HomeMy WebLinkAboutCorrespondenceAs a result of the objections presented by our neighbor and owner of the West Carmel Market Place Shopping Center at the Public Hearing of this petition, and subsequent e mails we are convinced that our neighbor will attempt to oppose the extension or extract a substantialto Cons 1 a f a,% As requested at the Special Studies Committee we are respectfully asking the Plan Commission to exercise its legal rights under Carmel Zoning Ordinance 23C Us 421 Michigan Rd Corridor Overlay Zone to provide for the unobstructed and uncompensated extension of Walnut Creek Drive (-cc 61 II-I& 2 010 Conn, Angelina V From G WILLIAM ARMSTRONG [armdev @sbcglobal net] Sent Thursday November 04 2010 10 07 AM To Hollibaugh Mike P John Molitor Cc Conn Angelina V Brian Cross SGlazier @cgglawfirm com Rider Kevin D Dierckman Leo J Subject Walnut Creek Drive Extension Mike /John Thank you for your continuing efforts to assist us in the extension of Walnut Creek Drive through your support of our petition before the Special Studies Committee You are aware of my concerns that Casto will oppose the petition for the single purpose of extracting unwarranted benefits for West Carmel Marketplace Their objective as made known to us is to obtain a sizeable financial payoff as well as restrictions on uses for our real estate which correspond to self imposed restrictions on their Center to which they readily agreed when they purchased the property from Duke The combination of these two objectives if achieved will he devastating to our real estate and the Chantable Trust that owns a majonty of it I have concluded that the Plan Commission in Section 23C of the Overlay Zone Ordinance has the discretionay power to require the extension of the frontage road without obstruction However as a result of the discussion at the Special Studies Committee meeting I sense that there may not be total conviction of this conclusion And while I am pleased that the Committee will recommend Plan Commission approval I am not not sure that simple approval of the plan will allow unobstructed connection to Walnut Creek Dnve You are planning an Executive Session to further discuss avenues to resolve this issue I have no knowledge of who constitutes or what subjects the Session may consider However if the City leaves this issue up to me and Casto to resolve we will be seriously damaged through extraordinary unjust costs and restricted uses of our real estate or lack of access to a frontage road to which the laws of the City can require and we should have had To avoid this outcome I am willing to consider any reasonable avenue including dedicating my share of Walnut Creek Drive to the City of Carmel I look forward to the City's approval of our plan and the just resolution of our request for unnobstucted access to the frontage road Thank you G William Armstrong P S When appropriate can you share with me the results of the Exacutive Session meetings? coming from Mr Visco based on his message of Tuesday evening He probably will notify Mr Armstrong that they (Casto) will view it as a civil trespass if Armstrong or his workers even accidentally set foot on the Casto side of the property line They may also warn the City that they will view the City as unlawfully interfering with their property rights if we continue to attempt to authorize Armstrong to proceed My assumption is that Casto will hold out for some sort of payment from Armstrong to obtain an access easement which would allow his tenants and customers to use Casto s frontage road and other driveways In any event my advice is that we should share Casto s notice letter with the City Attorney and consult with him before we take any further steps regarding this controversy of Walnut Creek Drive which exists in front of Home Depot and behind Burger King has not been fully extended to the south property line of the West Carmel Marketplace development The intent of the Carmel Plan Commission s approval of the development plan for West Carmel Marketplace was to have a street stub to which the next developer could connect thus allowing for vehicular access to /from 98 Street for internal circulation within the developments and to ease the traffic congestion along Michigan Road That said the City will authorize Mr Bill Armstrong the land owner of the parcels dust south of and adjacent to West Carmel Marketplace to extend the common roadway south so that there are no gaps in pavement between your portion of Walnut Creek Drive and his Mr Armstrong plans to move forward with redevelopment of his land which includes extending Walnut Creek Drive south to 98 Street A proposal to revise his already approved development plan from 2007 was submitted to our Department on August 20 2010 which is the filing deadline for Plan Commission applications He is slated to appear before the Plan Commission for a public hearing on October 19 2010 and all adjacent
