Griffiths, Luci Snyder, Kevin Rider, Clerk- Treasurer Diana L. Cordray and Deputy Clerk Treasurer Lois Fine. Councilor Carter was not in attendance. Mayor Brainard called the meeting to order at 6:00 p.m. Rabbi. Benjamin Sendrow, Congregation Shaarey Tefilla, pronounced the Invocation. Mayor Brainard led the Pledge of Allegiance. I RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: There were none. APPROVAL OF MINUTES: Councilor Seidensticker made a motion to approve Minutes from the October 18, 2010 Regular Meeting. Councilor Griffiths seconded. There was no Council discussion. Council President Sharp called for the vote. Minutes were approved 6 -0. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL: Jim Smith, P 0 Box 685, Carmel, 1N. addressed the Council regarding utility concerns at 111 and College Avenue. Jack Badger, 3039 Rolling Springs Drive, Carrnel, IN. addressed the Council regarding Carmel communications. COUNCIL, MAYORAL AND CLERK TREASURER COMMENTS /OBSERVATIONS: Councilor Snyder addressed the Council regarding the Hamilton County Humane Society. Council President Sharp addressed Mr. Smith and Mr. Badger. 1 Mayor Brainard addressed Mr. Smith. ACTION ON MAYORAL VETOES: There were none. CLAIMS: Councilor Griffiths made a motion to approve Claims in the amount of $1,306,887.14. Councilor Snyder seconded. There was brief Council discussion. Council President Sharp called for the vote. Claims were approved 5 -0 (Councilor Sharp abstained). COMMITTEE REPORTS: Councilor Snyder reported that the Finance, Administration and Rules Committee had not met. The next meeting will be held on Thursday, November 18, 2010 at 5:30 p.m. Councilor Griffiths reported that the Land Use, Annexation and Economic Development Committee met and discussed Ordinance Z- 544 -1.0 and Ordinance Z- 545 -10. Both ordinances were referred back to the Council with proposed amendments. Council President Sharp reported that the Parks, Recreation and Arts Committee had not met. Councilor Griffiths reported that the Utilities, Transportation and Public Safety Committee had not met. Mr. Hammer presented the report from the Carmel Redevelopment Commission. There was brief Council discussion. OLD BUSINESS Council President Sharp announced the Fifth Reading of Ordinance D- 2003 -10; An Ordinance of the Common Council of the City of Cannel, hldiana, Amending Chapter 2, Article 4, Section 2 -127 of the Carmel City Code (Municipal Food and Beverage Tax Fund #105). Council President Sharp addressed. the Council and without objection was Withdrawn by Council President Sharp. Council President Sharp announced the Third Reading of Ordinance D-2015-10, As Amended; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 1, Division II, Section 2 -8 (c), Adding 2 -8(d) (Redevelopment Commission) of the Carmel City Code. Council President Sharp lifted this item from the Table. There was brief Council discussion. Councilor Griffiths made a motion to approve Ordinance D- 2015 -10, As Amended. Upcoming Meetings: o Wednesday, November 17, 2010 Regular Meeting Financial Matters: The end of month September CRC Operating Balance is $11,359,054 CRC Public /Private Partnerships: 1. City Center CRC /Pedcor LLC. (Parcel #5) a. Please see attached report from Signature Construction (Distributed at 10/25/10 CRC meeting). 2. Performing Arts Center (Parcel #7 -A) a. Please reference attached Construction Manager's report. (Distributed at 10/25/10 CRC meeting). 3. The "Green" (Parcel #7 -B) (The "Green" is the green space between the Concert Hall and the Main Stage Theater /SEP Office building to the south.) a. Please reference attached REI Project Manager's report. b. Construction Manager Meyer -Najem has kicked off construction of the "Green" by clearing contractor equipment to begin laying out the curb work for the loop road that comes off 3rd Avenue and serves both The Palladium and supporting theaters. The road must be complete for Office Building #1 tenant (SEP) to move in by December 1, 2010. c. Coordination meetings with City Fire officials regarding access to the Office Building are being resolved. 1 d. Underground utility work is underway with the streetlight pads poured and sidewalks defined. Campus security and fiber optic lines are being run to connect City Center buildings, both public and private. Security camera locations, both exterior and interior, have been laid out and looped together at a common monitoring station. e. The "Green" surface will be ready for Palladium events with final landscaping complete in Spring 2011. All contracts for work have been awarded. f. CRC has authorized the City of Carmel IT Depai tuient to order security equipment based on bids and existing City contracts. All equipment and installation will be paid for by the CRC. The CRC has also authorized underground conduit runs for City Center and public buildings based on the City of Carmel IT Depaitnient's recommendations. Once all security systems are installed, the City's IT Department /Communications Center will monitor and maintain the equipment. 