SUBDIVISION COMMITTEE MINUTES

The Subdivision Committee considered the following items:
1. Docket No. 10110001 OA: R -4 District Setback Amendment
The applicant seeks to amend the Zoning Ordinance, Chapter 10: R -4 Residence District and Chapter 23 A: State
Highway 431 Keystone Avenue Corridor Overlay Zone in order to amend the front setback requirements. Filed by
the Carmel Department of Community Services on behalf of the Carmel Plan Commission.
Present for the Petitioner: Adrienne Keeling
Overview:
Continuation of prior subdivision committee meeting (November 30, 2010) regarding:
o Amend setbacks for R- 4/Residence District for front yard setback (minimum) to a Build -to Line.
(Existing minimum set back is 30 feet from property line (road right of way)
o Proposing a revision so that principal buildings can be developed 0 -30 feet from property line (or from
future road right of way as stated in City of Carmel Comprehensive Plan Thoroughfare Plan and not on
recorded easements)
o Adding to amendment a statement that will prohibit any additions to existing structures that are closer
than 30 feet from property line
o Proposing an amendment to the existing Keystone Overlay Zone for residential uses to correlate with R -4
Amendment.

Revisions
o More focused on keeping single family dwellings in R -4 District still having a 30 feet front yard setback
and the other uses in R -4 would have 0 -30 feet front yard setback which will help maintain existing
character of neighborhood.
o Clarified language in Chapter 23A: Keystone Overlay greenbelt area where it states can not have
building in greenbelt area but then also further states can not have parking in greenbelt area making
language seem redundant. Therefore removed on page 3 the parking section so it is understood the
greenbelt area should remain clear.
o Changed wording in Section 23.A.03- Landscaping from State Highway 431 to Keystone Parkway
Public Comments:
Feel can handle future issues when Right of Way area is being taking by Governmental action in the R-4 District
by going through Board of Zoning Appeals Hearing Office Meeting rather than rewriting entire R-4 ordinance;
which could put public in a harmful situation (pool area close to main street or front door entry within steps from
main street, etc.)
Committee Comments:
Overall concern is with front yard setback line being "zero Feel what is stated in ordinance is what the builder
will build to. Want to avoid having front entry way being located on edge of street or on edge of public area.
Review two area's currently zoned as R-4 districts (Northwest Corner of East 106"' Street and Haverstick Road,
part of The Woodlands subdivision along with the intersection of Lakeshore Drive East and Emily Way) to
possibly rezone them to a zoning district that is similar to adjacent properties.
Requested to add "Two Family Dwelling" to Single Family Dwelling referenced in Section 10.04.03 Minimum
Lot Standards, Front Yard.
Suggested DOCS Staff to revise amendment to address concern of "zero" lot line and to visit the suggestion of
having the two locations mentioned above to be rezoned to more fitting zoning classification with adjacent
properties.
RESULT: Department staff is to revise amendment, resubmit to committee members and continue discussion at
next Subdivision Committee Meeting on February 1, 2011.
