The Minutes of the February 16, 2010 meeting were approved as submitted Legal Counsel Report, John Molitor: An update on the Johnson Acres garage situation is anticipated next month. Also, the Carmel SmartCode was defeated at City Council last evening. Docket No. 10010007 DP /ADLS: Legacy PUD The Livingstone Cottages The applicant seeks site plan and design approval for an adult family living/continuing care development. The site is located at the northwest corner of Community Dr. and Cherry Creek Blvd. It is zoned PUD /Planned Unit Development. Filed by Brandon Adomatis of Adult Family Living, Inc. The motion was seconded by Sue Westermeier, approved 8 -0. 2. Docket No. 10010008 DP /ADLS: Meridian Pointe The applicant seeks site plan and design approval for a 174 -unit multi family development. The site is located at 12346 Old Meridian St. It is zoned OM /O Old Meridian District, Office. Filed by Anthony Birkla of Anderson Birkla Investment Partners, LLC for Carmel Development I, LLC. Present for Petitioner: Mary Solada, attorney; Anthony Birkla and Tim Hill, Anderson Birkla Investment Partners. No sidewalks on either side? Any indoor or underground parking? Connectivity of paths along Pennsylvania Meridian Streets to front door of buildings? Provision for indoor bike storage? Request streetscape be distributed at Committee Where different colors and materials will be placed would be helpful— please enlarge /clarify Address any consideration to extending the bike path across the entire property so that other persons could get from Old Meridian to Pennsylvania and beyond —a short cut path Signage —need to know location, size, aesthetics Tim Hill, Anderson Birkla Investments: Location of structural supports would not allow construction of a sidewalk Anticipating installing pavers rather than 10 foot sidewalk in front of entry Secondary access on the west side Approximately 10% of the units have attached garage parking Indoor trash compactors and recycling stations Anderson Birkla intends to be long -term owner of the apartment community 10 -foot bike path around entire site with connectivity Internal bike lockers will be utilized Awning rendering cornice signs shown— working on the details Motion: Sue Westermeier "To delegate full authority to Subdivision Committee for a final vote on Docket No. 10010008 DP /ADLS, Meridian Pointe." The motion was seconded by Madeleine Torres, voted 7 in favor, one opposed (Grabow) Motion approved 7 -1. 3. Docket No. 09090004 OA: SCO Ch 4: Definitions, Amend The applicant seeks to amend Chapter 4: Definitions of the Subdivision Control Ordinance in order to add definitions for Preliminary Plat and Final Plat. Filed by the Department of Community Services, on behalf of the Carmel Plan Commission. Present for Petitioner: Alexia Donahue -Wold, Department of Community Services, City of Carmel. Docket No. 10020015 Z: C -1 Rezone, Arby's /Party Time /Langston Properties The applicant seeks to rezone 6 properties from B -3 /Business and I -1 /Industrial zoning, within the Carmel Dr /Range Line Rd Overlay, to the C -1 /City Center zoning classification. The properties are located at the northwest corner of Range Line Rd. and Carmel Dr. Filed by the Department of Community Services, on behalf of the Carmel Plan Commission. Present for Petitioner: Michael Hollibaugh, Director, Department of Community Services, Carmel. Overview: Propose rezoning approximately 10 acres within City Center area to C -1 /City Center zone Property located at northwest corner of Range Line Road and Carmel Drive Proposal is to rezone 6 parcels from B -3 /Business and I -1 Industrial Zone to C -1 /City Center Arby's, Party Time Rental, and 4 tracts owned by Langston Development Proposal includes key infrastructure extending Executive Drive, enhancing Range Line and Executive Drive intersection to bring Executive Drive into Veterans Way, and structured parking to help make up the difference in elevation on Range Line Road, especially at the Party Time site. The motion was seconded by Madeleine Torres, approved 8 -0. I. Old Business 1. TABLED TO APRIL 20: Docket No. 09100009 DP /ADLS: Long Branch Market w/ Kroger (Altum's site). The site is located at 11335 North Michigan Road. It is zoned B-3/Business and located partially within the US 421/Michigan Road Overlay. Filed by Robert Barker of Zinkan Barker Development Co., LLC. Docket No. 09100011 DP /ADLS: CVS Pharmacy at Rangeline Rd. The applicant seeks site plan and design approval for a new retail building. The site is located at 1421 S. Rangeline Rd. and is zoned B -8 /Business within the Carmel Dr. Range Line Rd. Overlay Zone. Filed by Craig Forgey of Gershman Brown Crowley, Inc. Present for Petitioner: Charlie Frankenberger, attorney, Nelson and Frankenberger; Tom Crowley, Gershman Brown Crowley, and other members of the development team. Also present: Jon Dobosiewicz, Land Planner with Nelson and Frankenberger. Overview: Site is located at northeast corner of Medical Drive and Range Line Road Site is currently occupied by a CVS and Taco Bell Proposal will replace CVS and Taco Bell with one, new CVS store Current architecture and design of the building are not consistent with the desired character of the Range Line Road