RESPONSE LETTER
On November 1, 2010, the consulting engineering firm of Keeler -Webb
Associates was retained by Mr. Lowell Rolsky, with Pro Care Horticultural
Services, to conduct a surveying investigation to determine if parking on the
property known as Pro Care Horticultural Services, located at 9801 North
Augusta Drive, Carmel, IN, lies within the bounds of the property.
This investigation was performed due to a Zoning Code Violation letter from
the City of Carmel, dated August 19, 2010. This letter was issued based
on; inaccurate parcel boundaries shown on the City of Carmel GIS
mapping, which showed the southern gravel employee parking lot lying
over the southern property line. Our review of the GIS mapping determined
that there is a distance error of 20 feet in the overall North -South distance
of the Pro Care property line dimension.
Keeler -Webb Associates issued an ALTA/ACSM Land Title Survey of the
subject property, last revised on October 19, 1998. On November 3, 2010,
an on -site inspection was performed and it was determined that the
properties substantially match the conditions reflected in the survey.
Additionally, we obtained and Aerial Photo of the subject property, provided
by the City of Carmel, GIS mapping, dated 2009. This aerial photo closely
represents the current condition of property.
On November 8, 2010, a meeting was held at Carmel DOCS with DOCS
staff, the owner, and land surveyor present. All of the above evidence was
reviewed with staff at that time, and it was determined that there is no
zoning code violation.
Based upon the data collected, along with observations made at the time of
our inspection and analysis, it is our surveying opinion that the southern
gravel employee parking lot lies entirely within the bounds of the subject
real estate. Furthermore, the North -South dimensions of the properties
along the East side of North Augusta Drive (per the City of Carmel GIS
parcel dimensions) do not match the deed distances.
The opinions stated in this report are based upon the physical conditions
present at the time of our inspection and the ALTA/ACSM Land Title
Survey of the subject real estate.
Unless additional detail, assistance, or other land surveying effort is
requested, this investigation is considered to be complete as per the scope
of land surveying work required and no further professional support will be
provided.

Dear Mr. Mrs. Rolsky
This letter is being provided to inform you that the parking of vehicles in the gravel lot at
9661 Augusta Drive North, is prohibited as per Carmel Zoning Ordinance, which states:
27.02.04 Parking spaces may be located on any part of a lot, unless otherwise
specified herein. Parking spaces shall not be located in any required
greenbelt or lawn area.
27.02.01 Off street parking spaces may be located on an area within three hundred
(300) feet of said building and two or more owners of buildings may join together
in providing the required parking spaces. Where the required parking spaces are
not located on the same lot with the building or use served, the usage of the lot
or tract upon which said parking spaces are provided shall be restricted by an
instrument of record describing the premises for which said parking is
provided and assuring the retention of such parking so long as required by
this Ordinance.
To avoid further enforcement action, please permanently discontinue parking vehicles on the
unpaved site to the south, or provide the Department of Community Services with an
updated site plan and instrument of record indicating permission to park on this site. If you

Lowell Rolsky of Pro Care, 9801 North August Road, appeared before the Board seeking
approval for a Use Variance for a storage facility. The time for the approval granted at
the BZA meeting in January, 1998 has now expired.
The building is an architectural steel, pole barn building utilized for materials and
equipment storage. All other aspects of the Use Variance have been completed: this is
the only facet uncompleted.

Petitioner seeks approval to construct a private recreation facility in an S -1
residential district. The site is located at the intersection of Hazel Glen and West
Lake Boulevard.

Charlie Frankenberger, attorney with Nelson and Frankenberger, 3021 East 98 Street,
Indianapolis, appeared before the Board on behalf of Zaring Homes. The applicant is
seeking approval to construct a swimming pool and amenity area in a residential
community known as the Lakes at Hazeldell.
Also present on behalf of Zaring Homes were Robert Krohngold and David George.
At the initial hearing, Zaring was requested to change the dimensions of its pool and to
agree that a lifeguard would be present at all time the pool is open. Zaring is willing to
comply with both conditions but asks for the following consideration'
The problem with the reconfiguration of the pool is two -fold. The petitioner has already
obtained from the State the permit for the original design. If reconfigured, the process
would take an additional twelve weeks and out of the current construction season. In
addition, Zaring has stated that they have designed a pool more for family and
recreational purposes than competitive swimming: more for lounging than laps In light
of the hardship of waiting until next year's construction season, the applicant is asking the
Board to reconsider their requirement.
In regard to pool safety, in a pool of this size. the State has decided to remain silent and
does not require a lifeguard. The Zoning Ordinance does not specifically address the
issue. This is deemed to be a private matter. Residents would want the flexibility of
enjoying the pool at will and not contingent upon the presence of a lifeguard. There are
liability concerns and also concerns about how this requirement can consistently be
applied to future pools. In short, the question is whether or not this is an area that we
want to regulate. Based on the foregoing, the petitioner is asking that the Board
reconsider its requirement of the presence of a lifeguard during pool hours.

