Those comments were addressed as follows: 1. The 8' multiuse path has been discussed with the developer and we have decided to proceed with a 6' path in this area. A plan for bike traffic is included in our PUD for the entire development. 2. We have revised our note on Sheet C201 to include the extension of the sidewalks to the adjacent subdivision at the time of completion of the second subdivision constructed on Brauer Lane. We have included a revision sheet with the Construction Plans, Sheet C002, and have listed all changes to the plans per the comments from other agencies. This letter is being issued as a supplement to any previously issued letters. Some comments may be repeated. We offer the following comments: GENERAL INFORMATION 1. These comments represent the Department of Engineering's first review of the construction plans for this project. 2. We request that all responses to our comments be provided in writing and be accompanied by a drawing reflecting the requested revisions. Failure to provide written responses may result in the delay of the review process. 3. It is critical that this office be made aware of all modifications made on the plans being re- submitted, particularly if any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans including all revisions. Please notify us of any changes and specifically state any changes, including changes resulting from Plan Commission, BZA or other committee meetings. 4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations submitted to this office for review. If you have not already done so, please provide a set of drainage plans and calculations to their office for review. We will share Crossroad's comments as they are received. 5. Final drawings will not be approved for construction until: a. All Engineering Department and Utility Department and Hamilton County Surveyor issues have been resolved. b. All bonds and performance guarantees are posted. c. All Board of Public Works and Safety approvals and any other governing agency approvals (if required) are obtained. d. All off -site easements necessary to install utilities to serve the development are secured. e. SWPP is approved. f. All fees are paid. 6. The Department reserves the right to provide additional comments based upon subsequent reviews. 7. An approved Storm Water Management Permit is required prior to commencing any earth disturbing activity. 8. An approved right -of -way permit is required prior to commencing any work in the public right -of -way. 9. If it will be necessary to relocate existing utility poles, they must be relocated to within one foot of the proposed right -of -way, Costs for such relocations are to be borne by the developer. As this section does not front any City of Carmel streets bearing a designation on the City's 20 -year Thoroughfare Plan, the Department rescinds the comment presented in the previously issued comment letter for this section of the development. 11. The Department requires that the construction drawings be developed in accordance with the City of Carmel digital submission standards and that all required submittals for primary plat, secondary plat, and construction drawings be made. The digital files must be submitted to the Department of Engineering prior to the approval of the construction plans. Please contact the City GIS Department for the requirements. 12. Jurisdictions: a. The project site is located within current City of Carmel Corporate Limits. b. Streets and Right of Way City of Carmel (Interior Streets) Hamilton County Highway Department (146 Street) c. Water City of Carmel Utilities d. Sanitary Sewers City of Carmel Utilities e. Storm Sewers/Drainage City of Carmel. f. Legal Drains Hamilton County Surveyor's Office. 13. Drawings submitted for approval: a. The design engineer must certify all drawings submitted for final approval. b. This office will require a minimum of 5 -sets of drawings for approval after all issues have been resolved. The drawings will be stamped as approved and signed by the City Engineer and by Carmel Utilities. The Owner will receive 1 -set which must be maintained on the construction site at all times. If additional approved sets are desired, we will approve a maximum of 2- additional sets. However, the additional sets must be submitted with the required minimum 5 -sets. 14. Carmel Utilities will provide separate reviews of this project for water and sanitary sewer issues. Utility Jurisdictions/Right of Way Permits e. Availability (acreage) Fees BOARD OF PUBLIC WORKS AND SAFETY 17. A schedule for Board of Public Works and Safety meeting dates and agenda deadlines will be sent electronically for your use. Please use the Engineering Department deadlines for submissions to the Board. 18. Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and /or the Board of Zoning Appeals (if applicable) and completion of review by the Technical Advisory Committee. All written requests to be placed on the Board's agenda must include the appropriate Docket Number and the date (or dates) of approval by the Plan Commission and /or the Board of Zoning Appeals (if applicable). 