HomeMy WebLinkAboutExecutive Order JB-2010-6 CITY OF CARMEL EXECUTIVE ORDER J B- 2010 -6 WHEREAS, the City of Carmel Ethics Ordinance, codified as City Code Section 2 -184 "Ordinance establishes a code of ethics for City officers, officials, and employees; and WHEREAS, the Ordinance creates an ethics board "Ethics Board describes standards of ethical conduct, and requires the submission of an annual statement of economic interest "Statement by all City officers, officials, and employees to the Ethics Board; and WHEREAS, the Ordinance is silent as to administrative procedures to be followed regarding the submission of the required Statement to the Ethics Board; and WHEREAS, the establishment of such administrative procedures are necessary in order to provide for the proper administration of the Ordinance. NOW, THEREFORE, by virtue of the power and authority granted to me as Mayor of the City of Carmel, Indiana, James Brainard, do hereby declare and order the following administrative procedures to be followed for the submission of Statements to the Ethics Board, effective on January 1, 2011: 1. The Office of the Carmel City Attorney shall, no later than February 1 of each calendar year, provide to all City officials, officers, and employees (except for Carmel /Clay Parks Recreation), by electronic means to the extent possible, and otherwise by U.S. Mail, a blank Statement, with instructions for the completion of same and the submission of same to the City Human Resources Director. Al! questions regarding the Statement shall be addressed to the Office of the City Attorney. By February 1 of each calendar year, the City Attorney shall provide to the Director of Human Resources a list of the names of those City officers, officials, and employees who have been sent a Statement that year. Department Directors are responsible for ensuring that each of their employees has access to either the electronic version or a hard copy of the Statement. 2. The City Human Resources Director and all other City Directors shall instruct any person who has a question about the completion or submission of the Statement to contact the Carmel City Attorney. 3. Each City officer, official, and employee shall fully complete and turn in a Statement to the Department of Human Resources no later than February 15 of the year in which it is received. Each statement shall be individually submitted in a sealed envelope with the name of the person whose Statement is enclosed early written in ink on the face of the envelope. Any envelope that does not have a name clearly visible thereon will be opened by the Human Resources Director to determine its contents. The Department of Human Resources shall date stamp all such envelopes and track the names of those persons who have submitted the same on the list of City officers, officials, and employees provided by the City Attorney. 4. By March 1st of each calendar year, the Department of Human Resources shall forward to the secretary of the Ethics Commission all of the envelopes that have been received by that Department that year, as well as a list indicating which City officers, officials, and employees have not submitted a Statement that year. 5. The Ethics Commission shall coordinate with the City Attorney regarding any actions deemed appropriate regarding any failure of a City officer, official, or employee to timely submit a Statement as required by the Ordinance and this Order. 6. The Ethics Commission shall be provided staffing assistance as needed by the Department of Law to fulfill its obligations under the Ordinance.
