We will take care of the ROW permit with Engineering before submitting
the building permit. We heeded the advice Gary Duncan provided in
December and have located the tennis court in the flat portion of the
back yard outside of any easements.

If it is a private tennis court that the homeowner would use for
personal use, there would not be a zoning issue, as long as it is
located within a side or rear yard and not in a front yard. Also, the
tennis court can have a maximum 16-ft tall open wire mesh fence to
enclose the tennis court area and standard apron areas. This is per
zoning ordinance section 25.01.01.C.6.
Also, the land owner should check if there's recorded neighborhood
declaration of covenants and restrictions to make sure that the
homeowners association (if there is one) would not need to
review/approve the plans, too. (But that is a private matter between the
land owner and the neighborhood residents.)

I just talked to Jim and we are OK with taking in a building permit
application.
However, the tennis court that is planned for this parcel would be
through engineering, not our department. They would need to approve
construction entrances, etc. through their right-of-way permit process.
When we take in building permit applications, we require either an
approved right-of-way permit, or a signature on our application from
engineering that a ROW permit is not required. Either way, this would
need to be taken care of before the application is submitted to our
office.
Also as far as a tennis court on this parcel, this isn't an issue with
the zoning for this property, right?

Bryan - Yes, this is very reasonable to us. And thank you for explaining
the situation and putting it in writing, so that all parties involved
understand what is needed.

Angie,
I wanted to follow up with you on our phone conversation this morning.
After talking with Nick Mishler, our builders and the surveyors, I think
I can clarify the approvals we are seeking from the City and how to
overcome the chicken-and-egg issue regarding the building permit.
To briefly summarize the situation, the Baileys own Lot 12. They would
like to purchase Lot 13 to construct a carriage house and a tennis
court. These are accessory uses to the primary dwelling on Lots 12,
therefore to legally establish them on Lot 13 requires combining the two
lots into one through the replat process. Before purchasing Lot 13 the
Baileys want to know that they will be able to build the desired
carriage house and tennis court on the property. To that end, the
purchase agreement for the lot requires that we secure the building
permit before the Baileys purchase the lot.
Here is my proposal for securing the required approvals and protecting
all the parties involved.
1. The replat has been filed. The surveyors are making some
changes as directed by the City and will have the revised replat back to
the City by the end of the week. The replat will be addressed at the
Board of Public Works meeting on 01-19-11.
2. On 01-05-11, LoMac Construction LLC (the Estridge Custom
Company) will file the building permit for the carriage house and tennis
court on Lot 13.
3. City of Carmel reviews and approves the building permit;
estimated approval by 01-12-11. If necessary, the building permit can
be issued with the Certificate of Occupancy contingent upon the
recordation of the replat.
4. With the permit approval granted by the City, the Baileys can
now purchase Lot 13; estimated closing on or before 01-18-11.
5. On 01-19-11 the Board of Public Works reviews and approves the
replat combining the two lots.
6. On 01-21-11 the replat will be available for recording. LoMac
will record the replat.
7. With the replat recorded, the certificate of occupancy can be
granted as usual when construction is complete.
The above approval schedule protects the City of Carmel, the Baileys,
and Estridge. If this seems reasonable to you, please let me know and
we can proceed with our building permit submittal. Let me know if you
have any questions about this matter.
