The Special Use approval "Use Approval conditionally granted to O'Brien, for the construction of an automobile dealership under Docket No. SU- 54 -00, will technically expire on June 26, 2001. On behalf of our client, we respectfully request that the Director of the Department of Community Services extend the Use Approval for a period of six months pursuant to Section 21.2.7 of the Carmel /Clay Zoning Ordinance. As you know from the record on this matter, although the Use Approval was granted on June 26, 2000, the Use Approval was subject to the review and approval of the site plan and building design by the Plan Commission. Therefore, the Use Approval was not legally effective until several months later following the Plan Commission's review and approval. This has prevented O'Brien from proceeding with construction within the one year following the date that the conditional Use Approval was granted. This extension will preserve the Use Approval until December 26, 2001, pending the Board's consideration of the Special Use Amendment application and allow O'Brien to either construct the building in accordance with the plans approved pursuant to the proposed Special Use Amendment or in accordance the Use Approval and prior Plan Commission approval. Bridge. If and when the Parks Department obtains funding, either to widen the bridge or ar extend the bridge, the owner will contribute the sum of $15,000.00 and also install tit 6 1 foot pedestrian path. 2_ Parking inin l The owner will commit that•(i) the parking spaces in the floodway will be eliminated, (ii) no inventory or customer parking will occur within the area of the surface that extends into the floodway, and (iii) other than to the extent shown on the site plan submitted in connection with this request, no asphalt or other improvements will extend into the floodway_ Regarding this, please note that (i) the proposal addresses the concern of vehicles parked in the floodway and (ii) to the north of the northern boundary of the Tom. Carmel Creek is not currently classified as a County Regulated Dram_ Therefore, no permits are required from this office for activities along the creek, 2. It appears that a large portion of the ffloodway will be affected by this project. Has IDNR granted approval for the loss of this flood storage area`? We offer the following comments: 1. This project is within the City of Carmel Sanitary Sewer service area and the Indianapolis Water Company water service area. All other infrastructure issues are within City of Carmel jurisdiction with the exception of the Carmel Creek, which is a regulated floodway. 2. Board of Public Works and Safety Approvals Required Commercial Curb Cut Board approval is required for the 96 Street Curb Cut. Requests for approval must be accompanied by an 8 1 /2 x 11 -inch reproducible drawing of the request cut and location. Submitted drawings should indicate the location of all- opposing driveways and appropriate distances including driveway width, radius, and distance from nearby intersections. Please refer to Item #4, below. Sanitary Sewer Availability- This calculation will be based upon the type of business or proposed use of the development. Reference Item #3 regarding Connection and Availability Fees. Secondary Plat Approval If this is to be a platted development, the plat will require Board approval. All required Performance Guarantees must be posted prior to Board approval. Additionally, the plat must be recorded as a requirement for a building permit. 3. Sanitary Sewer Connection and Availability (acreage) Fees Connection Fees- I am enclosing copies of the Average User Factors from our Utility Ordinance regarding sanitary sewers. If the appropriate application is not listed in the table, this usage and connection will be negotiated with Cannel Utilities and the Board. The Sanitary Sewer Connection Fee is $795.00 per 1.0 EDU. Availability (acreage) Fees This fee is based upon total platted acreage $1,365.00 per acre. 4. The entrance to this development needs to be aligned with the drive on the south side of 96 Street. Opposing left turns should align. Also, the driveway width as indicated on the drawing is excessive. This office would be agreeable to 18 foot back to back entrance lane, a 10 foot median and 22 feet back to back exit lane for a maximum width of 50 feet. 5. Pavement sections within the right -of -way of 96` Street must match the 96 Street pavement section. 6. Please provide this office with a set of drainage calculations. Include with these calculations, hydrograph study or report to justify the elimination of onsite detention. 7. Resubmit a copy of the DNR Permit for the modified floodway. 8. What is the drainage plan for parking areas? Are curb turnouts planned? We do not see evidence of the turnouts on the plans nor do we see erosion control and protection for the turnouts, if so. Direct discharge from parking areas will have to be included in the drainage analysis and calculations. 9. It appears a portion of the parking area is to be constructed in the floodway. We do not believe this is allowed. Please confirm that it is acceptable to conditions of the DNR Permit. Curbs Sanitary Sewers Storm Sewers if the street is dedicated. Monuments Sidewalk or Asphalt Path requirements. These requirements would include Certified Engineer's Cost Estimates for the Performance Guarantees and three -year Maintenance Guarantees when the Performance has been released. 11. If the street that is indicated into this development is to be a dedicated street, we will have additional comments regarding pavement sections, widths, markings, etc. 12. I am enclosing miscellaneous data regarding requirements that may apply to this development. It is your responsibility to share this information with developers/owners and/or contractors to be involved with this project. 13. Any lane closures associated with this construction must be coordinated with this office. In addition, proper advance signage will need to be utilized if lane closures will occur (i.e. lane closed ahead, merge left, etc.). We request maintenance of traffic plan, if applicable. 14.
