The site is located at 10560 N. Michigan Rd. and is zoned I -1 /Industrial within the Michigan Rd/US 421 Overlay Zone. Filed by Jeff Kauerz for AutoZone Stores, Inc. Docket No. 10110007 CA: Lincolnshire Commitment Amendment (formerly called Murphy Hall). The applicant seeks plan commission approval to amend the recorded commitments relating to the subdivision plat. The subdivision is located at the northwest corner of 141st St. and Towne Rd. and is zoned S -1 /Residence ROSO. Filed by Bryan Stumpf of The Estridge Companies. Present for the Petitioner: Bryan Stumpf, Estridge Companies, Mark Webber, Estridge Development, Companies; Tim McMahon, Fischer Homes. Overview: Two changes proposed Consists of 82 lots, Currently 34 are still available Community is half finished after 5 years Introducing new home designs bringing in additional builder necessitates commitment amendments Current commitment states all homes constructed in the Subdivision shall be The Estridge Companies 700 series homes with an average of 2,800 square feet with a basement Proposed change would read: "Substantially similar to The Estridge Companies 700 Series homes" Second change in commitment addresses front facade and materials used Proposed commitment change identifies materials for use —fiber cement board, stucco, cultured stone, or a mixture thereof Average in the commitments, 2800 sq ft—minimum ranch 2400 sq ft, minimum two -story 2600 sq ft After all 18 lots constructed, petitioner is committing to not be below minimum average of 2800 sq ft (excluding existing homes) Motion to suspend the Rules of Procedure in order to vote this evening: Jay Dorman, seconded by Woody Rider, approved 8 -0 Preliminary Motion, Jay Dorman: To approve Docket No. 10110007 CA, Lincolnshire Commitment Amendment, formerly called Murphy Hall, with the latest renderings that include the side -load garages and the latest commitments presented this evening, and a third commitment, all of which will be recorded, that in the event the current developer, Estridge, who has agreed to cover any HOA deficit, should cease to exist, or his successor company does not step up to cover those HOA deficits, then Fischer Homes will cover those said HOA deficits until full takeover by the local HOA group; seconded by Sue Westermeier. Fischer Homes was agreeable to paying HOA deficits on their lots only, not the entire development. Mark Webber, Estridge Development Companies—comments: Recently completed restructure for land loan for Lincolnshire Bank loan secures the future of the community by paying for future maintenance as well as subsidy Financial situation is one of the reasons Fischer Homes being brought into neighborhood To ask Fischer Homes to commit further does not seem appropriate Bank controls the funds; a set amount goes each month to take care of the subsidy as well as maintenance and any capital expenditures Scott Paderack, 2565 Telemere Court. Lincolnshire is very much concerned about the size of the homes and how it will be managed to the 2800 square foot average. Lincolnshire understands that Fischer does not build a larger ranch and we can live with four ranches at 2400 square feet, but the thought process is that the rest of the homes should be at a minimum versus coming to an average, given that that would reflect the current, over 3100 square foot homes in the development. If you look at 2800 square feet as a minim for everything but those four ranches —that would fall into most of the designs that Fischer has shown to us only just today. The thought process is that it departs that uncertainty around —are they at 2800 average or not? It is very clear, they are 2800, it meets most of the designs of Fischer, and makes the problem go awaya lot of homeowners would be more appreciative of that than having this average thing standing out there. Tim McMahon, Comments: Critical to add a new dimension to the community Sales have been slow -five sold in this fiscal year Estridge is creating a floor -2600 square feet Estridge currently has a home in their collection at 2700 square feet allows a break in price point Need is to drive sales Critical to get a significant scale in community for both Estridge and Fischer to be successful Tim McMahon was willing to make a commitment that Fischer Homes would build an average of 2800 square foot homes on the 18 lots that Fischer will develop. Clarification: The minimum ranch home would be 2400 square feet; the minimum two -story home would be 2600 square feet; upon completion of building on the 18 lots, the minimum average will not be below the 2800 square feet minimum in the PUD today (excluding the existing homes.) Motion: Jay Dorman to approve Docket No. 10110007 CA, Lincolnshire Commitment Amendment (formerly called Murphy Hall) with commitments as follows: 1) The newest rendering showing the side load garages will be incorporated 2) On newly constructed Fischer homes, the average square footage of the newly constructed 18 homes will be 2800 square feet on average; 3) The latest representation of the commitments are to be incorporated into the proposal; and 4) Should Estridge, its successors or assigns fail to cover the deficit on the HOA, Fischer Homes will pay the dues on their lots that Fischer owns. Bryan Stumpf was concerned regarding a requirement to create new renderings of their plans, since Fischer only has a front load garage design; the side -load garage is an option. A note could be incorporated on each of the renderings that a side -load garage is included Agreed I. Old Business: None J. New Business: None K.
