Good afternoon! Platinum went before the Board of Commissioners today for approval of
access on 146th Street. They received approval for four (4) access points. At the west
end of the project, the large lot residential, they will have a right -in right -out
left -in. East of the residential they will have a right -in right -out. Community Drive
will be a full access and east of Community they will have a right -in only. We will be
working with them on the design of each entrance and some additional agreements for
signalization and requests for access in the future.
As soon as the minutes to the Commissioners meeting are available, I will forward you a
copy for your file. I will keep you informed as to the progress of plan approval. If you
have any questions, feel free to contact me.

Dear Mr. Ochs:
This letter is in response to your request for a determination of classification for memory units as part of a
continuing care retirement community (CCRC) in the Legacy PUD.
I have taken some time to look into this subject and have found that, in general, the memory units (with or
without kitchenettes) will have little impact on vehicle traffic, which is an important consideration when
measuring their impact on the overall allowable density for Legacy.
Consistent with my letter to you dated July 10, 2007, the CCRC memory units shall be considered alike to
the skilled nursing facility (SNF) units, in that they do not fulfill the definition of Dwelling in the Legacy
PUD, and, as such, will not be counted against the maximum Base Unit limitations (1344), nor shall they be
measured against the overall allowable number of combined units, including Based Units and Ancillary
Units (1829).

Regarding your question about use classification presented at out meeting on July 9, it has been determined that
skilled nursing facility (SNF) units, in conjunction with a continuing care retirement community (CCRC), will
not count toward the maximum unit limitations of the Legacy development as described in Section 17 of the
Legacy PUD ordinance Z- 501 -07. The use in question (nursing beds) is considered an accessory use.

Dear City of Carmel Plan Commission Members:
This binder is presented to you by East Carmel, LLC the contract purchaser of approximately
509 acres commonly referred to as the Earlham property, located south of and adjacent to 146`
Street, on either side of River Road. An aerial photograph outlining the real estate is in the
pocket part of this binder, beneath this letter.
Paul Rioux and I have combined our development experience to establish upon the real estate the
Legacy District. The blueprint for the Legacy District is the Legacy PUD Ordinance, establishing
a synergistic blend of residential and commercial uses through seven different use blocks. The
Legacy District provides for a multitude of residential opportunities including larger lot homes,
smaller lot homes, attached residential options, and the possibility of a continuing care retirement
center thereby creating a multigenerational community that has the ability to meet the needs of
its residents as their lives progress. The office and retail will be designed to be walkable and in
direct proportion to the streets and sidewalks where it will exist. This eclectic mix of uses is
orchestrated by the Legacy PUD, the text of which is in the pocket part beneath this letter, and
the exhibits of which are bound in the adjacent 3 -ring binder.
The Legacy District promises an innovative and upscale development for the Earlham property
that will provide residents walking access to neighborhood commercial and open spaces with the
goal of reducing their reliance on their cars. The community will feature over 40% open space,
significant tree preservation, designated bicycle amenities, and an emphasis on pedestrian
accessibility. As the developer we will incorporate many LID practices such as bio- swales and
the use of pervious pavers to allow storm water to percolate back into the ground rather than be
collected and flow unfiltered back into the White River. This design and planning has projected a
certification by the preliminary draft LEED -ND rating system.
The public hearing of this matter originally took place on June 20, 2006. Since then, we have
had eight meetings of the Special Studies Committee, many of which were in addition to
regularly scheduled meetings, and many meeting with the Department of Community Services.
The Legacy PUD, along with all of its exhibits, has received the very careful and thoughtful
analysis of the Special Studies Committee and the Depai tiuent of Community Services, and, as a
result, has been substantially revised and refined throughout this process.
We look forward to presenting this community to you on December 19, 2006.

I am writing as a follow up to our telephone conversation of September 12, 2006. As we
discussed, members of the school administration have reviewed your proposed "Legacy"
project with regards to the number of students which may live in the development.
We are not professional demographers, however our best estimate is the development
might result in approximately 300 additional students. Based on our most recent
demographic study your development would not result in the need for an additional
elementary school. Further, if the project did contribute to additional student enrollment
that would have a positive influence on our school funding.