19. Water and Sanitary Sewer Availability approval from the Board will be required. This is an EDU approval based upon the total number of residential lots 1.0 EDU per lot. The letter of request should include the total number of residential lots and the total platted acreage of the development. Commercial Curb Cut Approval It appears that this will be a typical platted residential subdivision, which normally would not require BPWS curb cut approval. However, since 146 Street is under the jurisdiction of the Hamilton County Highway Department, approval of the 146 Street entrance should be obtained from them. 21. Temporary Construction Entrance approval if the location is at a site other than the location of the proposed permanent entrance to the development. Again, if this is to be located on 146 Street, Hamilton County Highway Department approval will be required. 22. The installation of any permanent, privately owned and/or maintained improvement (signs, decorative street signs, walls, streetlights, etc.) within dedicated right of way (other than 146 Street) or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of Carmel. Such agreements are executed by the Board of Public Works and Safety. The City Engineer may approve irrigation system agreements. 23. Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. 24. Dedication of Right of Way if not platted. 25. Any open pavement cuts of the existing subdivision streets in Cherry Tree Grove if Cherry Tree Grove is developed prior to this construction. BONDING REOUIREMENTS 26. Upon initial review, it appears performance guarantees for the Legacy Residential Section 1, Phase 1 development shall be provided for the following: a. Interior Streets (stone base, asphalt binder and asphalt surface). b. Interior Curb Gutters c. Water Mains. Onsite and offsite may be bonded separately or together. However, if bonded together, all onsite and offsite construction must be complete prior to release of the performance. d. Sanitary Sewers. Onsite and offsite may be bonded separately or together. However, if bonded together, all of the construction must be complete prior to release of the performance. e. Storm Sewers /Storm Drainage. Onsite and offsite may be bonded separately or together. However, if bonded together, all of the construction must be complete prior to release of the performance. f. Street Signs. Please designate if Standard City of Carmel Street Signs or decorative type street signs will be installed. A Performance Guarantee is required in either case. However, if decorative signs are installed, they must meet our minimum standards. Additionally, after the Performance Guarantee for decorative signs has been released, 3- Year Maintenance Guarantee will not be required as future maintenance will be the responsibility of the Developer /Owner/HOA. g. Monuments Markers. Street centerline markers and perimeter concrete monuments. h. Interior Sidewalks. These are the builder's lot right of way sidewalks. i. Exterior Sidewalks. These are sidewalks that are constructed in the right of way adjacent to common areas or perimeter streets. Any sidewalk or asphalt path construction in the right of way of 146 Street should not be bonded with the City of Carmel j. 146th Street right of way improvements will be under the jurisdiction of the Hamilton County Highway Department who may require bonds to be posted. This could include acceleration/deceleration lanes, passing blister, pavement widening, thermoplastic striping, stone shoulders, curbs, etc. k. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley, Engineering Department Stormwater Administrator, for details regarding engineer's estimates /performance guarantee requirements for these items. 27. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost of labor and materials to construct the individual improvements, to be Mr. Brett Huff February 20, 2008 RE: Legacy Residential, Section 1/Phase 1- Project Review #1 Page 4 of 8 provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit costs, pipe sizes and materials, etc. Please provide the estimates to this office as soon as possible and certainly prior to submission of Performance Guarantees by the Developer in order to give us sufficient time to review the estimates. 28. Upon completion and release of individual Performance Guarantees, a three -year Maintenance Guarantee will be required (see Street Sign comments above). The Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets and Curbs and 10% of the Performance amount for all other improvements. 29. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit. 30. Please reference the available enclosures for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING 31. Any work in the dedicated right of way of 146 Street is under the jurisdiction of the Hamilton County Highway Department who should be contacted regarding Right of Way Permits. It does not appear that a Right of Way Permit with the City of Carmel will be required. 32. If a Permit with the City of Carmel is required, the bond amount is determined by the number of instances of work in the right of way at $2,000.00 per instance. However, if the work is included in the scope of work of a required and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the bond requirements of the Right of Way Permit. 33. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting and bonding. AVAILABILITY AND CONNECTION FEES 34. The Availability Fees are current as of this date but are subject to future revisions. Availability (acreage) Fees must be paid after all other Engineering Department Requirements have been satisfied and prior to approval and start of construction activities. Availability Fees are based upon total platted acreage or legal description acreage and are as follows: a. Water Availability Fee $1,010.00 per acre plus a $300.00 Development Application Review Fee (effective 7/2/07). Based on the secondary plat, Water Availability Fees would be 27.517 Acres $1,010.00 /Acre $27,792.17 $300.00 b. Sanitary Sewer Availability Fee $1,365.00 per acre. Based upon the secondary plat, Sanitary Sewer Availability Fees would be 27.517 Acres $1,365.00 /Acre $37,560.71. 35. The Connection Fees are current as of this date but are subject to future revisions. Connection Fees are paid on an individual lot basis after satisfactory completion of infrastructure construction and when an application for a building permit is submitted. a. Water Connection Fee $1,396.00 per 1.0 EDU (effective 7/2/07). b. Sanitary Sewer Connection Fee $795.00 per 1.0 EDU 36. If an entryway irrigation system, other community irrigation system, community swimming pool, community clubhouse or community bath house is planned for this development, additional Water Availability Fees and Water Connection Fees (and Sanitary Sewer Availability and Connection Fees if applicable) will be assessed based upon the size and usage of the system and upon the recommendations of the Director of Carmel Utilities. CONSTRUCTION DRAWING REVIEW COMMENTS 37. General Comments a. This project is subject to the City's Storm Water Manangement and Storm Water Quality Ordinances. Mr. Brett Huff February 20, 2008 RE: Legacy Residential, Section 1/Phase 1- Project Review #1 Page 5 of 8 b. Please contact Amanda Foley to review storm water quality/treatment requirements. One particular item to review is if the runoff from this section will be treated by a second BMP that is being installed with a subsequent section or other construction package. If the runoff is not being treated by the two permanent BMP's in the short term; what interim measures are being considered? c. The City defers to the Hamilton County Highway Department as to the details of the 146 Street entrance and all work within that right -of -way. 38. Please include a legal description of the section on the Development Plan. 39. Please indicate proper monumentation at the external corners of the section on the plat 40. Please indicate the swale sub surface drains on Sheets C200 and C201. 41. Please include a note on each plan sheet "Approval Pending -Not for Construction" until the plans are approved. 42. Some internal lot line dimensions are not complete on the Secondary Plat. 43. Please confirm that the "squares" are adequately sized for school buses, emergency response equipment, trash trucks, moving vans and moving trucks. 44. Please indicate an SSD in the swales at the rear or sides of Lots 1, 5, 6, 10, 11, 12, 13, 15, 16, in the swales between Lots 8 and 9 and between lots 18 and 19 and under the swale in Common Area #4. 45. The right -of -way is indicated at the back edge of the proposed curb along New Garden Lane and Arnett Drive. While we discussed that a 38 -foot right -of -way would be acceptable for this roadway, we did not review the relationship of the limits of the right -of -way to the centerline. Clear zone for the proposed roadway must be contained in the right -of -way as well as an area that would allow City crews to perform routine maintenance on the curbing. The right -of -way on the north side must be shifted to the north that distance to contain the clear zone within the right -of -way. 46. Any walls adjacent to the right -of -way must be located outside of the clear zone if the clear zone extends beyond the right -of -way. 47. The Department raised concern over the effect the following will have on the safe stopping sight distance for vehicles traveling east bound on 146th Street and entering the subdivision: a. Proposed location of the intersection of New Garden Lane, Arnett Drive and Integrity Court in relation to 146th Street; b. The proposed walls; c. The down gradient into the development Have these items been reviewed with the Hamilton County Highway Department in their review and approval of the proposed access? 48. Please confirm that the SSD on the outside of the "squares" will be effective at draining the subgrade of the entire area of the "square Please provide confirmation from the SSD manufacturer. 49. Please clearly indicate the construction limits on the development plans, the off -site grading plan sheets and the off -site water main plan sheets. 50. What basis was used in establishing the minimum lengths of vertical curves? 51. The decorative signs shall be installed and maintained by the developer or the HOA. The speed limit and stop signs must still be enacted by ordinance before they are enforceable by Carmel Police Department. 