AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL I H ANA,
AMENDING CHAPTER 2, ARTICLE 4, SECTION 2 -127
OF THE CARMEL CITY CODE
WHEREAS, the Common Council of the City of Carmel, Indiana "C has established a
municipal food and beverage tax and created a Municipal Food and Beverage and "Fund 105 in
which to deposit all tax revenues and any interest earned thereon that e -negated by said tax, as
codified in Carmel City Code Section 2-127; and
WHEREAS, the Council desires to use all monies depon und 105 for the support of the
City's Center for the Performing Arts, as permitted by Indian Co 6 -9 5 -14; and
WHEREAS, the Council desires to establish pr ur s or the disbursement of monies from
Fund 105.
NOW, THEREFORE, BE IT ORDAINE ►T Common Council of the City of Carmel,
Indiana, as follows:
Section 2: Chapter 2, Article Se io► -127 of the Carmel City Code shall be and the same is
hereby amended by the addition of t subsections:
"(c) All monies deposited in t Fund all interest earned thereon, shall be used to support the City's Center for
the Performing Arts.
(e) Funds from the Fun shat •e dispersed only upon the written request of the Mayor, who shall indicate therein the
reasons why is in he p bli interest to support the Center for the Performing Arts.
(f) The Council ay, r -r due discussion and deliberation, approve the Mayor's request as written or may approve the
same in an amo s than that requested by the Mayor, change the request recipient of same, or disperse monies
from the Fund abs t a written request from the Mayor to do so.
(g) The Pres' -ent Pro Tempore of the Council shall account, by separate line item, for the receipt and disbursement of
all sums to =nd from the Fund."
Secti 3. All other provisions of City Code Section 2-127 shall remain in full force and effect
and are no affected by this Ordinance.
Section 4. If any portion of this Ordinance is for any reason declared to be unconstitutional or
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as
enforcement of same can be given the same effect.
Section 5. This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor.
PASSED by the Common Council of the City of Carmel, Indiana, this day of
2010, by a vote of ayes and nays.