We have reviewed the P.U.D. Ordinance submitted for review at the May 17, 2006 Technical Advisory
Committee meeting. We offer the following comments:
GENERAL INFORMATION
These general comments along with specifics will be repeated as construction drawings are submitted for
this development.
1. The project site is located within current City of Carmel Corporate Limits.
2. Jurisdictions:

3. Board of Public Works and Safety Requirements:
Water Availability and Sanitary Sewer Availability (EDU) approval from the Board will be
based upon: Single Family Residential 1.0 EDU /single family residence
Townhomes the total number of townhome units and number of bedrooms per
unit 0.54 EDUs /1- bedroom unit; 0.81 EDUs /2- bedroom unit and 1.0
EDUs /3 bedroom unit.
Apartments 89.3 gallons /day /unit x units 300 gallons /day EDUs
Assisted Living Facility Number of beds 0.5 EDUs/bed
Offices 0.5 EDUs /1000 ft of office space
Retail Center based upon specific usage.
If a community swimming pool or bathhouse is planned, additional Water and
Sanitary Sewer Availability approval from the Board will be required and
additional Water and Sanitary Sewer Connection Fees will be assessed. If
entryway or other community irrigation systems are planned, these will also
require additional Water Availability approval from the Board and additional
Water Connection Fees will be assessed based upon the size and usage of the
system.
Commercial Curb Cut Approval This approval will be required for all commercial curb cuts
planned for the development that involve dedicated streets under City of Carmel jurisdiction.
Curb cuts on 146 Street will require separate approval by Hamilton County. Provide a letter
to this office requesting BPWS Commercial Curb Cut approval. Provide an 8 1 /2 x 11 exhibit
or exhibits detailing the requested curb cut(s) with all appropriate dimensional data including
width, radii, acel/decel/passing blister dimensions, existing and opposing streets or drives, etc.

Temporary Construction Entrance approval if the location is at a site other than a permanent
curb cut. Submission requirements are the same as for commercial curb cut.
Any permanent improvement to be installed within dedicated right of way or dedicated
easements. This approval would require a Consent to Encroach Agreement between the
Owner and the City of Carmel.
Secondary Plat approval if applicable.
Dedication of Right of Way if not platted.
Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and/or
the Board of Zoning Appeals (f applicable) and completion of review by the Technical Advisory
Committee. All written requests to be placed on the Board's agenda must include the appropriate
Docket Number and the date (or dates) of approval by the Plan Commission and/or the Board of
Zoning Appeals (if applicable).
4. T.A.C. Review/Drawings submitted for approval:
We request that all comments and comment letters generated by this office be answered in writing
and be accompanied by a drawing reflecting requested revisions. Final drawings will not be
approved for construction until all Engineering Department and Utility Department issues have
been resolved. The design engineer must certify all drawings submitted for final approval. This
office will require a minimum of five -sets of drawings for approval after all issues have been
resolved. The drawings will be stamped as approved and will be signed by the City Engineer and
Director of Carmel Utilities. The Owner will receive one -set which is to be maintained on the
construction site at all times. Carmel Utilities will receive two -sets, our Public Works Inspector
will receive one -set and one -set will be maintained in the Engineering Department. If additional
approved sets are desired, we will approve a maximum of two- additional sets. However, the
additional sets must be submitted with the required five -sets.
5. Please be advised that any installation of signs, walls, irrigation systems, etc. within dedicated
right of way or dedicated easements will require a Consent to Encroach Agreement with the City
of Carmel. This agreement, with the exception of irrigation systems, requires BPWS approval.
The City Engineer may approve irrigation system agreements.
6. Carmel Utilities should be provided drawings for review of water and sanitary sewer issues. They
will provide a separate review regarding these issues.
7. Carmel Utilities does subscribe to "Holey Moley" who should be contacted directly for all water
main and sanitary sewer main locations.
BONDING REOUIREMENTS
8. The following bonding requirements may apply to this project:
Performance Guarantees/Engineer's Estimates
Streets (base, binder and surface must be bonded together)
Curb Gutters
Water Mains
Sanitary Sewers
Storm Sewers/Drainage
Monuments and Markers
Street Signs
Sidewalks (Interior builders lot right of way sidewalks and Exterior common area/perimeter
right of way sidewalks /asphalt paths may be bonded separately).
Right of Way Improvements may be bonded separately. This could include accel/decel lanes,
passing blister, pavement widening, thermoplastic striping, stone shoulders, curbs, etc.
Contact Amanda Foley, City of Carmel Storm Water Administrator regarding bonding
requirements for erosion control.

