Minutes
The Special Studies Committee of the Carmel Plan Commission met at 6:00 PM in the Caucus
Rooms of City Hall, September 4, 2007. Members in attendance: Wayne Haney, Steve
Stromquist, Susan Westermeier.
DOCS Staff Present: Christine Barton Holmes and Rachel Boone
The Special Studies Committee considered the following items:
1. Docket No. 070700017 ADLS Amend: The Ginkgo Tree
The applicant seeks approval for a parking area expansion tree removal. The site is located at
105 1S Ave NE and is zoned B- 1/Business within the Old Town Overlay Character subarea.

Jennifer Hartmann, 3407 Tahoe Road, Carmel appeared before the Committee representing the
applicant. Ms. Hartman said she had talked with the Dept. Staff (Angie Conn, Scott Brewer, and
Christine Barton Holmes) and with Gary Duncan, Engineering Dept., via email. Ms. Hartman
presented new site drawings and parking lot design —the curb has been added for proper drainage.
The large Maple Tree on site will be preserved and this is no longer an issue; at this point, the
garage has been demolished and Ms. Hartman presented a picture of the site showing the absence
of the garage. To the best of Ms. Hartman's knowledge, the only issue outstanding was with
Gary Duncan and Engineering.
Department Comments: Christine Barton Holmes confirmed that she, Angie Conn and Scott
Brewer had met with the petitioner. Most of the outstanding issues have been resolved,
particularly the issue of preserving the Maple Tree, and the tree should show on the site plan as
being preserved. The Urban Forester would like to see an up -dated landscape plan showing how
the parking area will work with the tree. The Department would like to see the commitment
from the Carmel Lions Club granting the petitioner use of their parking lot. At this time, the
Department is recommending approval, subject to three conditions as follows:
1) The petitioner is to follow construction requirements as outlined in an email from Gary
Duncan to the petitioner dated November 14, 2006
2) The receipt of Board of Public Works approval for the curb cut modification
3) Subject to Carmel Engineering approval of final construction drawings

Jennifer Hartman explained that the only thing changing is that the curb will be cut and there will
be added cement around the tree and curbing to protect the tree. The parking lot will have four
(4) spaces; three across the back and one at the corner so that the cars can maneuver easily. Two
spaces are for employees, two for visitors —any employees above the two would park at the
Carmel Lions Club lot—it is public parking.
Wayne Haney noted that with the four spaces, the parking lot is really tight.
Sue Westermeier asked about the percentage of lot coverage—Ms. Hartman said it is 68%
coverage.
Sue Westermeier made formal motion to approve Docket No. 070700017 ADLS Amend, The
Ginkgo Tree, conditioned upon the following: 1) Petitioner is to adhere to construction
practices as outlined in an email letter from Gary Duncan, Carmel Engineering, dated November
14, 2006. 2) Approval from Board of Public Works for curb cut modification. 3) Approval of
final construction drawings from Carmel Engineering and up -dated landscape plan. The motion
was seconded by Wayne Haney, APPROVED 3 -0.
2. Docket No. 07080006 ADLS Amend: Thomson Signage
The applicant seeks approval for 17 new signs. The site is located at 10330 N. Meridian St. It is
zoned 13- 1/13usiness in Meridian at 465.

Jim Shinaver, attorney, Nelson and Frankenberger appeared before the Committee representing
the applicant. Also present: Rick Dyer, Vice President of Corporate Security Real Estate for
Thomson; Doug Staley, Jr., Staley Signs.
There are 17 signs associated with this particular site —the petitioner is simply replacing the 17
existing signs—no new locations. This particular office park is located south of 103r Street, west
of Meridian, zoned B -1 /Business. Thomson has been a long -time corporate partner and business
within the City of Carmel. Thomson is undergoing a transition and has essentially re- located their
corporate offices from the main Thomson building. St.Vincent now occupies most all of the
Thomson building.
This particular location is the hub for Thomson's global satellite business. It is an important
business in Carmel and has created many high skilled, high -tech positions. Of the hundreds of
different Thomson offices throughout the world, it is considered one of the 7, world -wide centers
of excellence. Because this particular office building has national and inter national importance,
clients, visitors and vendors come from all over the country to conduct business and it is
extremely important for the sign package to provide the notice /recognition.
The signs are virtually the same, although there is a slight change with the logo and in the color
scheme. The petitioner appeared before the Board of Zoning Appeals and obtained variances for
the size of some of the signs, but it was mainly an issue that dealt with the logo itself. Again, only
the face of the signs is being changed.