The regular meeting of the Board of Zoning Appeals was opened at 7230 P.M.
by the Board attorney, Ray Adler, January 28, 1980 in City Hall.
New Board of Zoning Appeals members Dr. Richard Dowell, Terry Litvan,
Rev. Warren Saunders, Carl Geltz and Donna Skeens were sworn in by Mayor
Reiman. Mr. Jerry York was sworn in by Hamilton County Circuit Court Judge
Richard De Tar.
Election of a chairman and vice chairman followed.
Dr. Dowell nominated Jerry York for Chairman. Seconded by Mrs. Litvan.
Rev. Saunders moved the nominations be closed. Seconded by Mr. Geltz.
Mr. York was elected chairman and took over from Mr. Adler.
Rev. Saunders nominated Mrs. Litvan for vice chairman. Seconded by Mrs.
Skeens.
Rev. Saunders moved the nominations be closed. Seconded by Mr. Geltz.

Roll was called and members present weret Dr. Richard Dowell, Terry

There were no additions or corrections to those minutes and Mrs. Litvan

by the petitioner.

The Public Hearing opened at 8:03. Mr. Rolsky made the presentation
showing the plans for a nursery and green house. There will be 6 parking
lanes inside a fenced area which will be screened with landscaping.
No remonstrators were present and the Public Hearing closed at 8 :06.
Mr. Anderson commented regarding drainage and required set back stating
that they are waiting for the report from the Dept. of Natural Resources.
Mrs. McCart read the Technical Advisory Committee report, the Industrial
and Commercial Committee report and the December Plan Commission minutes
pertaining to this petition.
Mr. York questioned the parking.
Mr. Rolsky said there will be 6 parking spaces and only 3 are required
by the ordinance.
Mr. Rolsky said the pole barn is 40 ft. by 72 ft. and the greenhouse is
24 ft. by 42 ft.
Miss Chapman, city planner, said they need to know the level of the
100 year flood.
Mr. Rolsky said it will take 2 to 3 weeks for the report to come and
requested approval subject to receiving the required report from the State.
Mr. Rolsky stated that there will be no retail business here.
Mrs. Litvan moved that BA 1 -80 be approved subject to receiving the
report requested. Seconded by Dr. Dowell.
The vote was unanimous for approval.

It has been brought to my attention by neighbor complaint and my inspector's report
that you have several violations not permitted for the use of this land as approved.
1. The first complaint is a trailer being used for general nursery storage. Only
construction trailers are permitted to be used while construction is in progress
to facilitate telephone, plans and construction tools or instruments.
2. Storage shed constructed near or on fence. This is not in the original plans
approved and no variance or permit has been granted for this.
3. Trash and open garbage are being dumped on the property. This also violates
the Indiana Board of Health rules, as well as our ordinance, as this debris will
draw rats and other rodents. This type of use is not in the original plans
approved.
This letter is to advise you that immediate compliance and corrections be made to
your property. I would also advise that no future uses be considered without permits
and to comply with the original approval of use of your land.
A copy of this letter is being filed with the Board of Zoning Appeals this day, July
28, 1980, and the original handed to you, if present, or will be mailed by registered
mail if you are not present.