The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100%
of the cost of labor and materials to construct the individual improvements, to be provided by the
design engineer. Please provide detailed Engineer's Estimates for each improvement including
quantities, unit costs, pipe sizes and materials, etc. Upon completion and release of individual
Performance Guarantees, a three -year Maintenance Guarantee will be required. The Maintenance
Guarantee amount is based upon 15% of the Performance amount for Streets and Curbs and 10%
of the Performance amount for all other improvements. Performance Guarantees may be
Performance or Subdivision Bonds or Irrevocable Letters of Credit. Please reference the
enclosures for more detailed explanation of our procedures.
Right of Way Permit and Bonding
Any work in dedicated right of way will require an approved Right of Way Permit and a License
Permit Bond. The bond amount is determined by the number of instances of work in the right
of way at $2,000.00 per instance. However, if the work is included in the scope of work of a
required and posted Performance Guarantee, the Performance Guarantee may be used to satisfy
the bond requirements of the Right of Way Permit. Please contact our Right of Way Manager,
Fred Glaser, to arrange right of way permitting and bonding.
9. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations
submitted to this office for review. We will share Crossroad's comments as they are received.
When construction plans are submitted for review for this development, please provide a set of
drawings and drainage calculations directly to Crossroad. Please contact Crossroads to obtain a
copy of the City's drainage review checklist. The Department will expect the drainage system to
be designed in accordance with the standards outlined in the checklist.
AVAILABILITY AND CONNECTION FEES
10. Availability (acreage) Fees must be paid after all other Engineering Department requirements
have been satisfied and prior to approval and start of construction activities. Availability Fees are
based upon total platted acreage or legal description acreage for the development at the current
rate of $1,010.00 per acre for Water Availability and $1,365.00 per acre for Sanitary Sewer
Availability.
Connection Fees Please provide this office with a listing of all buildings, residential, commercial
and retail in order to calculate Connection Fees. The current Water Connection Fee is $1,310.00
per EDU. The current Sanitary Sewer Connection Fee is $795.00 per EDU totaling $2,105.00 per
EDU for both water and sanitary. Connection Fees are paid when the infrastructure has been
completed, satisfactory test results obtained and the development has been released for building
permits.
The Availability and Connections Fees are current as of this date but are subject to future
revisions.
If an irrigation system, swimming pool or clubhouse is planned for this development, additional
Water and/or Sanitary Sewer Connection Fees will be assessed based upon the
recommendations of the Director of Carmel Utilities.
PUD ORDINANCE COMMENTS
11. Article 8. I, D. Please add that safe egress from buildings or other areas for emergency or other
purposes shall not impeded by outdoor cafes or fences or other improvements associated with
outdoor cafes.
12. Article 10.1. The Department suggest that any modifications to the standards referenced in this
comment letter and, Per Comment No.: 24 below, any modifications to the standards outlined in
Section 6.03 of the Subdivision Control Ordinance be formalized in the PUD to avoid future plan
review conflict. Such revisions shall be subject to review and approval by the City.
13. Article 10.2. Please add that alley drainage shall be accommodated within the limits of said alleys
and runoff shall not be discharged from the alley to the public streets.
14. Section 15. Please address the provision of bicycle parking per the current City ordinances.

