AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
REGARDING THE STRUCTURE OF FUNDS FOR THE
CARMEL -CLAY PARKS AND RECREATION BOARD
WHEREAS, the City of Carmel, Indiana "City and Clay Township of Hamilton County,
Indiana "Township entered into a certain Interlocal Cooperation Agreement "Interlocal Agreement
dated July 26, 2002, to provide joint park and recreational services to the City and the Township; and
WHEREAS, the Interlocal Agreement, as the same has been subsequently amended from time to
time, remains in full force and effect as of the date of this Ordinance; and
WHEREAS, pursuant to the terms of the Interlocal Agreement, a Carmel /Clay Board of Parks
and Recreation "Parks Board was created to administer the park and recreational services provided to
the City and the Township, which Parks Board remains duly formed and operating as of the date of this
Ordinance; and
WHEREAS, pursuant to Ordinance No. D -161 1 -02, the office of the Carmel Clerk- Treasurer has
administered the Non- reverting Parks and Recreation Operating Fund, Fund 104 (the "Fund for the
Parks Board; and
WHEREAS, in an effort to more efficiently administer the Parks Board funds, the Council desires
to replace the existing Fund with two funds: the Extended School Enrichment Fund, #108 (the "ESE
Fund and the Monon Center Operating Fund, 109 (the "Monon Operating Fund and
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1. The foregoing Recitals are fully incorporated herein by this reference.
Section 2. Carmel City Code Chapter 2, Article 4, Section 2 -121 is hereby amended to read as
follows:
2 -121 Parks and Recreation Nonreverting Monon Center Operating Fund (Fund 109).
(a) The City, pursuant to the request of the Carmel /Clay Parks and Recreation Board "Park Board
hereby establishes a Nonreverting Parks And Recreation Monon Center Operating Fund "Monon Center
Operating Fund for the purpose of accounting for operating receipts and disbursements, revenues and

other monies received or made for park purposes in connection with the City and Clay Township's
jointprovision of recreation programs and facilities at the Carmel /Clay Board of Parks and Recreation
Monon Center (the "Monon Center The monies in the Monon Center Operating Fund shall be used for
general maintenance, for the acquisition, repair and /or replacement of capital improvements, for
equipment, for other property, goods and services necessary to the operation of the Monon Center, and as
otherwise permitted by law. The Monon Center Operating Fund shall be administered and maintained by
the Fiscal Officer of the City as hereinafter set forth:
(1) The funds contained in the Monon Center Operating Fund shall be received and deposited
therein from the City, from Clay Township, and from all other lawful sources, in accordance with applicable
law; and
(2) The funds contained in the Monon Center Operating Fund shall be accounted for and
maintained separate and apart from all other City funds, and shall be invested with the interest earned
thereon deposited into the Monon Center Operating Fund; and
(3) The funds held and accounted for in the Monon Center Operating Fund shall be withdrawn only
for the purpose of maintaining, improving and /or operating the Monon Center.
(4) All property acquired from funds held in the Monon Center Operating Fund shall be titled in the
name of the Park Board; and
(b) The life of the Monon Center Operating Fund shall be perpetual, unless terminated by subsequent
ordinance duly enacted by the City's legislative body."
Section 3. The Council hereby Resolves that the Non reverting Parks and Recreation Operating
Fund, Fund #104, is hereby dissolved, and any remaining funds transferred to the Monon Center Fund,
#109.
Section 4. Chapter 2, Article 4, of the Carmel City Code is hereby amended to add a new Section
136 which shall read as follows:
2 -136 Parks and Recreation Extended School Enrichment Fund (Fund 108).
(a) The City, pursuant to the request of the Carmel /Clay Board of Parks and Recreation "Park
Board hereby establishes a Nonreverting Parks And Recreation Extended School Enrichment Fund
"ESE Fund for the purpose of accounting for operating receipts and disbursements, revenues and other
monies received or made for park purposes in connection with the City and Clay Township's joint provision
of recreation programs and facilities within the Carmel -Clay School District (the "ESE Activities The
monies in the ESE Fund shall be used for general maintenance, for the acquisition, repair and /or
replacement of capital improvements, for equipment, for other property, goods and services necessary to
the operation of the ESE Activities, and as otherwise permitted by law. The ESE Fund shall be
administered and maintained by the Fiscal Officer of the City as hereinafter set forth:
(1) The funds contained in the ESE Fund shall be received and deposited therein from the City,
from Clay Township, and from all other lawful sources, in accordance with applicable law; and

(2) The funds contained in the ESE Fund shall be accounted for and maintained separate and
apart from all other City funds, and shall be invested with the interest earned thereon deposited into the
ESE Fund; and
(3) The funds held and accounted for in the ESE Fund shall be withdrawn only for the purpose of
maintaining, administering, improving and/or operating the ESE Activities.
(4) All property acquired from funds held in the ESE Fund shall be titled in the name of the Park
Board; and
(b) The life of the ESE Fund shall be perpetual, unless terminated by subsequent ordinance duly
enacted by the City's legislative body."
Section 5. All other obligations and requirements set forward in prior Ordinances and Resolutions
are hereby incorporated by reference, and shall continue in full force and effect.
Section 6. This Ordinance shall become effective on and after the date and time it is properly
approved and signed by a majority of the members of the Carmel Common Council.
SO ADOPTED by the Common Council of the City of Carmel, Indiana, this day of
2010, by a vote of lQ ayes and 6 nays.
