The applicant also seeks the following commitment amendment and zoning waiver approvals: Docket No. 08020022 CA amendment of parcel's previous commitments Docket No. 08020023 ZW Chapter 23E.09.E.1 building must face Pennsylvania St. The site is located at the 10800 block of Pennsylvania St. and is zoned 13-6 /13usiness within the West Home Place Commercial Corridor High Intensity area. Filed by Jim Shinaver of Nelson Frankenberger for Hotel Development Services, LLC. Jim Shinaver presented for the petitioner. He was accompanied by Chris Laystrom for Wolpert Eng., Mark Carlsen, Architect and David Wiespiser for HDS. He gave a brief outline of the project and asked for input from the Committee. Nick Redden- Engineering has sent a comment letter and is awaiting a response. Greg Hoyes Hamilton County Surveyor's Office, outlet permits are needed. Landscaping needs to be outside of easement. Chuck Shupperd Vectren Energy, discussed the need to possibly extend the encroachment. David Littlejohn -DOGS, has sent a comment letter and has no further comments at this time. David Lucas Had no comments. Chris Ellison, CFD discussed the possible need for additional hydrants. Chris also asked about the sprinkler system. Scott Brewer, Forester discussed drainage issues, buffer yard and his recommendations for species change. He suggested that the petitioner and he meet to discuss these issues. Shirley Hunter Duke Energy asked when construction is slated to begin. The petitioner indicated they hope to start in the fall. Shirley requested an Auto CAD file and indicated that the petitioner will need to contact Shawn South. Ryan Hartman CTRWD, sent a comment letter yesterday, if the petitioner has any questions, please feel free to contact him. Discussed whether there would be a need for a grease trap or not. Alexia Donahue Wold, DOGS, no comment at this time. Petitioner discussed whether there would be a need to meet with Angie to go over architecture. Petitioner would be in contact with Angie in regards to that. 9:15 a.m. Docket No. 08020028 DP /ADLS: The Legacy Towns Flats The applicant seeks site plan and design approval for a retail/residential development of 23 buildings with 288 residential units. The site is located southeast of the 7000 block of E. 146th St. and is zoned PUD /Planned Unit Development. Filed by Charlie Frankenberger of Nelson Frankenberger for J.C. Hart Company, Inc. Charlie Frankenberger presented for the petitioner. He was accompanied by John Hart of J. C. Hart Company and other members of the J.C. Hart team. (Sign in sheet was not completed) Charlie discussed the project. This will be a large upscale project in the new Legacy project on 146 Street and River Road, and will include both residential and retail. Nick Redden- Engineering sent a comment letter and has no further comments at this time. Petitioner asked about Gary's comments and Nick was not sure the status of those comments. Petitioner should contact Gary directly to inquire his comments. Greg Hoyes Hamilton County Surveyor's Office, has sent a letter indicating the need for more outlet permits. Chuck Shupperd Vectren Energy, asked the petitioner if gas will be used for heating, etc. Charlie indicated that only the pool and pool cabana will be using gas. David Littlejohn -DOGS, sent a letter indicating the need for bike paths per the ordinance. Discussion was held regarding how the Hart project paths would connect with the Platinum Properties proposed paths. The petitioner will review the ordinance and contact David to set a meeting to work out any outstanding issues. David Lucus Hamilton Co. Highway Dept., No comment on this site, however he will continue to work with Platinum Properties on issues relative to 146"' Street. Chris Ellison, CFD stated that a meeting has been scheduled with the petitioners for next Tuesday to discuss the project. Scott Brewer DOCS, sent a comment letter last evening. He had some concerns regarding tree species, structural soils, etc. He will await a response from the petitioner. Shirley Hunter Duke Energy, She and Shawn South are working on the overall design for this project. She asked the petitioner for details and information regarding the types of apartments/buildings, ie: square footage, to help determine cooling and heating design needs. Ryan Hartman CTRWD, this project falls outside their jurisdiction. Alexia Donahue Wold, DOCS, indicated that Angie Conn had sent a comment letter indicating 4 or 5 issues that need to be addressed. The petitioner and the Department will meet either the 3ra or 4 of April. Christine Barton Holmes -DOGS, has no comment at this time. M L L11 9:30 a.m. Northview Christian Life Church Expansion Special Use Amendment. The applicant seeks the following special use amendment approval: Docket No. 08020026 SUA Section 21.03; church expansion The site is located at 5535 East 131st Street and is zoned S1 /Residence. Filed by Charlie Frankenberger of Nelson Frankenberger for Northview