The Department Staff was OK with the red color of the sign showing during the day, their
preference was for a white color at night. The Staff also had a similar preference for the front
monument sign (sign 99) adjacent to Meridian Street —their preference was that the Thomson
name and logo would be black to match the color of the other signs on site.
Color can be a very subjective thing, and the Ordinance under sign provisions does not appear to
regulate color except for the section under Prohibited Signs. There is a strong preference on
behalf of this applicant to retain the color scheme proposed. Because of the transition, the color
scheme is very important to the corporation—it is visible on their letterheads —and visitors from
out of time would be inclined to look for the red color with the Thompson name.
Department Comments, Rachel Boone: The 17 signs replace the existing signs-10 directional, 3
entry signs above the doors, 2 wall signs, and 2 ground signs. There are 5 signs that need a
variance for the size —the 3 entry signs above the doors and the 2 wall signs —the most visible of
the signs to visitors. The Department understands the corporate branding and the color scheme as
well as all of the directional signs, however, the Department's preference is for the signs to be
white at night to match the development, the same as St. Vincent did for their signs.
The current monument sign is colored in pale blue and cannot be seen very well from a distance
because it blends. Black would be better and stand out more from the concrete monument.
Simply for consistency, black would look better and would not take away from Thomson's
identity and branding. The Department respects the color scheme and identity of the applicant,
and supports the petitioner's request. At this time, the Department recommends positive
consideration.
Wayne Haney noted that the proposed monument sign reads well compared to the existing; no
objection to the red.
Doug Staley, Jr. commented that the graphic standards are appropriate and allows for the letters
to be black —there is no need to deviate from the corporate standards. In this situation,
Thomson's preference looks appropriate —the "302 blue" would clash terribly.
Jim Shinaver stated that the red being requested is not an eyesore and is not necessarily
inconsistent the color scheme is subjective.
Susan Westermeier asked if the sign would be red during the day and white at night.
Doug Staley responded in the affirmative and also noted that the logo element of the signs is
beyond a charcoal gray and those letters are non illuminated.
Susan Westermeier made formal motion to approve Docket No. 07080006 ADLS Amend,
Thomson Signage (17 signs) as submitted, seconded by Wayne Haney, APPROVED 3 -0.
3. Docket No. 07080004 ADLS Amend: Smart Car
The applicant seeks approval for exterior building remodel and site changes. The site is located
at 4000 E 96 St. and is zoned 13- 3/13usiness.

Marcelle Tworek, Miranda Construction Group, Baxterset Engineering, 410 US 31 North,
Whiteland, Indiana appeared before the Committee representing the applicant. Also in
attendance: Paul Petinaro represented the owner; Jim Shinaver, attorney, Nelson and
Frankenberger was also in attendance.
Jim Shinaver facilitated the discussion. The site is adjacent to West 96 Street and Lake Shore
Drive. The type of product that would be offered at this location was explained by Paul Petinaro
of Smart Car.
Paul Petinaro, Smart Car, explained the concept of the "Smart Car" product. Currently, the
petitioner owns the Mercedes -Benz store at 3500 East 96 Street. The property at 4000 East 96
Street was purchased about 5 years ago—at that time, Mercedes Benz was starting the "Smart
Car" in Europea small, 5.8 feet machine that get up to 60 miles per gallon. At the time, Benz
approached the network throughout the United States to see who would be interested in dealing
the car -there was very little interest, and the project was killed. It was then decided to remodel
the property into a Used Car Center. The building was completely re -done, then Roger Penske
reached an agreement with Daimler Chrysler to become the importer /distributor of the Smart Car
in the United States.
There will be 50 "Smart" dealers in the USA, one of which we have envisioned opening January
first on 96 Street. What was the Used Car Center will now be the Smart Center of Indianapolis.
This will be one of only 14 that is a free standing center.
Jim Shinaver said it was quite a distinction to achieve the dealer franchise in this area—Chicago
was not chosen.
Mark Twoek explained some of the changes that would be occurring at this site. Via Jim
Shinaver, the sign package will be submitted at a later date. The major change to the building is
exterior and site design. There will be a portal entry added to the front of the buildinga lot of
the change is paint —there is a lot of new metal on the outside per Smart Car requirements.
Exterior -wise, there will be squared -out concrete set for small display areas outside. The bicycle
parking has been answered, the landscaping was approved —the only comment that came up was
the questions of closing the driveway. The Engineering Dept. wanted to close the southwest curb
cut onto 96 Street and that would create a hassle for the petitioner; a compromise is requested
such as a one -way out.
Jim Shinaver said that with the redevelopment of the site, some major drainage issues were
corrected at the rear of the site. Mark Tworek agreed that to the rear, there were major drainage
problems where the parking lot backs up—we have raised that, put the storm sewers in and a
concrete swale in order to alleviate the situation. The building is being up -dated from its current
condition color, etc., the drainage has been approved, and those are benefits. Regarding the
curb cut issue, it looks as if there is a preference (not a requirement) from the Engineering Dept
that the southwest curb cut be eliminated in order to improve traffic flow onsite and also improve
the site's interaction with 96 Street.

