Dear Mr. Walters:
The City has received your construction plans dated March 30, 2007. Thank you for taking the time to
meet with the Department on May 25, 2007. We offer the following comments:

1. These comments represent the Department of Engineering's first review of the Phase 1
Master Infrastructure construction plans for this project.
2. We request that all responses to our comments be provided in writing and be accompanied by
a drawing reflecting the requested revisions. Failure to provide written responses may result
in the delay of the review process.
3. It is critical that this office be made aware of all modifications made on the plans being re-
submitted, particularly if any such changes are considered "new" or fall outside of our
previous reviews. Please provide revised plans including all revisions. Please notify us of
any changes and specifically state any changes, including changes resulting from Plan
Commission, BZA or other committee meetings.
4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage
calculations submitted to this office for review. If you have not already done so, please
provide a set of drainage plans and calculations to their office for review. We will share
Crossroad's comments as they are received.
5. Final drawings will not be approved for won until:
a. All Engineering Department and Utility Department and Hamilton County Surveyor
issues have been resolved.
b. All bonds and performance guarantees are posted.
c. All Board of Public Works and Safety approvals and any other governing agency
approvals (if required) are obtained.
d. All off -site easements necessary to install utilities to serve the development are secured.
e. SWPP is approved.
All fees are paid.
6. The Department reserves the right to provide additional comments based upon subsequent
reviews.
7. An approved Storm Water Management Permit is required prior to commencing any earth
disturbing activity.
8. An approved right -of -way permit is required prior to commencing any work in the public
right -of -way.
9. If it will be necessary to relocate existing utility poles, they must be relocated to within one
foot of the proposed right -of- way. Costs for such relocations are to be borne by the
developer.
10. Compliance with the Thoroughfare Plan includes construction of the improvements
prescribed by the Thoroughfare Plan across the frontage controlled by the development
(including sections with no access). Typically, developers provide a commitment equal to

the value to construct these improvements for deposit into the City's non reverting
thoroughfare fund. Credit is typically given towards this commitment for any widening,
milling and resurfacing of the perimeter streets. Please refer to comments issued based on
the Planned Unit Development review. I know that this issue was discussed and it was
agreed to work together to establish minimum improvements to accommodate the traffic
generated from the development and extend the life of the pavement for the increase in
traffic. Please refer to Sections 5.03.05 and 5.05.02 -34 of the Subdivision Control Ordinance
as it relates to the improvements previously requested by the Department of Engineering. As
no improvements are indicated adjacent to River Road ant this time, the Department requests
that Platinum continue to work with the Department to resolve this issue so that the
expectations are clear when the frontage of River Road is developed.
11. The Department requires that the construction drawings be developed in accordance with the
City of Carmel digital submission standards and that all required submittals for primary plat,
secondary plat, and construction drawings be made. The digital files must be submitted to
the Department of Engineering prior to the approval of the construction plans. Please contact
the City GIS Department for the requirements.
12. Jurisdictions:
a. The project site is located within current City of Carmel Corporate Limits.
b. Streets and Right of Way City of Carmel (Interior Streets, Cherry Creek Boulevard,
River Road) Hamilton County Highway Department (146 Street)
c. Water City of Carmel Utilities
d. Sanitary Sewers City of Cannel Utilities
e. Storm Sewers/Drainage City of Carmel.
f. Legal Drains Hamilton County Surveyor's Office.
13. Drawings submitted for approval:
a. The design engineer must certify all drawings submitted for final approval.
b. This office will require a minimum of 5 -sets of drawings for approval after all issues
have been resolved. The drawings will be stamped as approved and signed by the City
Engineer and by Carmel Utilities. The Owner will receive 1 -set which must be
maintained on the construction site at all times. If additional approved sets are desired,
we will approve a maximum of 2- additional sets. However, the additional sets must be
submitted with the required minimum 5 -sets.
14. Carmel Utilities will provide separate reviews of this project for water and sanitary sewer
issues. Please assure that copies of all drawings are sent to:

