(2) Reserved" Page One of Three Pages ORDINANCE D- 201 -10 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ADDING CHAPTER 8, ARTICLE 3, SECTION 27, TO THE CARMEL CITY CODE AND AMENDING CARMEL CITY CODE CHAPTER 8, ARTICLE 3, SECTION 8 -26, SUBSECTIONS (a)(1) and (2) WHEREAS, the City of Carmel, Indiana "City has the authority to establish motor vehicle speed limits pursuant to City Code Section 8 -15 and Indiana Code 9- 21 -5 -6; and WHEREAS, the Common Council now finds it appropriate to establish a 50 m.p.h. speed limit on Keystone Parkway from 98 Street to 146 Street within the City's corporate limits, and to remove the worksite speed limits currently in effect thereon. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section L The foregoing Recitals are incorporated herein by this reference. Section 2. Chapter 8, Article 3, Section 8 -27 should be and the sane is hereby added to the Carmel City Code and shall read as follows: §8 27. Fifty m.p.h. Speed Limit Designations. (a) No person shall drive a motor vehicle in excess of 50 miles per hour on the following streets: (1) Keystone Parkway from 98 Street to 146 Street. (2) Reserved. (b) Any person who operates a motor vehicle in violation of this Section shall, upon conviction, be fined in an amount not to exceed $2,500.00 for each such violation." Section 3. The Street Department is directed to promptly install appropriate signage consistent with this request. Section 4. Chapter 8, Article 3, Section 8 -26, Subsections (a)(1) and (2) of the Carmel City Code should be and the same are hereby amended to read as follows: Section 5. All other current provisions of City Code Section 8 -26 shall remain in full force and effect and are not affected by this Ordinance. .r This Ordinance prepared by Douglas C. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. Section 7. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 8. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor.