Mort Rolsky and Mitch Rolsky were present. Mort Rolsky stated that it
was called to his attention that two of the adjoining property owners did
not receive notice for last January's Public Hearing. Mr. Rolsky said that
that was not his fault but an error in the County Clerk's office.
Warren Pettitt, W. 97th St., stated that on New Augusta Rd. only one
house was notified and three should have been and they were not aware of the
Public Hearing.
Mr. Adler said if the people feel aggrieved they may appeal to the Circuit
Court within 30 days of the meeting of the BZA.
Mr. York related that the Board has no jurisdiction in this matter.
Joe Hoover, W. 97th St., stated that they want assistance and that they
wish to present their side.
Mr. York asked if they have had advise of counsel and stated that the
Board cannot at this time do anything and that the court is the place they
should go.
Jim Doom, adjoining property owner, questioned what recourse they have
if Mr. Rolsky does not remove the trailer when he is through and if he does
not keep his word.
Remonstrators complained of the trailer, trash and garbage on the property
Mr. Anderson submitted a letter to Mr. Rolsky, with a copy for the record
(which is a part of the official minutes and attached to the master copy).
Mr. Anderson read the letter which cited violations by Mr. Rolsky that
were called to his attention. Mr. Anderson said that immediate compliance
and corrections are to be made to the property.
Mr. Anderson said he will meet with Mr. Rolsky to work out these points
of violation.
Mr. York stated that the remonstrators will have to go to the Circuit
Court regarding the notice error for the January BZA Public Hearing.
2g. Rules and Procedures
The Board members are to review the 1958 rules and those of 1977 and
determine some standards.
The Board will meet next month at 7:00 P.M. and no Public Hearings are
to be scheduled until 7 :45 P.M. in order that the rules and procedures can
be reviewed.
There being no further business to come before the Board, the meeting
adjourned.

Please let me know if you have difficulty accessing the links below. They are from my Facebook
page but unrestricted in terms of access.
The video was shot from my back yard a few weeks ago of the equipment operated at ProCare
landscaping company on N. Augusta. Can anything be done or am I stuck since they were in
operation before our neighborhood was built? This is the owner's claim but I am hopeful in the spirit
of Carmel businesses being good neighbors that something can be done to improve the quality of life
for those of use close by. I know this would never have happened if we were in Carmel from the get
go but sadly we were not well goverened before the annexation. Thanks for all of your help so far,

recent welcome letter you sent and to express my excitement and anticipation of 'officially'
becoming part of the great community of Carmel Indiana
One opportunity that I hope this transition provides for me personally is some type of
relief /resolution to the situation I experience as a neighbor of the ProCare landscaping
business http:// www. procarelandscapers .com /index.asp that admitedly has existed long
before our neighborhood was built.
While seemingly tolerant 6 -7 years ago, the noise situation has grown increasingly worse. The
owner, Lowell Rolsky, and I have failed at attempts to resolve the matter. Unfortunately,
another neighbor and I have sadly resorted to calling Hamilton County Sheriff's department
when after 8:30 p.m. on a Sunday night the power equipment was still being run. We would
like to resolve this amicably.
The city of Carmel 's encouragement of this company to be a less conspicuous neighbor would
be most welcome. Installing fence, trees, etc. would be appropriate and welcome (and
feasible given this IS a landscaping company!).
Attached is a photo shot from my back yard. The video clips I have are too large so I will send
a link separately.

The letter for Pro Care is going out today, citing them for not parking on their site, or at least not providing us with an
instrument of record that says they can park there. The question is, should the neighbors to the south get a letter as
well, since their property is being illegally parked on? I've combed through all the files, and it doesn't seem as though
anyone was /is aware that Pro Care is encroaching. All of their site plans show the lot on their site, but our GIS and
County GIS aerials show them encroaching for at least the last ten years. So who's the lucky landowner who gets the
citation filed on their property?

This is their first notification. Darren and I have been following up on complaints from a neighbor about noise, dust, etc,
but because their original approvals were essentially blanket approvals with no commitments, and because they seem to
be aware of the noise ordinance, this is the only thing we can get them on.

Subject: Pro Care
I've drafted a letter for Pro Care, citing them for parking on the required lawn of the site next door, and not
having an instrument of record for parking on the adjacent lot. It's a gravel lot, which is also a no -no, but do
you think we should get the legality of the lot squared away before they make it permanent? Any
suggestions /additions?

Mr. Hollibaugh,
My name is Charles Spray and I live on West 97th St, and have for about the past seven years. In those seven
years this area has been severely wrecked by a couple of investors who have bought homes either and use them
for commercial business, or just let them sit and fall apart. I'm in a situation where I own a nice home, but the
area has become very trashy and unsafe, but my options for selling are limited. Right now, I cannot sell my home
as a residential property since no decent human being would want to live around here, and I can't sell it
commercially either as things have really slowed down in the area the past couple of years.
I was wondering if you could give me an idea of what you expect to happen in this area during the next year so
that I might have an idea of what I need to do.