BOARD OF PUBLIC WORKS AND SAFETY
17. A schedule for Board of Public Works and Safety meeting dates and agenda deadlines will be
sent electronically for your use. Please use the Engineering Department deadlines for
submissions to the Board.
18. Any submission to the Board requires prior approval by the Carmel Clay Plan
Commission and/or the Board of Zoning Appeals (if applicable) and completion of

review by the Technical Advisory Committee. All written requests to be placed on the
Board's agenda must include the appropriate Docket Number and the date (or dates) of
approval by the Plan Commission and /or the Board of Zoning Appeals (if applicable).
19. Water and Sewer Availability approval from the Board will not be applicable to Phase 1
Infrastructure construction. This is an EDU approval and the EDUs have not been
determined. There will be no building permits issued with this construction.
20. Commercial Curb Cut Approval It appears that this will be a typical residential subdivision,
which normally would not require BPWS curb cut approval. The cut for the future public
street will not require Board of Public Works and Safety approval. The cut for the access
drive to the lift station will require approval from the Board.
21. Temporary Construction Entrance approval if the location is at a site other than the location
of the proposed permanent entrance to the development.
22. The installation of any permanent, privately owned and/or maintained improvement (signs,
decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated
easements requires the execution of a Consent to Encroach Agreement between the Owner
and the City of Carmel. Such agreements are executed by the Board of Public Works and
Safety. The City Engineer may approve irrigation system agreements.
23. Secondary Plat approval if applicable. All performance guarantees must be posted prior to
submission of secondary plats for Board of Public Works and Safety approval.
24. Dedication of Right of Way if not platted. Do you intend to dedicate the right of way for
Street A and the roundabout prior to construction?
25. Any open pavement cuts of the existing Cherry Creek Boulevard or the subdivision streets in
Cherry Creek Estates.
BONDING REOUIREMENTS
26. Upon initial review, it appears performance guarantees for Master Infrastructure Phase 1 shall
be provided for the following:
a. Streets (Street A and Roundabout base, binder and surface must be bonded together)
b. Curb Gutters (Street A and Roundabout)
c. Sanitary Sewers including the lift station and force main.
d. Street Signs. Please designate if Standard City of Carmel Street Signs or decorative type
street signs will be installed. A Performance Guarantee is required in either case.
However, if decorative signs are installed, they must meet our minimum standards.
Additionally, after the Performance Guarantee for decorative signs has been released, 3-
Year Maintenance Guarantee will not be required as future maintenance will be the
responsibility of the Developer /Owner/HOA.
e. Monuments Markers. It appears that street centerline markers for Street A and the
roundabout will be the only Monument Marker bonding requirement for Phase 1.
f. Right of Way Improvements may be bonded separately. This could include
acceleration/deceleration lanes, passing blister, pavement widening, thermoplastic
striping, stone shoulders, curbs, etc. Since this construction will occur within the 146
Street Right of Way, which is under the jurisdiction of the Hamilton County Highway
Department, please determine which entity will post Performance Guarantees for this
construction and advise this office when the determination is made.
g. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley,
Engineering Department Stormwater Administrator, for details regarding engineer's
estimates /performance guarantee requirements for these items.
27. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for
100% of the cost of labor and materials to construct the individual improvements, to be
provided by the design engineer. Please provide detailed Engineer's Estimates for each
improvement including quantities, unit costs, pipe sizes and materials, etc.
28. Upon completion and release of individual Performance Guarantees, a three -year
Maintenance Guarantee will be required (see Street Sign comments above). The

Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets
and Curbs and 10% of the Performance amount for all other improvements.
29. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of
Credit.
30. Please reference the enclosures for more detailed explanation of our procedures.
RIGHT OF WAY PERMIT AND BONDING
31. Any work in the dedicated right of way of Cherry Creek Boulevard or the subdivision streets
in Cherry Creek Estates will require an approved Right of Way Permit and a License
Permit Bond. Conversely, any work in the right of way of 146 Street will require approval
from the Hamilton County Highway Department.
32. The bond amount is determined by the number of instances of work in the right of way at
$2,000.00 per instance. However, if the work is included in the scope of work of a required
and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the
bond requirements of the Right of Way Permit.
33. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting
and bonding.
AVAILABILITY AND CONNECTION FEES
34. The Availability and Connections Fees are current as of this date but are subject to future
revisions.
35. Availability (acreage) Fees must be paid after all other Engineering Department requirements
have been satisfied and prior to approval and start of construction activities. Availability Fees
are based upon total platted acreage or legal description acreage for the development at the
current rate of $1,010.00 per acre for Water Availability and $1,365.00 per acre for Sanitary
Sewer Availability.
36. It appears there will be no water main installation with Phase 1 construction. If that is the
case, Water Availability (acreage) Fees will not be applicable. However, there is
considerable sanitary sewer construction, which would normally require payment of Sanitary
Sewer Availability (acreage) Fees. Carmel Utilities will make this determination. Please
advise this office of the decision by Carmel Utilities.
37. Connection Fees are not applicable to Phase 1 construction since there will be no building
permits issued. Connection (EDU) Fees have not been determined.
38. If an entryway irrigation system, other community irrigation system, community swimming
pool, community clubhouse or community bath house is planned for this development,
additional Water Availability Fees and Water Connection Fees (and Sanitary Sewer
Availability and Connection Fees if applicable) will be assessed based upon the size and
usage of the system and upon the recommendations of the Director of Carmel Utilities. It is
assumed that this would not be applicable to Phase 1 construction.
CONSTRUCTION DRAWING REVIEW COMMENTS
In addition to the comments provided verbally and as written on the sheets during the review meeting on
May 25, 2007, the Department provides the following comments:
39. General Comments
a. This project is subject to the City's Storm Water Manangement and Storm Water Quality
Ordinances.
b. Please contact Amanda Foley to review storm water quality/treatment requirements.
c. Please add the following note to the drawings: "IF IT WILL BE NECESSARY TO
RELOCATE UTILITY POLES, THE EXPENSE OF SUCH RELOCATION SHALL BE
THE RESPONSIBILITY OF THE DEVELOPER. ALL UTILITY POLES SHALL BE
LOCATED WITHIN ONE -FOOT OF THE PROPSOED RIGHT -OF- WAY."
d. The City will defer to the Hamilton County Highway Department as to the details of the
146 Street entrance.

We have reviewed the construction plans submitted to the Hamilton County Surveyor's Of
on April 5, 2007, for this project and have the following comments:
1. The proposed project falls in the incorporated area and MS4 jurisdiction of the City of
Carmel
2. The proposed project DOES fall in a Carmel Wellhead Protection Zone.
3. The proposed project falls in the Tunis Gerard, Paulsel Vance Paulsel, Elizabeth
Warner, and Emily Vestal Regulated Drain Watersheds.
4. Please note this site will be required to comply with the new Hamilton County
Stormwater Management Technical Standards Manual, along with any additional
requirements from the City of Carmel Manual.
5. Please submit an outlet permit for the direct discharge to the Tunis Gerard Regulated

6. The forcemain for this project will require 2 crossing permits (Elizabeth Warner and
Emily Vestal Drain) and a Utility Non enforcement Agreement for the parallel run

7. Please show all Regulated Drains that fall in the boundary of this site. This includes
the 2+ miles of the Tunis Gerard Drain and the 146 Street Relocation of the Paulsel
Vance Paulsel Drain.
8. The drainage calculations do not provide post developed release rates in the summary
to verify compliance with Hamilton County Ordinance 4- 26 -99 -C or Hamilton
County Stormwater Technical Standards Manual, Section 302.02. Future
development of this project will require a full master drainage plan and calculations
for the entire project.
9. The drainage calculations do not account for drainage area north of 146 Street, via
surface water pipes under 146 Street. This drainage does utilize the Elizabeth
Warner Drain and will need to be maintained with the development of this project.
10. Any private tiles located on this site will need to be located; breathers set at the
downstream property line, and crushed or removed across this site. If any of these
tiles extend beyond the limits of project, they will need to be provided a positive
outlet and allowed to continue to function, as it is illegal to block off a private
"mutual" tile.
11. The overall site development plan show fill for building pads in mapped floodplain
per FIRM Panel 235, which is in direct conflict with Hamilton County Ordinance 4-
26-99-C(6). A variance from the Hamilton County Drainage Board will need to be
sought and approved prior to the filling of this floodplain area of a regulated drain.
Also, LOMB -F will need to be filled with FEMA for the official remove of this area
from the FIRM panel floodplain.
12. Will the Stormwater Park" be protected in a permanent easement? Who will be
responsible for the maintenance of this area and any items that are to be considered
part of the overall site BMP? The proposed created wetland that is part of the
Stormwater Park falls in a Hamilton County Regulated Drain Easement and will need
to be approved by HCSO and Hamilton County Drainage Board.
13. Please note that further comments WILL be necessary at a later date.

transportation. I have reviewed the drawings submitted for the April 18, 2007 Technical Advisory Committee
meeting and offer the following comments:
