West Lake City Bank (Outlot 2) Notice is hereby given that the
CARMEL Plan Commission on the 21st day of September, 2010 at 6:00
p.m. in the City Hall Council Chambers, One Civic Square, CARMEL,
Indiana 46032 will hold a Public Hearing upon applications by Lake City
Bank (the "Applicant to amend the text of the Parkwood Crossing West
Planned Unit Development Ordinance (Z- 359 -01) to allow for the
development of that portion of real estate subject to the PUD known as
Outlot 2, located at the northwest corner of Meridian Street and 96th
Street, as a branch bank and regional bank headquarters and for site plan,
architectural design, landscaping, lighting and signage approval for a bank
building. These applications, identified by the docket numbers above,
may be examined in the Office of the Department of Community
Services, One Civic Square, Third Floor, CARMEL, IN 46032. The real
estate affected by said application is legally described in Exhibit "A"
attached hereto. All interested persons desiring to present their views on
the above application, either in writing or verbally, will be given an
opportunity to be heard at the above mentioned time and place. Interested
persons may also file written comments prior to the meeting. The hearing

Meridian Street A part of the Southwest Quarter of Section 11, Township
17 North, Range 3 East, Hamilton County, Indiana, more particularly
described as follows: Commencing at a Harrison Monument marking the
southwest corner of said quarter section, said corner being South 89
degrees 24 minutes 09 seconds West 2,693.06 feet from the southeast
corner of said quarter section; thence North 89 degrees 24 minutes 09
seconds East, 1261.67 feet along the south line of said quarter section;
thence North 00 degrees 35 minutes 56 seconds West, 71.58 feet to the
north right -of -way line of 96th Street as described in the dedication and
deed to the City of CARMEL, recorded as Instrument number
200600018041 in the Office of the Recorder of Hamilton County,
Indiana; thence continuing North 00 degrees 35 minutes 56 seconds West,
323.35 feet; thence North 89 degrees 24 minutes 04 seconds East, 213.27
feet; thence North 00 degrees 35 minutes 56 seconds West, 39.22 feet to
the Limited Access right of way line described in the deed to the State of
Indiana, recorded as Instrument Number 2001 28753, the following 4
calls being along said State of Indiana limited access right of way; (1)
thence South 57 degrees 54 minutes 09 seconds East, 61.54 feet; (2)

I am enclosing with this correspondence our Affidavit of Public Notice of Public Meeting

discussed, notice was not given within 25 days of the September 21 Plan Commission meeting;
however, notice was given within 10 days of the meeting as required under state statute.
Accordingly, we will request, with your support, that the Plan Commission suspend its rules and
hear this matter on September 21.