4. Energy Center (Parcel #7 -C) a. Construction work is nearing completion to add the additional pumps and modules to serve the Main Stage Theater, Office Building #1 and Office Building #2 with the necessary capacity that will serve existing city buildings to include City Hall, police department and fire station. Work was substantially completed in. October 2010. b. Survey work has been completed to establish routes to run hot and chilled water lines to the city buildings. Engineering documents will be bid to establish construction costs of running lines to city buildings. Consulting engineers have worked up a cost estimate to rework the 20- year -old heating and cooling systems in the existing city buildings, especially police headquarters. c. CRC is working with outside counsel and John Duffy of the City of Carmel Utilities on operating the Energy Center within the rules set by the State of Indiana Utility Regulatory Commission. City Utilities will assist the CRC in maintaining the Energy Center until final disposition of the Center is resolved. 5. Main Stage Theater CRC, REI and Pedcor LLC (Parcel #7C -1) a. Construction is moving forward at a fast pace. Structural steel is about 100% complete with adjacent masonry shaft for the elevator and stairs completed. b. Contracts have been awarded for shell and core and are below budget. c. Masons have started building an enclosure wall around the Theater interior space. The architects have submitted the proposed Theater color schemes and finishes to the CRC Plan Review Panel, and received approval by the committee. Samples of Theater seating have been submitted for approval. d. Main Stage Theater is set for completion in June 2011 and the Studio Theater could be ready by March 2011. 2 e. Bids for Theater equipment have been received and appear to be below budget. Theater interior finishes bids have been received and are being evaluated. 6. Studio Theater Office Building #1 (Parcel #7C) a, Interior construction of Theater space is well underway with all trades installing walls, ceilings, structural supports and mechanical and electrical rough -ins. b. Theater equipment and sound systems have been ordered and will start to be installed by the end of December 2010. c. Construction Manager has had Civic Theater and Steven Libman sign off on theater and sound equipment lists. d. Studio Theater general construction will be substantially complete December 31, 2010. 7. North Office Building #1 CCDC (Parcel #7C -2) a. The building shell has been entirely enclosed. Glass and frames are now being installed on the east and north wall. Masonry is going up on the east and north side of the building. Interior cores spaces are being completed with mechanical and electrical work underway on the top two floors. b. SEP space has been turned over to their Finish Contractor who started work on July 19, 2010. CRC's Construction Manager is coordinating all trades to assure SEP space is complete by December 1, 2010. c. Duke Energy has mandated several electrical service requirements that affect the various products under construction and the two future projects Office Building #2 and Residential Lofts. Electrical service for the Green will come from the main transformer "farm" at the Energy Center. d. Loop road work that is necessary for SEP to occupy Office Building #1 started on August 24, 2010. Construction Manager is looking at lobby modifications to meet needs for public access to Farmers Market. 8. Parking Structure CRC (Parcel #7C -3) a, Garage construction is nearing completion. Garage final finish materials are arriving daily to meet construction schedule delivery to site. b. Contractor has completed pouring topping slabs on upper floors. Contractors are preparing to pour the concrete slab at grade. Construction Manager and Architect are reviewing topping slabs in areas that appear to have uneven finishes. Concrete 3 contractor has completed the underground storm water retention area under the south end of the garage. c. Framing and glass infill at stair towers along with architectural grillwork are now complete. d. Garage substantial completion will be November 2010. Construction Manager is working with City agencies to obtain Certificate of Occupancy no later than December 1, 2010. e. The garage security system as well as the controlled entry points are being resolved with security consultants as the building relates to both the Theater and Office Building. 9. Arts District Lofts Shoppes CRC /Keystone Development (Parcel #47) a. Contractor has basically completed the underground garage with installation of utilities for drainage, water and power. Utility companies are running power from across the street (north side of 1st Street NW) into the electrical load center in the garage. Final transformer and meter panels have been resolved with Duke Energy. Street cut for utilities is being coordinated with City agencies. b. Additional carpentry and drywall labor is being added to the job for interior finish. Good weather has helped the schedule. c. Mansard roofing is complete with full roofing completed October 2010. Material supplier arriving daily to keep up with the construction. d. Building exterior masonry is complete on the east, north, west and south side of the building. Developer has submitted minor exterior changes to the CRC Plan Review Panel for upper floor wall vents and penetrations. e. Trade contractors are constantly being reminded not to park on City streets and to park at the old City Street Department site. Contractors will soon be able to park in the lower levels of the garage. f. Bids for streetscape and road work were received on July 14, 2010 and rejected. Construction Manager recommended rejecting bids and re- bidding with more alternates based on Commission's comment that the costs are over budget. Bids were opened on September 8, 2010, 8:00 a.m. at a CRC special meeting and taken under advisement with the Construction Manager making recommendations at the September 15 regular meeting to award contracts to Gibraltar Construction for all streetscape and 2nd Ave rebuilding to include storm water provisions. 