Christian Life Church, Inc. Jim Shinaver of Nelson and Frankenberger presented. He was accompanied by Greg Ilko of Crossroads Engineering, Rick Thompson for Northview Christian Life and Steve Siroky of S B Construction. Nick Redden- Engineering has sent a comment letter and has no further comments at this time. Greg Hoyes Hamilton County Surveyor's Office, no problems with the project. Chuck Shupperd Vectren Energy, asked if there will new gas service needed. The petitioner indicated that some new service changes may be needed. David Littlejohn -DOCS, sent a letter indicating changes needed in the path alignment. The path should extend the full length of the property. The petitioner will review the plans and make changes as needed. David Lucus Hamilton Co. Highway Dept., outside of his jurisdiction. Chris Ellison, Carmel Fire Department asked if there will be any relocation of meter Scott Brewer DOCS, has not had an opportunity to send a comment letter. However, he expressed serious concerns about the removal of some well established trees. Scott and the petitioner discussed some possible resolutions. The petitioner stated that they had spent considerable time and effort to save trees, particularly during the last building project. Scott asked if it would be possible to realign the new building in order to spare some of the trees. The petitioner will look into this. Shirley Hunter Duke Energy, requested that a load sheet be completed and an auto CAD drawing of the new addition be submitted. Ryan Hartman CTRWD out of his jurisdiction. END 9:40 a.m. Docket No. 08020024 TAC: Fire Station No. 45 (Home Place Addition, lots 165- 166) The applicant seeks site plan and design approval for a building addition. The site is located at 10701 N College Ave and is zoned R -3 /Residence within the Home Place Business District. Filed by Doug Callahan, Trustee of Clay Township. Dennis Lockwood of Lockwood Design Assoc. presented. He was accompanied by Doug Callahan. Dennis indicated that this is an addition to the station of 6800 sq. ft. new construction and 3000 sq. ft. renovated space. Nick Redden- Engineering stated that this is outside engineering jurisdiction. Greg Hoyes Hamilton County Surveyor's Office, no further comments at this time. Chuck Shupperd Vectren Energy, asked if gas will be turned off or new services requested. Dennis responded that facility will remain operational during construction and no service upgrade will be necessary. David Littlejohn -DOCS, no comment on this project. David Lucus Hamilton Co. Highway Dept., has sent a comment letter and has no further comments at this time. Chris Ellison, Carmel Fire Department, asked if there would be a new alarm system. Petitioner said they will try to use the existing system. Scott Brewer DOCS, Noted that landscaping is generally not allowed in the right -of -way. Suggested planning new trees to replace any old ones that will be removed. Shirley Hunter Duke Energy, no comments at this time. Ryan Hartman CTRWD, all issues have been resolved. Main Street The applicant seeks construction plan approval for an interior private drive off of 131st Street. The site is located at 1328 -1440 W. Main Street and is zoned B -6 /Business within the US 31 Overlay. Filed by Chris Wiseman of Cripe Architects Engineers for Browning Real Estate Partners. Chris Wiseman of Cripe Engineering presented. He was accompanied by Jaime Browning of Browning Investments, Terry Hebert of Browning Investments and Sara Farny of Cripe. Nick Redden- Engineering, has sent a comment letter with comments. Greg Hoyes Hamilton County Surveyor's Office, does not see any major issues at this time. Chuck Shupperd Vectren Energy, discussed the need for a larger utility easement, it needs to be at a minimum 15 ft. to accommodate utilities. There needs to be 5 ft. of separation between utilities. David Littlejohn -DOCS, has sent a comment letter. Had a question about installing sidewalks on both sides of the street. Petitioner only wants them on one side and said the had gotten a variance to allow this. David will look into that. David Lucus Hamilton Co. Highway Dept., no comment Chris Ellison, Carmel Fire Department, no comment. Scott Brewer DOCS, indicated that he had not received any landscape plan or tree preservation plans. Jaime Browning indicated that Scott had received these plans late last year. He stated that they had done a total tree survey and had saved trees that were indicated. Jaime stated he will send another copy to Scott. Shirley Hunter Duke Energy, reiterated the points made by Chuck regarding the easements. She also informed the petitioner that costs of relocating the poles would be paid by the petitioner. Jaime had questions regarding when the City of Carmel would be doing roadway improvements in that area. Shirley stated that they had no knowledge that roadway changes would occur and that if changes did occur, it would be up to the petitioner to recoup the costs for the City.
