston, Hamilton County Surveyors Office, this project falls within the Taylor Trace Regulated Drain water shed, but we have no objection to the variance request. Chris Ellison, Carmel Fire Department, asked about the time line for phase 3. Don responded they do not have a date certain; they are currently in the fund raising part of the project. Chris informed Don that a new Fire and Building Code were adopted this week, so there are new requirements. He suggested that these be reviewed prior to submitting the next phase. Ryan Hartman CTRWD out of his jurisdiction. Scott Brewer DOCS, he has not received an updated landscaping plan for the new addition. It looks like 3 trees will be affected, he asked for confirmation. Don gave Scott an updated plant. He asked where the affected trees are. Scott stressed that if the building is changing than the landscaping will be changing and it is critical that the department be informed of any changes to the original plan. David Littlejohn -DOCS, received the email that Don had sent, indicating that he intended to put in the path. David would like to see it included on the current drawing plan so we consistently have a path. Don stated that it is shown on the plans as a 6 ft. path as was approved. David stated that the Alternate Transportation Plan required 10 ft. paths along 146 and Carey Rd. and since the plan has been changed you will be required to put in a 10 ft. path. Don will speak with David at a later time. He stated that the 6 ft. path was approved in 2004 with the knowledge that it would be put in after the construction. David stated that our new plan states that the 10 ft. path must be put and that the previous approval would not cover this. Angie Conn, DOCS, no comment at this time. Filed by Rex Neal of Printing Plus, owner. Rex Neal presented. He gave an overview of the project. He has a small printing business. There are no chemicals, no printing press. No trucks, no walk in customers. His business works with national groups and share information via email and complete the order and ship out. There will be no signage or outdoor lighting.