15. Section 15.2. Please add that the on -street parking shall be for the use of the general public and
shall not be dedicated/reserved parking for individual businesses, the residents of the development
or their guests.
16. The Covenants and perhaps the PUD ordinance itself must address responsibility for maintenance
of storm water quality best management practices. This responsibility shall be in accordance with
the Carmel Stormwater Management Ordinance and the Carmel Property Maintenance Code.
17. The PUD and restrictive covenants shall state that the property owners may not install any
Improvements within platted or dedicated easements or right -of -way per the provisions of the
Property Maintenance Code.
18. There are errors in the Table of Contents. For example, Section 10. Streets are actually on page 16
rather than page 13 as shown in the index.
19. The Department recommends that standards be established in the PUD for:
Widths of curb cut, driveways or entrances from the public streets.
Curb return radii of curb cut, driveways or entrances from the public streets.
Access control and offsets to road intersections for such curb cuts /access points. Safe
sight distances shall be accounted for in the design and location of streets, parking, and
buildings, driveway or other curb cuts and alleyways.
20. The PUD shall state that storm water management and system design shall be in accordance with
the Carmel Stormwater Management Ordinance, which was adopted February 6, 2006.
21. The PUD shall state that storm water quality and treatment system design shall be in accordance
with the Carmel Stormwater Management Ordinance, which was adopted February 6, 2006. The
Ordinance should establish requirements for storm water quality (for the overall development and
individual building lots and commercial lots as they develop) to conform to the current City
Ordinance and should encourage low impact development (such as pervious pavement, green
architecture, etc.). Maintenance responsibility of such facilities shall be established to conform to
the City's Stormwater Management Ordinance and Property Maintenance Code.
PRIMARY PLAT
The following comments should be considered requirements of the Department of Engineering and should
be incorporated into the Development Plan/Primary Plat.
22. The Department of Engineering will require detailed information before approving any the
locations of any of the entrances from the perimeter roads. The Department reserves the right to
make additional comments related to required improvements at each entrance when more detailed
information is provided.
23. The northernmost River Road entrance and the third River Road entrance from the north (second
from the south) shall be right in/right out only.
24. The petitioner shall comply with the standards established in Section 6.03 of the Subdivision
Control Ordinance, unless the PUD Ordinance modifies such standards. Such modifications to the
standards outlined in Section 6.03 by the PUD shall be reviewed and approved by the City. Such
standards include:
a. Interior street intersections must be separated by a minimum of 150 feet.
b. The minimum horizontal curve radius for each interior public street shall be 150 feet.
c. The intersection angle between two interior streets may be no less than 75 degrees.
d. Any entrance from perimeter roads will require auxiliary lanes (acceleration lane,
deceleration lane, and passing blister) conforming to City standard dimensions. The City
will defer to the County related to their requirements for auxiliary lanes on the 146th
Street entrances.
e. The Department will expect dedication of right -of -way per the Thoroughfare Plan across
each frontage.
f. Intersections of more than two (2) streets at one point shall not be permitted.
25. The minimum spacing between successive existing and proposed entrances /intersections on River
Road shall be 500 feet.