Department Comments, Christine Barton Holmes: The petitioner is seeking a complete
remodeling change, basically a new facade to the building. The real outstanding issues are the
variances that will be required for the number of signs, and signs within the right -of -way, and the
curb -cut issue with the Engineering Dept. A right in -right out might be a compromise. The City
Forester has reviewed the landscape plan and has approved it.
Rachel Boone high lighted the signage issues: Originally, the petitioner had proposed a 15 -foot
tall pylon sign; the Department requested that be brought down to six (6) feet —the allotted size
of the ground sign. Depending on the curb cut issue, the directional sign may or may not be
needed. If the curb cut is one -way out, that would be good. The Smart logo is fine on the main
entry doors —the only thing is that this is a Regional Center /Hub, Indianapolis, and the facility is
actually in Carmel. There are a few other directional signs and a service sign —they are fine.
Jim Shinaver said the signage is a part of this package; however, because there is a need for
certain variances, the petitioner will appear before the BZA in October. The design of the signs
would be for approval, the number is under the BZA jurisdiction. Regarding the text, the "Smart
Center of Indianapolis," from a legal standpoint, Jim Shinaver felt that the Smart Center of
Indianapolis is a legal entity and we must be consistent, even though the location would physically
be Carmel, the actual address would be Indianapolis, with an Indianapolis zip code—technically
Carmel, but with an Indianapolis address. In looking at the zoning ordinance and the
requirements, the only control over the text of a sign is if it is "obscene, offensive, things of that
nature." Jim Shinaver gave an example of the "Texas Roadhouse Restaurant," even though it is
not in Texas, it is Indianapolis —but that is their signage, their logo.
Mark Tworek commented that the petitioner would be returning with a complete sign package
after the BZA hearing. The current color of the building is gray and the rear faces Lake Shore
Drive. The neighbor to the east on 96 Street is Penske Honda. The price tag for the Smart Car
is between $12 and $17,000. The candle -power was increased for the parking lot lighting and the
photo- metrics have been submitted and approved by the Department. The landscaping has also
vastly improved.
Everything is the same on the exterior of the building except that between the windows, the face
of the building, and the portal entry, it is in black metal, the balance is paint.
Susan Westermeier made formal motion to approve Docket No. 07080004 ADLS Amend,
Smart Car, conditioned upon the petitioner working with Carmel Engineering regarding the
elimination or compromise on the southwest curb cut, seconded by Wayne Haney, Approved 3 -0.
4. Docket No. 07080020 ADLS Amend: City Center at Penn (122 °d Street Penn)
The applicant seeks approval for 6 new ground signs. The site is located at 1320 City Center
Drive and is zoned 13-3 /13usiness.

