FRANKUN ROAD INDIANAPOUS, IN 46219 (317) W6.2461 October 19, 1994 Mr. David Clark Regional President zaring Homes, 'Inc. 11711 North Meridian street suite 200 Carmel, IN 46032 Dear Dave, Please let this letter serve as official notification from the Architectural Control Committee of the Sutton Place Section I Community granting you approval to build the attached homes pursuant to the terms and conditions of the contract between taring Homes and Sutton Place Joint Venture and the architectural guidelines attached as, Exhibit "AM as part of that contract. The following homes are approved for construction in Section I subject to the above and following conditions: AapMvad Homes• Meridian Huntington Delray Bradbury Harrison This approval is also subject to the following conditionsc I. All homes shall utilize a side load ,garage entry unless specifically agreed by the sutton Place Architectural control Committee. 2. Any further homes which taring wishes to offer in the Sutton Place section I iC6=munity must also be approved by the Architectural Control Committee prior to their construction. 3. Final color schemes shall be submitted prior to the construction of _ttie first home for approval by the Architectural control Committee whose approval will not be unr@asonably withheld. 4. Zaring agrees. to follow the mailboxes which are utilized as standard mailboxes -in Button Place Section 1. S. Prior to the, closing of the first home in the community, Zaring shall submit dusk' to dawn lights for approval by the Architectural Control Committee. Siding must be wood, wood oomposite or; stucco material, no aluminum to be allowed. B. Developer understands and agrees that builder will construct speculative or market houses; in the community. These homes will be finishad,on the outside while the inside will remain at the frame stage. 9. Standard landscape plansiwill be approved prior to the initial ' closing of the lots and, shall be consistent with the architectural guidelines aa,attached as Exhibit ^A."