26. The minimum separation distance between an internal street intersection to an adjacent perimeter
street intersection shall be 150 feet.
27. Platted lots with direct access to perimeter roads were not evident. Please establish non access
easements along the River Road frontage.
28. The City does not allow common areas within the right -of -way.
29. Please label and dimension the right -of -way of all exterior roads and interior streets.
30. Asphalt paths will be required along both the 146th and River Road frontages. Please label the
10 -foot asphalt paths.
31. The curb return radii at each of the River Road entrances shall be a minimum of 40 feet.
32. The curb return radii at each interior public street intersection shall be a minimum of 30 feet.
33. Please provide the City standard street width of 30 feet back of curb to back of curb and standard
right -of -way width of 50 feet for all interior public streets unless the PUD allows differing cross
sections.
34. Please indicate subsurface drains beneath the curb on both sides of all the streets.
35. Please indicate 5 -foot wide sidewalks on both sides of all interior streets.
36. The intersection angle between local streets and River Road shall be 90 degrees.
37. All lots adjacent to side yard easements must be wide enough to accommodate the anticipated
house model and any planned driveways such that there is no encroachment in the easements.
38. Entrances with medians may be a maximum width of 46 feet. Each travel lane (on either side of
the median) shall be a maximum of 18 feet wide and the median shall be a maximum of 10 feet
wide.
39. Please edit or provide a detail which requires the following pavement section for the paving of the
proposed interior public streets: 1.5 inches HMA #11 surface on 2 inches HMA #8 binder on 3
inches HMA #5D base on 7 inches #53 stone. Please add a note that all paving must be completed
in one paving season.
40. Please add an Asphalt Path Detail that requires 1 inch HMA #11 surface on 2 inches HMA #8
binder on 5 inches #53 stone if the proposed multi -use paths will not be concrete.
41. As the drainage design progresses for the Primary Plat, the design shall accommodate detention
volume for the fully developed site and for the fully developed thoroughfare plan right -of -way for
the perimeter road frontages. This requirement shall apply regardless of watershed limits. Please
provide adequately sized pipes to carry water from the street to the proposed ponds.
42. This project is subject to the Carmel Stormwater Management Ordinance, which was adopted
February 6, 2006.
43. All River Road drainage structures and bridges across the frontage of this development must be
indicated on the plans and replaced or improved by the developer to accommodate the widening,
auxiliary lanes, multi -use path, and any other required improvements to the property or the
roadway.
44. Place "PRIVATE" label on all alleys and private streets.
45. The plan shall indicate a continuation of the existing Cherry Creek Boulevard per the current cross
section and shall include curbing of the median. Pavement section shall be per the current City
standards.
46. The City normally requires improvements to the perimeter streets outlined below. However,
unless other or lesser improvements are a condition of approval by the Plan Commission, the City
is requesting the petitioner, in accordance with the Thoroughfare Plan, to completely reconstruct
River Road across the frontage to the cross section and pavement specifications (depth and
materials) established by the Department of Engineering, including adequate drainage facilities
and reconstruction of the existing bridges at the River Road crossings of the Elizabeth Warner
Legal Drain and the Tunis Gerard Legal Drain. In the event that the improvements requested
above are made, the items outlined below will not be required. If other or lesser improvements are
a condition of approval by the Plan Commission, the items outlined below will be required, at a
minimum, across the River Road frontage.

a. A three -foot wide #73 stone shoulder at a minimum depth of six inches across the
property frontage or to the limits of the auxiliary lanes, whichever is greater. Subsurface
drain is required beneath the stone shoulder.
b. Widening across the property frontage or to the extents of the auxiliary lanes, whichever
is greater for 15 -foot travel lanes on each side of River Road. Auxiliary lanes shall be
measured from the edge of the 15 -foot travel lane. Any new pavement placed in the
River Road right -of -way for widening, for auxiliary lanes and for each entrance up to the
mainline right -of -way limit shall meet the following section: 1.5 inches HMA #11
surface on 2 inches HMA #8 binder on 3 inches HMA #5D base on 7 inches #53 stone on
4 inches #2 stone or match existing, whichever is greater. Please delineate this section
with hatching on the plans and appropriate reference in the legend. Please indicate
widening on the road cross section.
c. 1" milling with 1.5" H.A.C. #11 resurfacing for the entire width of the existing roadway
across the property frontage or to the limits of the auxiliary lanes, whichever is greater.
d. Restriping of the existing roadway with thermoplastic striping.
SECONDARY PLAT, CONSTRUCTION PLAN COMMENTS
The following comments should be considered requirements of the Department of Engineering and should
be considered in developing the Development Plan/Primary Plat and shall be incorporated into the
development of the secondary plat and construction plans. The Department reserves the rights to provide
additional comments beyond what is presented below when such detailed engineering drawings are
provided.
47. Please provide monuments at all external corners.
48. Any off -site easements must be secured prior to the Department of Engineering approving the
drawings.
49. Please provide ADA ramps where the entrances cross the asphalt path and at all interior street
intersections.
50. Place "PRIVATE" label on all alleys and private streets.
51. Please add the Department Standard Sub Surface Drain detail.
52. All paving within the existing and proposed City right -of -way shall conform to the requirements
of the Department of Engineering. Please add a note to the drawings that the Contractor shall
contact the Department of Engineering to schedule a pre construction meeting to review the
Department's construction requirements, staff notification requirements, required inspections for
certain stages of the work and to review the authority of the Department as it relates to work
within the existing and proposed City right -of -way.
53. Please provide a maintenance of traffic plan.
54. Please include the note "THERE SHALL BE NO WATER VALVES OR MANHOLES WITHIN
THE PAVEMENT, CURBS, OR SIDEWALKS, OR ASPHALT PATHS" on all appropriate
sheets.
55. Please do not include a landscape plan in sets of plans submitted for approval by the Department
of Engineering. The Department of Engineering does not approve the landscape plan.
56. If it will be necessary to relocate existing utility poles, they must be relocated to within one foot of
the proposed right -of -way.
57. The Department requires that the construction drawings be developed in accordance with the City
of Carmel digital submission standards and that all required submittals for primary plat, secondary
plat, and construction drawings be made. The digital files must be submitted to the Department of
Engineering prior to approval of the construction plans.
58. The City has adopted a new paving policy. Please revise any notes, specifications, and details to
accommodate this policy. The language of this policy must be added to a specification sheet on
the plans.
59. The City has adopted a new curbing policy. Please revise any notes, specifications, and details to