52. Thank you for adding the note related to the signage meeting the MUTCD. I expect this note is related to the dimensions of the sign, manufacture of the sign, etc. However, the posting of the sign in relation to the traveled road as well as the mounting height of the sign shall also conform to the MUTCD. Please revise detail to conform to the MUTCD for proper placement by the developer's contractor. The Department is reviewing the MUTCD as it relates to the placement of the pedestrian crossing advisory sign. 53. The asphalt path detail for the interior paths indicates an 8 -foot width while the development plans indicate a 6 -foot width. Please revise. Please indicate why the typical street cross sections show the 5 -foot sidewalk at the back edge of the right -of -way. City standard is 1 -foot from the back edge of the sidewalk to the right -of -way line. 55. Please include the City standard roll curb detail. 56. Where are Type `B" ADA ramps proposed? 57. Thank you for adding the backfill notes to the sanitary sewer/PVC pipe bedding detail on Sheet C800. However, the notes added refer to backfill standards for RCP pipe. Please move the Water and Sewer Under Pavement notes from Sheet C801 to Sheet C800 and reference these notes for the final backfill. Also, please revise General Note 5 on Sheet C800. 58. Thank you for adding the note related to the contractor contacting the Department of Engineering to schedule a pre construction meeting. The note is incomplete from the City standard. The note needs to start with the following: "All paving within the existing and proposed City right -of -way shall conform to the requirements of the Department of Engineering." 59. Are easements required from the Carmel -Clay School Corporation and the adjacent HOA to construct the storm piping to the existing pond? If so, these easement must be obtained prior to construction plan approval. 60. As it does not appear that any part of this section is located in a Special Flood Hazard Area, Note 3 under the MFPG definitions on Sheet C201 is not applicable and may be deleted. Also, the MFPG note on Sheets C200 and C201 should be revised to reference the more detailed defmition on Sheet C201 so the information is not duplicated. 61. Please indicate the flood route from the property to the west on the development plan. The Department assumes it will flow through some part of this section. The flood route must be contained in a 30 -foot easement and MFPG and LAG for the lots adjacent to the flood route must be established. 62. How is the New Garden Lane /Arnett Drive/Integrity Court intersection graded. There is insufficient data for me to evaluate. It would appear to me that very flat areas are being created in the southwest and southeast corners for parts of these areas intended to drain to the east and west. How will the pavement be transitioned to normal crown for the east -west streets if the intent is to tie into the gutter of Integrity Court? 63. Are the swales in the vicinity of Lots 11 -14 temporary? 64. The plans indicate a connection by the developer of Cherry Tree Grove to the end of Brauer Lane. Those plans do not show this connection as I recall so there are no approved plans for this 20 -30 feet of roadway. Is the developer of Cherry Tree Grove aware that he needs to make this connection? Also, I cannot recall, but does the Cherry Tree Grove plan anticipate a 6.67% slope in the vertical curve design of this connection? 65. Please move the crosswalk at Lots 1 and 26 to the proposed high point in the road. 66. Is safe stopping sight distance provided from a horizontal and vertical standpoint for the crosswalk on Arnett Drive? 67. The Department is of the opinion that the proposed "squares" represent a large area to drain into inlets farther down the street. What is the total curb length from the high point of the "squares" to the receiving inlets in each case and does this length exceed the standard in the Storm Water Technical Standards Manual for inlet spacing? 68. Sheet C405. What path/walk is being installed then by the developer per the note on this sheet? Is the intent of this note indicating that no such walk or path is being installed by the developer with these plans? 69. Sheet C400 and C401. Why is the back side of the "square" indicated to be 0% slope? I think I understand the intent in this case; however, pavement should always slope, even if a crest. Also, it is not the best idea to have the SE /SW (or the NE/NW) corner elevations the same (or differing by a tenth or two) from that elevation of the interior island. There are large flat triangles being created in these areas. 70. The Department is concerned with the long -term impact to pipe longevity by not having the requisite cover on the off -site storm sewers until subsequent sections are constructed. Short- Mr. Brett Huff February 20, 2008 RE: Legacy Residential, Section 1/Phase 1- Project Review #1 Page 7 of 8 term construction traffic as well as that traffic to construct the future sections will traverse this pipe. Is it not possible to mound soil over the piping to provide the minimum cover? Alternately, is it possible to simply excavate for the future pipe now and leave the conveyance as a swale for future pipe installation? 71. In addition to the Minimum Flood Protection Grade elevations, please also establish lowest adjacent grade elevations for the affected lots. 72.