Fred Simmons, Simmons Architects appeared before the Committee representing Panatoni
Development. The proposal was originally for three ground identification signs, two off of City
Center Drive, and one off of Pennsylvania Parkway. One of the ground signs is being eliminated

off of City Center Drive and the petitioner will probably return at some point in time when
building 93 is developed and request a variance. The square footage and materials are consistent
with the Ordinance.
Department Comments, Rachel Boone: The Sign Ordinance permits one ground identification
sign per street frontage and the petitioner has two therefore, the petitioner is allowed two signs.
There are three entrances to this site and the petitioner was advised not to apply for a third sign
but to apply for a variance later when that portion of the site is being constructed. The three
direction signs are in compliance-20 square feet, 4 feet tall —the design is consistent with the
entire site. At this time, the Department is recommending positive consideration.
Note: The wall signage is not being presented at this time.

5. Docket No. 07080022 ADLS Amend: North Meridian Medical Pavilion Signage
The applicant seeks approval for 6 new signs. The site is located at 12188 A B N. Meridian St.
It is zoned B -6.

Doug Staley Jr., Staley Signs, 1133 Burdsal Parkway, Indianapolis. Also in attendance: David
Campbell, Property Division of North Meridian Medical Office Bldg. The site is located at 12188
North Meridian Street, A and B Buildings.
The applicant is seeking approval for six new wall signs. Two of the signs will be located on
Building A (currently occupied.) The remaining four signs will be located on Building B which is
currently under construction.
Note: A variance will be required for the number of signs and for two signs to face a public right
of -way for both buildings. The request for variance will be heard at the September BZA meeting.
The signs facing Illinois Street will be 115 square feet of sign area per the Ordinance and is being
requested by the applicant. The signs facing Meridian Street are 95 square feet as approved by
Variance and this is what the applicant is requesting. The signs will be internally illuminated,
individual channel letters with white faces. The logos may not exceed 25% of the total signage
area.
Department Comments, Rachel Boone: The Department is recommending positive consideration
of the sign package as presented.

Amend, North Medical Pavilion Signage for a 95 square foot wall sign facing Meridian Street
and 115 square foot wall sign facing Illinois Street; the sign face color is white, illuminated white

at night and the logos may have color and illuminate with color, but will not exceed 25% of the

Note: The Petitioner will be appearing at BZA on September 24, 2007 for a variance relating to
the number of signs and for two of the sign to face public right -of -way.
6. Docket No. 07080021 ADLS Amend: Key Bank
The applicant seeks approval for exterior building renovations and site changes. The site is
located at 501 E Carmel Dr. and is zoned B-8/Business.

The petitioner is proposing renovations to the existing building located at 501 East Carmel Drive. The
changes involve a stucco band at the top of the building, new roofmg, and a brick stain on the existing brick
surface. Other changes involve new lighting fixtures and new signage. Currently the bank has a sign
facing AAA Way and one facing Carmel Drive. A third sign was proposed on the north side above the
ATM and a ground sign at the corner of East Carmel Drive and AAA Way.
The color and stain of the stucco and brick were shown. The existing trim around the windows, the under
side of the soffit, and the doors will be re- painted a white color.
Christine Stanfield commented that preference of Key Bank corporate is to maintain the two wall signs
such as they have currently —not the pylon sign —pass on the sign at the end of the canopy for the drive
thru, and reduce the size of the ATM sign to meet the requirements.
Department Comments, Rachel Boone: The signs facing east do not face a public street or right -of -way
and would not be supported by the BZA for a variance. The size of the ATM is larger than permissible and
is being reduced to three square feet. Either the wall sign facing Carmel Drive or the ground sign is
permissible, but not both.
Christine Barton Holmes commented that the petitioner is primarily up- dating and cleaning the fagade.
Scott Brewer has reviewed the landscape plan and the Department is recommending positive consideration.
The sconce lighting is acceptable to the department.
Mr. Mesuk sated that the landscaping plan was primarily for the front of the entry off of AAA Way that
was to be up -dated with new plantings. There is not really much of an overall in regard to the existing.
Wayne Haney noted that the improvements give the building more a residential look than commercial, and
he was agreeable to that. Are the down spouts being taken out? Also, the a/c load will be increased with
the dark roof.
Mr. Mesuk responded that the down spouts will remain; the three dimensional asphalt shingle will be used
and will replace the existing roof which is showing definite signs of aging.
Steve Stromquist asked about the Key Bank logo displayed over the ATM and whether or not it was a
change.