60. Please add a note to the site plan that all existing pavement shall be sawcut to a clean edge where

61. Please develop a plan for the restriping and for striping of the auxiliary lanes. Please add a note to
this plan that all striping shall be thermoplastic. Please delineate the milling and resurfacing areas
with hatching on the plans and appropriate reference in the legend.
62. All bonds and performance guarantees must be posted prior to Engineering Department approval
of construction plans. Board of Public Works and Safety approvals and any other goveming
agency approvals (if required) must be obtained prior to Engineering Department approval. All
performance guarantees must be posted prior to submission of secondary plats for Board of Public
Works and Safety approval.
63. The Department reserves the right to provide additional comments related to the grading and
drainage system upon receipt of drainage calculations and more detailed construction drawings
that provide grading elevations, pipe sizing and invert elevations. These comments may affect the
drainage system layout presented on the Development Plan.
These comments represent the Department of Engineering's initial review of the P.U.D. for this project.
We request that all responses to our comments be provided in writing. Failure to provide written responses
may result in the delay of the review process.
It is critical that this office be made aware of all modifications made on the plans being re- submitted,
particularly if any such changes are considered "new" or fall outside of our previous reviews. Please

Gentlemen,
I'm attaching a few thoughts on the PUD language and site /architectural design for the proposed Legacy
development. I understand some of these points are already being worked on. If you have any questions or
comments, or would like more information, please let me know.
1. Two and three -story raised apartment buildings /flats (condos, most likely) can be inspired from those in the
Old Northside, Meridian Kessler, etc. They blend almost seamlessly with the single family and two- family
houses. I have lots of photos of these types and mixes of buildings, if you'd like.
2. The area with the 90' single family lots is almost completely isolated from the rest of the development. It
needs to be fully integrated, with streets and walkways, with the rest of the site. A couple of walkways and
a stub or two would do it. The exercise trail misses a few obvious connection points, and additional
connections can be added between houses throughout the development by adding 15' or so easements.
3. The elevations need some work. The houses shown in Exhibit H seem to follow most closely the theme of
the development. These designs should be codified in the next version of the PUD. Exhibits I and J are
good too.
4. It would be nice to see more mid century and earlier type commercial buildings rather than the hip- roofed
one -story brick office buildings that pop up everywhere. In fact, it would be nice if there were no one -story
commercial buildings at all on site, not sure how realistic that is though.
5. In general, the development statement indicates a mid century and earlier, traditional neighborhood theme,
however, the site design and particularly the architecture do not bear this out. The development needs
more thematic cohesion if it is to function as an overall neighborhood, rather than a cluster of adjacent
subdivisions.
6. A variety of architecture, including modern /mid century modern, would be great. Again, I have some
photos if you'd like.
7. The assorted Mixed -Use districts are not truly mixed -use. They provide for a limited set of uses within
discrete boundaries adjacent to other uses. True mixed -use districts provide for a mix, including
residential. These districts should integrate uses more.
8. Anything with a drive through or drive -up window is not neighborhood scale. Neighborhood scale implies
walkability, while drive -up /through windows draw people passing through the area and contribute nothing
to the intention of creating a neighborhood. Drive throughs should be eliminated or restricted only to the
outer edges.
9. Lot dimensions are easier to read if they're sorted by individual districts, rather than by individual setback
requirements. A chart may be helpful.
10. Side yards may be too large for some areas, particularly the higher- density areas. State building code only
requires three feet between structures, provided there is a fire wall.
11. Minimum square footage requirements are huge. Reducing them will allow for a wider variety of
architecture and price points.
12. Granny flats should be allowed. In fact, garages and accessory structures are not addressed at all, and as
the development ages, this will become an issue, as people will want to add them and the overall theme
should be maintained.
13. Residential architecture should also require ADLS, not just commercial /office buildings.
14. The PUD needs to incorporate detailed written architectural standards, not just elevations.
15. Trails should be a minimum of 8', not 6', except perhaps where they run through residential

