The Minutes of the June 15, 2010 meeting were approved as submitted.
Legal Counsel Report, John Molitor: Reminder of the Executive Session scheduled for 7:00 PM or
immediately following the conclusion of the Plan Commission meeting.
John Molitor conveyed due thanks to Madeleine Torres and Rick Ripma for their time and work on behalf
of the Plan Commission as the Hamilton County Appointments. With the annexation of southwest Clay
Township, Rick and Madeleine become residents of the corporate boundaries of Carmel and no longer
County appointments. The City will acquire two new members from unincorporated areas of the City.
Department Announcements, Angie Conn: Items 2 and 3, Village of Mount Carmel, Section 11 have been
Tabled to the August 17, 2010 meeting.
H. Public Hearings
1. Docket No. 10060013 DP Amend /ADLS Amend: Regions Bank
(Kite PUD; Greyhound Commons, Ph III). The applicant seeks site plan and design
approval for a bank. The site is located at the southeast corner of 146 St. and Lowes Way,
and is zoned PUD /Planned Unit Development. Filed by Mark Naylor of The Roberts Group,
PSC.

Overview:
Regions Bank location is southeast corner of 146 Street and Lowe's Way
Site approval is for a plan previously approved by Plan Commission for Key Bank
The previously approved layout is the same —storm water, site circulation, and placement of the
building
Nothing has been done that would alter the previous approval
Access from 146` Street and from Lowe's Way is as it has been (right into the site from 140
Street, right onto Lowe's Way)
Access from 146 Street is Right In only
Residents of Danbury Estates will find access to 146` Street easier from Lowe's Way rather than
negotiating a left turn onto 146` Street
Request Development Plan approval this evening and forwarding to Committee for ADLS
review approval

Entry off Danbury Drive —for bank only and exit onto Lowe's Way?
Request more convenient location for bike racks /parking
Width of sidewalk/bike path?
Right In Only? Committee approved right in /right out as long as the right out was a
deceleration lane all the way to Danbury Estates entrance
Response, Mike Naylor:
Access will be one -way coming from Danbury, through the bank property, and right at Lowe's
Way to 146` Street
Bike path is at 5 feet, but the width can be increased
Bike rack/parking is along the front sidewalk will try to put it more towards the front door but
will also look at re- working the corner where it currently slopes to accommodate bike parking
Plan approved by Hamilton County only shows a right in
Department Response, Angie Conn:
The Hamilton County Commissioners have jurisdiction over 146` Street —the end result is right -in only
Note: Paul Reis stated that it is only a right in from 146` Street, but the deceleration lane does go
all the way across 146 Street to the entrance of Danbury Estates
Residents of Danbury Estates were in attendance at the meeting this evening —it is assumed the residents
are in agreement with the Petition

Motion: Jay Dorman "To Suspend the Rules of Procedure in order to vote this evening." The motion
was seconded by Woody Rider, approved 9 -0
Motion: Jay Dorman "To approve the Development Plan for Docket No. 10060013 DP Amend/ADLS
Amend Regions Bank, with the final details of ADLS review being worked out at the August P Special
Studies Committee meeting." The motion was seconded by Woody Rider, approved 9 -0.

2 -3. Docket No. 10050022 PP: Village of Mount Carmel, Section 11
The applicant seeks primary plat approval for 4 lots on 5 acres. And, the subdivision control
ordinance waiver requested is:
Docket No. 10050023 SW from SCO Chapter 6.05.01 lot without road frontage
The site is located at 1235 W. 146 St. and is zoned S- 2/Residence. Filed by Keith March.

