I would like to request an investigation on the conduct of Robert Hurst, license
AR00032850, based on his practicing of architecture without having renewed an expired
certificate of registration and for possible unprofessional conduct. If you check your
records, as of the date of this letter, Mr. Hurst's license expired on December 1, 2003. I
have documents that show Mr. Hurst submitted information for the review and approval
of the Indiana Department of Transportation on January 23, 2004. Since Mr. Hurst's
license apparently expired and he was no longer in good standing with the registration
board, I believe he may be in violation of Indiana Code 25- 4- 1- 26(1). I also believe that
he may be in violation of several parts of the Code of Conduct for Architects, Indiana
Administrative Code Title 804.
I will briefly explain the events that have taken place up to this point and it should
clearly show why I am requesting an investigation. In early 2001, Mr. Hurst designed a
project known as Chrysler Realty and was required to submit the project to my office for
review of the site drainage, as part of the local plan commission review process. After
some review comments, the project was granted conditional approval based on the
submitted documents. The project began construction and experienced delays do to
uncontrollable circumstances.
In August of this year, an engineering firm submitted plans to my office for a
parking lot expansion of the same project. These plans revealed a storm water lift station

that was not shown in the original approved plans. Hamilton County's policy, and local
ordinance require, that drainage is by gravity flow and therefore, storm water lift stations
not are allowed. This change to the original approved design was not submitted for
approval to my office or any other local regulatory agency in Hamilton County. It was
submitted to INDOT for approval, as mentioned above, but we believe this was done
after Mr. Hurst's license had expired. My office has recently received plans, from an
outside source, showing the changes, but no revision dates are shown on the plans and
Mr. Hurst's expired seal is still in place on the plans.
I believe Mr. Hurst's conduct may be in violation of your code of conduct. He
submitted plans for regulatory approval but authorized the construction of an alternative
system, without seeking new approval. Mr. Hurst made changes to approved plans and

Dear Mrs. Allen:
I would like to request an investigation on the conduct of Robert Hurst, license
AR00032850, based on his practicing of architecture without having renewed an expired
certificate of registration and for possible unprofessional conduct. If you check your
records, as of the date of this letter, Mr. Hurst's license expired on December 1, 2003. I
have documents that show Mr. Hurst submitted information for the review and approval
of the Indiana Department of Transportation on January 23, 2004. Since Mr. Hurst's
license apparently expired and he was no longer in good standing with the registration
board, I believe he may be in violation of Indiana Code 25 -4 -1- 26(1). I also believe that
he may be in violation of several parts of the Code of Conduct for Architects, Indiana
Administrative Code Title 804.
I will briefly explain the events that have taken place up to this point and it should
clearly show why I am requesting an investigation. In early 2001, Mr. Hurst designed a
project known as Chrysler Realty and was required to submit the project to my office for
review of the site drainage, as part of the local plan commission review process. After
some review comments, the project was granted conditional approval based on the
submitted documents. The project began construction and experienced delays do to
uncontrollable circumstances.
In August of this year, an engineering firm submitted plans to my office for a
parking lot expansion of the same project. These plans revealed a storm water lift station
fl
that was not shown in the original approved plans. Hamilton County's policy, and local
ordinance require, that drainage is by gravity flow and therefore, storm water lift stations
not are allowed. This change to the original approved design was not submitted for
approval to my office or any other local regulatory agency in Hamilton County. It was
submitted to INDOT for approval, as mentioned above, but we believe this was done
after Mr. Hurst's license had expired. My office has recently received plans, from an
outside source, showing the changes, but no revision dates are shown on the plans and
Mr. Hurst's expired seal is still in place on the plans.
I believe Mr. Hurst's conduct may be in violation of your code of conduct. He
submitted plans for regulatory approval but authorized the construction of an alternative
system, without seeking new approval. Mr. Hurst made changes to approved plans and
applied his seal without putting revision dates on the documents. Finally, he continues to
practice a profession even though his professional license is apparently expired.
I ask that you consider this information and conduct an investigation into Mr.
Hurst's conduct. As a professional licensing board, you are expected to apply strict
penalty for such conduct and reassure the citizens of Indiana that the highest standards
are being upheld in this state for the practice of architecture.

The referenced project consists of adding 0.84 -acres of paved parking area to the existing facility once
owned by Chrysler Reality. This site was improved per design plans approved in 2001, however the site
was never occupied: The recent improvements include a building with a showroom, service area and
offices, a parking area for employees, customers and new /used cars, drainage infrastructure including
expansion of an existing pond, a storm water lift station, and landscaping, per the approved plans. The
proposed improvement area conforms to the existing site regarding lighting, landscaping and existing
features as well as current zoning requirements.
At the writing of this letter there is one major drainage issue that has yet to be resolved. Ed Martin
purchased this site from Chrysler with the understanding that it was developed to the drainage standards
set by the Hamilton County Surveyor's Office and that the existing pond was sized to adequately hold
increased stormwater runoff from a parking lot expansion as proposed. A stormwater lift station was
installed by Chrysler to outlet the proposed pond to the highway infrastructure instead of the approved
gravity system. The, lift station was apparently installed because of an error in vertical data supplied to
Chrysler's engineer from the State Highway regarding their infrastructure. The infrastructure does not
allow for gravity flow from the pond to the highway ditch. INDOT will not allow any pavement cutting in
the existing highway to connect to infrastructure within the pavement. The county surveyor does not
allow stormwater lift stations and was not consulted prior to the installation of said lift station. Since Ed
Martin has inherited this unknown drainage problem we have been trying to satisfy the county surveyor's
request to eliminate the lift station. Unfortunately there is still no location to outlet the pond via gravity
method. With the advice of the reviewer from the County Surveyor's Office we have installed an
"emergency" outlet pipe from the pond to the existing infrastructure in 99t Street. This pipe would keep
the pond from flooding the surrounding area should the lift station fail. We are to present this plan to the
Hamilton County Drainage Board on October 25, 2004 for their approval. I have included a copy of the
drainage calculations that -were submitted to the County Surveyor's Office regarding the proposed parking
expansion and the capacity of the existing pond and lift station.
It is our intent to resolve the drainage issue at the October 25, 2004 Drainage Board hearing prior to our
presentation to you on November 4, 2004.

We have reviewed the construction plans submitted to the Hamilton County Surveyor's Office
on August 3, 2004, 2004 for this project and have the following comments:
1. This project does fall in the jurisdiction of Hamilton County.
2. The proposed project DOES NOT fall in a Carmel Well Head Protection Area.
3. The Ha l ilton County Surveyor's O ce WILL NOT grams approval for this
parking lot expansion because the storm water dra' age is through a lift station.
The HCSO is charged with overseeing drainage in unincorporated parts of
Hamilton County and this office DOES NOT allow storm water lift stations to be
installed. This 1 station was never show, l on the original construction pilaus for
the Chrysler Realty aiding and was ever presented to our office for review.
4. Please note that further comments may be necessary at a later date.