areas /easements. 8' is generally considered the minimum for a multiuse trail.
16. "Pedestrian Corridor" is not defined. Is it a greenway, a trail, an easement to access open area, or a
sidewalk?
17. On- street parking should not be counted towards the sum total parking requirement. A percentage, as in
Old Town, would be better.
18. Anything that is proposed to be marketed to "active adults" should incorporate at least the basic elements
of Universal Design
Just a few thoughts I have more written down in my copy of the PUD, plus copies of photos of some
possible architecture for the site, if you'd like to see them.

The following are our concerns regarding this request by East Carmel, LLC for a change of zoning for the 509.234 acre property (formerly known as the Earlham College
Conner Prairie property):
1). As Homeowners at 14320 Cherry Tree Road, which is located just West of this
property we are concerned about the leeway inherent in the proposed PUD zoning.
Cherry Tree Road (14100 to 14600 blocks) is a very curvy two lane road on which
20 single family homes on relatively large wooded lots (1/2 to 12 acre) are located.
Our country lifestyle and associated property values would obviously be
negatively effected by high density apartment or townhouse developments
adjacent to our properties. And certainly commercial /or retail development on
the Western portions of this property would violate the area's residential
character. It is our understanding that these scenarios are possible under PUD
zoning.
2). Rural, two lane Cherry Tree Road has already been negatively effected by
increased traffic from Pulte's Cherry Creek Development (300 plus homes)
which currently opens onto Cherry Tree in two locations. Any use of Cherry Tree
Road to carry any traffic from this additional 500 acre development would destroy
what is left of its character, as well as the road itself. Also, any plan which
included widening of Cherry Tree Road would destroy our neighborhood.
3). Thus, to know whether we can support, or fight, this development we need to
know just what PUD zoning would mean for this property. Is commercial /or
retail involved? If so where would it be located? What kind of density in housing
is anticipated, or allowed? How much traffic will be generated and where will it be
directed?
It is our hope that these issues will be seriously considered by the Plan Commission when
they discuss the change of zoning from S -1 to PUD for this huge tract.

Dear Mr. Hollibaugh:
Along with representatives of other youth sports organizations, including Carmel Dads' Club, members of
Carmel United Soccer Club met with Mr. Steve Pittman earlier this week to review his plans for the
development of the Earlham Property in East Carmel. While we were very impressed with his plans to
develop this property, we were disappointed to see that the property east of River Road is being planned
as passive "Open Space" and is not being planned as athletic fields for youth sports. We are writing to
share our concems with you.
It is our hope that Carmel United Soccer Club, along with the Carmel Dads' Club and other local youth
sports organizations, would work together to create what would be the crown jewel of athletic facilities in
the area. Carmel.United is unequivocally the best travel soccer program in the State of Indiana. In 2005,
our boys' and girls' teams won 9 out of a possible 14 State Cups and our girls' program is ranked 9
nationally. We have 48 teams and approximately 700 players. Our teams play locally, state -wide,
regionally and nationally thereby promoting the City of Carmel. Each year, Carmel United brings several
million dollars to the community of Carmel and its businesses through our College Showcase
Toumaments, the Murray Cup Toumament and league games where teams travel to Carmel to play.
However, we are outgrowing our facilities and need additional space to assist in maintaining our
competitive advantage.
This land could provide even more playing opportunities for the youth of our area and bring additional
economic benefits to the City of Carmel and its businesses through an increased number of
tournaments, clinics and other events not currently available due to the lack of facilities.
In conclusion, we are excited to see that the space has been set aside to be used as part of Mr.
Pittman's PUD. However, it is our hope that with your support, Pittman Partners and Carmel United
Soccer Club, along with other sports organizations, can help create an area dedicated to youth sports
thereby enhancing the City of Carmel.