Ms. Stanfield responded that the logo is being changed, but it is very minimal. The font is a little different,
a little heavier, and it is more side -by -side.
Susan Westermeier made formal motion to approve Docket No. 07080021 ADLS Amend, Key Bank, two
wall signs, one facing AAA Way, one facing Carmel Drive; (no pylon sign) the ATM sign will be reduced
to three (3) square feet for an incidental sign, subject to Department approval at their discretion, and
subject to landscape approval, seconded by Wayne Haney, APPROVED 3 -0.
7. Docket No. 07080035 ADLS Amend: Goodwill Signage
The applicant seeks approval for its wall sign color (blue). The site is located in Maplecrest
Commons along US 421. It is zoned B -3.

David Dean, United Signs, 1857 Shelby Street, Indianapolis appeared before the Committee
representing the petitioner. Permission is being requested to keep the "Goodwill" blue on the new
building located within Maplecrest Commons on US 421 in the Michigan Road Overlay. The two
signs will be internally illuminated; the west facade sign will be 81 square feet and read
"Goodwill." The sign on the north facade will be 14.25 square feet and read "Donations."
Department Comments, Rachel Boone: The Department would prefer the signs to show as blue
during the day and white at night. Initially, the Department requested that the signs match other
signage within the center. After further research, the only colors presented for the original sign
package for this center were red and white. Goodwill is occupying 50% of the tenant space
within the center, if not more, and as the main tenant, could be allowed the blue sign rather than
red and white. Again, the sign is preferred to be blue during the day, white at night. At this time,
the Department is recommending positive consideration.

Paul Reis, attorney, Bose McKinney Evans, 301 Pennsylvania Parkway appeared before the
Committee representing the applicant. Also present: Principals of ALTA Business Tom Ireland
and Curt Daner and son Mike Daner; Darren Reno, landscape architect; Greg Snelling, Engineer;
Brent Davis, Architect.
Paul Reis referred to an up -dated site plan that dealt with who was constructing the street, the
sidewalk, etc. —there were no major moves for the buildings, only slight moves. The lighting plan
now conforms to the Ordinance.
The petitioner appeared before the Board of Zoning Appeals and was granted approval for
constructing a one -story building; the use of a bank was also approved and construed as services
with retail. The location of the drive -thru on the side was approved at BZA primarily because of
the parking area being situated so that pedestrians would not have to cross the lanes coming into
the drive -thru. A variance was also granted for a building set -back line so that the buildings could
be brought closer to the street. An additional ten (10) feet will be dedicated to the City; even
though the road will essentially be done, the Thoroughfare Plan calls for an additional ten feet and
the petitioner is making that dedication.
Department Comments, Christine Barton Holmes: The petitioner did appear before the BZA last
week. Regarding the drive -thru location, the Staff felt that the drive -thru location as shown on
the layout is actually a safe location and puts vehicle circulation out of the way of pedestrians.
There is nothing shown on the site plan for green parking spaces for hybrid cards, however that is
up to the petitioner's discretion.
Commissioner Carol Schleif emailed a list of concerns. The City Forester is awaiting landscape
plan revisions; Engineering is still reviewing plans and currently has no issues with access to the
site. Access was dictated in large part by the road work done to Old Meridian by the City. The
Engineer's office will look closely at the right -of -way dedication indicated on the new site plan,
also the drainage system— underground water retention. The Department is still awaiting updates
from the County Surveyor. As far as the overall site design, the Department has no concerns and
recommends forwarding this item to the full Commission after all comments and concerns have
been addressed.
In addition to the above, commissioner Carol Schleif emailed a list of her concerns on this project.
The email was printed out and distributed to Committee members this evening.
Wayne Haney said he had no objection to the bank location and also thought the landscaping had
a "sheltering" presence with the trees, bushes, etc.
Paul Reis commented that everything on the landscaping had been approved as far as species,
number, location —the only issue is that Greg and Darren are working with Scott Brewer on how
to address some of the planting areas —the question is whether we need to do some type of
restrictive soil arrangement or not. Right now, we are leaning away from restrictive soils if we
can. Obviously, if a plant dies, we would have to replace it —that is in the Ordinance. If that
comes about, we would have to re- investigate that. All of the other landscaping issues have been
approved by Scott Brewer; Darren Reno concurred.