I. Old Business
1. Docket No. 10040009 DP /ADLS: Turkey Hill Minit Markets
The applicant seeks site plan and design approval for a mixed use building with office,
retail, and fuel station uses. It is located at the northeast corner of Range Line Rd Carmel
Dr. (former Pizza Hut site). The site is zoned B -8 /Business and lies within the Carmel Dr.
Range Line Rd. Overlay. Filed by Steve Fuller of TH Midwest Inc.
Present for Petitioner: Jon Dobosiewicz, Land Use Professional with Nelson Frankenberger; Jim
Shinaver, attorney, Nelson Frankenberger; Steve Fuller, Turkey Hill, and Eric Carter, Project Engineer
for Turkey Hill.
Overview:
Changes made to the building include materials to lighten the appearance and provide additional
contrast on the elevations
Changes have also been made to the parapet profile
Rectangular brick accent elements have been added for additional contrast
Awnings were changed to a lighter color from the red
Changes were made to the light fixtures
The screen wall was removed to make the building the focal element along the Range Line Road
street frontage
The significant adjustments made to the screen wall now incorporate masonry as well as block
and stone cap detail consistent with the building
Wall sign was re- located on the Carmel Drive elevation
The revision includes a reduction in canopy height reduction in width of the columns
Screen wall sign at the corner of the intersection was revised and submitted this evening
The HVAC equipment is totally screened from view
The petitioner is requesting approval with two conditions noted in the Staff Report: Final

Drainage Approval from the Engineering Dept; and working with Kroger for an appropriate
traffic circulation plan— including directional signage. An up -dated site plan will be submitted
to Kroger and revised directional signage given to DOCS Staff
Committee Report, Rick Ripma:
Committee spent a lot of time scrutinizing the exterior of the building, signage, and walls
Parking was discussed as well as design and flow of traffic in the parking lot
End Result of review is a much nicer building than submitted and a nicer view for this important
corner
Committee preference is also for the ground sign
Committee voted 5 -0 to recommend approval

Dept recommends the Commission approve this item subject to the two conditions stated:
Engineering Dept approval, and working with Kroger for safe traffic pattern and signage
Commission Questions Comments:
Heating, A/C Units totally screened from view? (based on elevations provided to DOCS Staff,
rooftop equipment will be completely screened from view on all four sides)
Clarify options for ground signs on southwest corner (Committee approved signage options, but
petitioner must appear before the BZA for number of signs and size)
Note: Petitioner's preference is for a ground sign as illustrated -if supported by BZA, petitioner would
remove the wall sign at the top of the building

2. Docket No. 10040014 OA: Patch Ordinance VIII
The applicant seeks to amend Chapter 3. Definitions; Chapter 23B: US Highway 31
Corridor Overlay Zone; Chapter 23C: US Highway 421– Michigan Road Corridor Overlay
Zone; Chapter 23D: Old Town District Overlay Zone; Chapter 23E. Home Place District
Overlay Zone; Chapter 23F: Carmel Dr. –Range Line Rd. Overlay Zone; Chapter 24:
Development Plan and Architectural Design, Exterior Lighting, Landscaping Signage,
Chapter 25: Additional Use Regulations; Chapter 25.07: Signs; Chapter 27: Additional
Parking Loading Regulations and Chapter 29: Administration of the Carmel Zoning
Ordinance. Filed by Carmel Dept. of Community Services on behalf of the Carmel Plan
Commission.

Committee felt that a new and separate section for food stands was more appropriate as opposed to
lumping them in with other sections or seasonal, temporary uses
Fast Food parking ratios were changed to one space per 80 square feet (currently, the ratio in the
Ordinance is one space for 50 square feet)
The Committee changed the Impact Fee language for Parks Recreation (see page 6) Provision added
provides that the Board of Public Works would act as a second option for issuing credits
Based on committee discussion, nothing is being included in the Amendment regarding signs and
administrative approval
Some issues have been highlighted in blue that will be added to the food stands —food stands being
removed from the premises when not in operation, and customer seating area at food stands is to be
prohibited
With the separation of food stands into a separate category, the food stand does not fall into the category
of 30, 60, or 90 days —for example, food stands such as the "Dogfather" would be an annual permit.

3. Docket No. 10050001 OA: Appendix A Amendment
The applicant seeks to amend Appendix A: Schedule of Uses of the Carmel Zoning
Ordinance. Filed by the Carmel Dept. of Community Services on behalf of the Carmel Plan
Commission.