Re: Conner Prairie
Ellen Rosenthal, the President of Conner Prairie Museum, Inc., and I met with Mayor
Brainard on April 21 to discuss various matters relating to the reorganization of Conner
Prairie and its independence from Earlham College. We specifically discussed our intent
to pursue the development of a strategic plan for the museum and a master plan for its
properties including the tract described as "Parcel C" in the settlement agreement
between the Indiana Attorney General and Earlham College. We also discussed our
mutual interest in considering the interests of both the City of Carmel and of Conner
Prairie as they relate to that parcel. I subsequently had a conversation with Steve Pittman
in which he reported that you had made the same point to him.
Under the terms of the settlement agreement, the 80 acres of land at the north end of
Parcel C adjacent to 146th Street, the south boundary of which runs parallel to 146th
from River Road to White River, are defined as the "Open Area Acreage." Section 5.2(d)
of the agreement provides that, as a result of the procedures described that section, "to the
fullest extent possible, [Conner Prairie Foundation, Inc.] may use the Floodway Area and
the Floodplain Area for any uses permitted by the Flood Area Restrictions and the S -1
Zoning Restrictions." However, the "Permitted Open Area Restrictions" may, under
certain circumstances, restrict the use of the Open Area Acreage "for public uses as
required by the City of Carmel, but only to the extent that restrictions are required by the
City of Carmel to approve a plat or PUD for the development of Parcel A and/or Parcel B
in accordance with the plans of [the purchaser from Earlham]." The plans described to
me by Steve Pittman for his development of Parcels A and B did not include any specific
uses for Parcel C.
Of course, regardless of the outcome of the zoning procedures for Parcels A and B and
their possible effect on the uses of Parcel C as described above, Conner Prairie
Foundation, Inc. has no obligation to permit any use of that parcel by third persons and
would be free to use that land for any purpose it might determine as long as that use was
not inconsistent with the zoning. You also should be aware that, under the terms of an
"Operating and License Agreement" between Conner Prairie Foundation, Inc. and
Conner Prairie Museum, Inc., dated December 30, 2005, the Foundation has granted the
Museum a license to use all of the real estate owned by the Foundation for Museum
purposes, with the result that Conner Prairie Museum, Inc. also has an interest in and
would be a necessary party to any agreements related to the use of Parcel C by others.
We are, therefore, in agreement with the suggestion that planning by the City of Carmel
and by Conner Prairie with respect to possible uses of Parcel C should go forward on a
cooperative basis and with appropriate consideration of the interests of all parties. We
intend to keep you advised of the progress of our strategic planning exercise as it might
affect the use of Parcel C, and we would appreciate being notified if and when the zoning
approval process for Parcels A and B should come to involve possible further restrictions
on the use of Parcel C.

We have reviewed the concept plans submitted to the Hamilton County Surveyor's Office on
May 4, 2006, for this project and have the following comments:
1. The proposed project falls in the incorporated area and MS4 jurisdiction of the
City of Carmel.
2. The proposed project DOES partially fall in a Carmel Wellhead Protection Zone.
3. The proposed project falls in. the Elizabeth Warner Regulated Drain Watershed
and. the Tunis Gerard Regulated Drain Watershed.
4. Please note this site will be required to comply with the new Hamilton County
Stormwater Management Technical Standards Manual and the City of Carmel
Stormwater Management Manual.
5. Both regulated drains will need to be reconstructed through the site and the
Gerard Regulated Drain will need to be reconstructed to the White River, as this
will be the main outlet point for this site.
6. Hamilton County Ordinance 4- 26- 99 -C(6) does not allow the filling of the
floodplain of a Hamilton County Regulated Drain, which is the major portion of
the floodplain located on this site. This floodplain will need to be appropriately
dealt with as this project progresses forward.