corridor The site is somewhat cramped and parking and site circulation are difficult The proposal was referred to the Special Studies Committee for review and is now being referred back to the Plan Commission with a unanimous, favorable recommendation The BZA granted development standard variances on the site January 26, 2010 The building has been revised by continuing wrapping the kneeboard around the southwest corner and by providing some variation to the east elevation of the building As a condition of BZA approval for requested variances, petitioner agreed to no signage painted on or affixed to the windows City Engineer recommended removing the on- street parking Special Studies Committee recommended getting two bids for cost of installation of on- street parking; petitioner would then pay into the City's Thoroughfare Fund, the average of the two bids written into the Findings of Fact as a condition of approval Petitioner is requesting approval from the Plan Commission this evening Department Report, Angie Conn: Two remaining staff comments to be addressed prior to recommendation of approval: Pedestrian crosswalk across drive Location of stub in relation to parcel to the east Jon Dobosiewicz, response to Staff Comments: Site plan revisions were submitted illustrating striped crosswalk connection thru parking lot to access remaining parking area Site plan also shows connection to the property to the east Revisions also cited elevations with building materials Petitioner is providing turn -out to the property to the east (Ordinance requires it) Committee Report, Woody Rider: No outstanding issues from Special Studies Committee voted unanimous 4 -0 to recommend approval Commission Questions /Comments: Businesses need to be seen —trees should not block signage Windows —how far back is signage? Maintenance could be an issue Any possibility of expanding Medical Drive at the intersection to allow for dedicated right turn lane? City Engineer has considered the possibility of a roundabout as well —no right lane turn proposed. Response Comments, Jon Dobosiewicz: Sufficient right -of -way has been dedicated to provide for future construction of a right or left turn lane at this intersection. This area was to have been on- street parking. No graphics will be applied to the window; the picture behind the window will be coordinated with perhaps the Carmel Clay Historical Society to provide photos that might be used for the back -drop. Local art work will also be placed behind the window —not just a window but a bay area for easy maintenance. Motion: Woody Rider "To approve Docket No. 09100011 DP /ADLS, CVS Pharmacy at Range Line Road, with the addition that Urban Forestry work with the petitioner to do plantings in front of the building that will never block their signage." The motion was seconded by Sue Westermeier, Approved 8 -0 J. New Business 1. Docket No. 10010006 ADLS: Cannel Science Tech Park, Blk 7, lot 1 Midwest ISO The applicant seeks design approval for a building to expand its data center. The site is located at 701 City Center Dr. and is zoned M -3 /Manufacturing. Filed by Fred Simmons of Simmons Architects, LLC for Midwest ISO. Present for Petitioner: Fred Simmons, Simmons Architects, 305 East New York Street, Indianapolis. Overview: Proposal is for a free standing, un- occupied building that will more than double data center capacity Possibility that only half of the expansion will be constructed this year and the balance when needed Building is single -story, no roof -top equipment Building materials will match existing building materials, colors, and patterns Original headquarters building, 720 City Center Drive) was designed for a portion of the data center to be located in the basement and mechanical equipment in the parking lot this never came about Site has a parking ratio of 4 spaces per one thousand square feet; the Ordinance requires 3 per one thousand square feet Midwest ISO is way over parked Current parking calculations allow for expansion of the 720 building probably within the next few years, by 35,000 square feet on three floors Site plan shows a tree preservation area inventoried in 1999 when the 701 building was originally designed Petitioner has worked closely with the Urban Forester to mitigate the elimination of 35 trees to accommodate the new facility Petitioner has landscaped around the building as appropriate based on t he Ordinance Wall- mounted light fixtures will be used Department Report, Angie Conn: All Department concerns have been addressed Engineering Dept recommends that approval be conditioned upon Engineering Dept's approval of construction documents Recommend Plan Commission suspend its Rules S:/PlanConunission/ Minutes/ PlanCommissionMinutes /PCMinutes2010/PC- 2010 -marl6 6 ONE CIVIC SQUARE CARMEL, INDIANA 46032 317 571 -2417 0 Recommend approval Motion: Woody Rider "To approve Docket No. 10010006 ADLS, Carmel Science Tech Park, Blk 7, lot 1, Midwest ISO." Commission Comments /Questions: How many surplus spaces exist to back -fill the 79 space shortage? Response, Angie Conn: Taking both sites into account, there will be a surplus of 128 parking spaces Further Questions from Commission: How many persons working/occupying the new building?