As far as Engineering, the petitioner is obviously not going to get a building permit until the
Engineering issues are resolved. If there are circumstances that would cause modifications to the
plans, we would return to the Committee. At this time, no major changes are anticipated.
Steve Stromquist asked about the issue with the Fertig Drain.
Greg Snelling, Engineer reported that the Fertig Drain is a County, regulated drain and there is a
restricted release rate of point 24 CFS -cubic feet per second per acre; the City's normal release
rate is point 3, so it is slightly more restrictive than the City's rate. On this particular site, the
petitioner must comply with both the County's release rate and the City's off -site drainage
requirements. Part of the Fertig Drain is an easement and no trees can be planted in the middle of
the drainage easement—it is a 30 -foot easement —not an open ditch.
Susan Westermeier noted Carol Schleif s comments regarding the elevations along the length of
Old Meridian and perhaps adding some parapet height to Building A; otherwise, the buildings will
look so much the same.
Christine Barton Holmes responded that the buildings will be similar but not identical. There is a
character that is being created within Old Meridian where Providence started and that is carried
further; these buildings fit in with that.
Wayne Haney referred to Carol Schleif s comments as having to do with the middle building and
maybe changing the "core" that would slightly change the appearance of the building. Carol's
comments are subjective only.
Paul Reis said he respected the architectural comments from Carol; however, breaking up a small
building is not economically feasible from the useable space on the interior. What is proposed
keeps the character the City is looking for.
Wayne Haney further commented that Carol Schleif s criticism is subjective only. Wayne said he
would mention to the full Commission that the landscaping will greatly soften the look —only two
buildings will be visible at one time.
Susan Westermeier made formal motion to forward Docket No. 07070005 DP /ADLS: Old
Meridian Professional Village to the full Commission with a positive recommendation, subject
to official landscape approval from Scott Brewer, City Forester, seconded by Wayne Haney,
Approved 3 -0.

The applicant seeks site plan and design approval for a multi- tenant retail building.

Jim Peck, Civil Designs, 2415 Directors Row Suite E, Indianapolis, appeared before the
Committee representing the applicant. Also in attendance: George Small, Design Point, 1637
Cornish Drive, Zionsville; Todd Schnatzmeyer, Williams Realty Group, 9830 Bauer Drive,
Indianapolis.
Jim Peck highlighted the development plan and site design for a multi- tenant retail building on
Outlot 3, Weston Pointe located at 11145 North Michigan Road within the Michigan Road
Overlay. There is one lot remaining.
The proposed building consists of 7,968 square feet. There have been some site changes
regarding pedestrian access and bicycles—bicycle racks have been added. The landscape plan has
been revised to reflect the changes, however final landscape plan approval has not yet been
received from Scott Brewer. The approval from the County Surveyor has been received and the
site is pretty much "under wraps."
George Small described the building materials as brick and dryvit and will mimic the building
directly behind the proposed building. Additional brick has been added to the tower, the dryvit is
19 Material -wise, a little darker band will be used for accent; the base is split -face in a taupe
color, accented with a pre -cast stone. The crown molding /cornice work is a lighter dryvit with a
stone cut. The lighting fixtures are similar to those in the retail center. There are black awnings
above the doors at the back of the building. Signage -wise, the address appears in the upper -left
corner of the building, similar to the other buildings.
Department Comments, Rachel Boone: The petitioner states that there will be no signage on the
awnings. All other signage will conform to the Sign Ordinance.
Department, Christine Barton Holmes: This particular building was before the BZA last month
for facade breaks within the Michigan Road Overlay. The building has one, maybe two facade
breaks. The only outstanding issues are the landscape plan approval and approval from the
Hamilton County Highway and Surveyor's office. At this time, the Department is recommending
that item be moved forward with a positive recommendation.
In response to questions from Steve Stromquist, the petitioner said he anticipates six maximum
tenants—possibly a coffee house, ice cream shop, possibly a beauty shop or nail salon, etc.
Currently, in the north building there is a dentist, a bookseller, and the Stone Creek Restaurant; on
the north end -cap of the south building, 6,800 square feet, the Bellagio Day Spa will be opening.
The south end of the south building contains 4,800 square feet and will house P.G. O'Keefe's.
The intent is that the tenants will be signed up before construction.
Rachel Boone asked for confirmation of the signage colors: yellow, green, burgundy, black and
white —the petitioner agreed.