10. Arts Design District Parking CRC (Parcel #62) a. The site behind the Chaos building has been filled with gravel on a temporary basis to fill in where old garages were demolished to allow for proper drainage away from buildings. 4 b. Existing CRC parking area has been re- striped to provide a more orderly and effective visitor parking area. c. The CRC is reminding merchants and their staff that they should be parking in the Carmel Lions Club Parking lot to maintain available parking for shoppers. 11. Apostolic Church Site/Nelson Property CRC (Parcel #92) a. Commission and consultants are working towards a closing on the sale of the property to Keystone Construction Corporation. b. CRC expenditures on Parcel 47 are conditioned upon the developer meeting its obligations under the development agreement, i.e. closing on the church property. Arts Design District Update: 1. News and Events a. A Clarian North Gallery Walk will be held in the Arts Design District on Saturday, November 6 from 5 -10 p.m. 5 mature on str°ucti LLC City Progress Report 10/14/10 Signature Construction is pleased to provide a brief list of highlighted activities being completed in Carmel within the last month for Carmel City Center Building A, Building B, P111 Waterproofing and Pavers, Village on the Green Parking Garage, Village on the Green Theater, and Tenant information at Indiana Design Center as well as Carmel City Center Buildings A B. 1. Parcel 73 Streetscape Project Divvy's restaurant retaining wall and planter work complete as well as the west stairs. East stair work has started. Masonry on Divvy radius wall has started. The Wedgewood. Way ramp is poured and opened as egress. City Center Dr curb demolition is complete as well as underground storm. Work continues on the parking islands and the zigzag curb that surround the pull off lane. Completed the underground roughs for the electrical drawings revised 9/21. The landscape block wall along Rangeline Rd has started. The underground conduit extension from the radius wall west has started. 2. P -111 Waterproofing, Mud Slab and Pavers Poured Veterans Way trench drains 10/13. Hanover Place north trench drains and curb forming began this week. Completed asphalt installation on Chandelier Court and Hanover Square. Asphalt installation on Hanover Place will begin this week. Expansion joint installation between Chandelier and Hanover has started. 3. Carmel City Center Building A Parcel 5 Completed roofing and windows /glazing at turret. Installed balance of hardware at storefront doors. Nearing completion of balcony railings. Installed majority of pavers at Public Ways. Energized exterior lights. Installed coiling doors in garage. Continued installations of louvers at garage fan rooms. Finishing miscellaneous items for fire alarm /mechanical work at hydronic elevators. Completed 5 floor and turned over to the owner. 4. Carmel City Center Building B Parcel 5 Tennant work for Drury Simmons has begun. Framing and rough in progress. o Received shell Certificate of Occupancy. 5. Village on the Green Parking Garage Parcel 7C -3 o RL Turner completed storefront. Brick columns at the entry are complete. Entry metalwork installation continues. Roofing is complete. Caulking continues. Concrete sealing will start when the architect approves repairs. Site road excavation continues. Site curb work is complete. Storm sump is complete and operating. o Real Mechanical is working on fire protection on the 1 st floor. The ductwork is being installed for the CO fans. o Sidney Electric continues power and lighting rough. The temporary electric service has been removed. 6. Village on the Green Theater Parcel 7C -1 The CMU walls at the West, East and South sides of the stage have been topped -out (only CMU in -fill work around steel remain at these walls). We are currently laying CMU walls at the North stage walls. In addition, we are currently laying CMU walls at the 1 floor SE SW. We have poured the remainder of the 2 nd and 3rd floor decks at the East side as well as along the South side. We are currently working on steel detailing work along the West elevation. This work is scheduled to be completed by the end of next week. Exterior wall framing and sheathing work at the North and East elevations is scheduled to be complete by early next week (less the opening for equipment access). Weather barrier work for the N E elevations is scheduled to start next week. We will be working on the slab -on -grade prep work in conjunction with the radiant floor heating piping work at the North side 1 floor next week. Granite is scheduled to be delivered by early November. We are tentatively scheduled to start veneer masonry work at the East elevation the week of 10/25. We are currently working on in -wall plumbing rough -in work, as well as overhead MEP rough -in work, at the East side of the 1 floor. In addition, overhead MEP rough -in work continues at the lower level and has commenced at the 2 floor. We have started to layout the interior walls at the East side of the 1 floor. We are scheduled to start interior wall framing in this area next week. The air handling units are currently scheduled to be delivered the first part of November. 7. Indiana Design Center Tenant Spaces The total leasable square footage for Indiana Design Center is 82,408 square feet. Currently, 53,000 square feet is leased. 8. Carmel City Center Tenant Spaces The total leasable space for Carmel City Center Phase 1 is 78,427 square feet.
