RE: Majestic Office Buildings
Dear Mr. Bommer:
ONE CIVIC SQUARE
This letter is to inform you of our findings regarding the parking issue at the Majestic Office Building
located at 3802 West 96"' Street.
As 96"' Street and Augusta Drive are intended to be widened, and as there was no dedication of rights -of-
way requested at the time of rezoning for the subject property, the subject property will lose the majority
of its existing parking, and will need to replace that parking elsewhere, as well as the sign currently
located at the edge of the property. On that same parcel, immediately north of the office building, is
located a septic field which will become redundant when the site is hooked up to sewer and water
facilities. This septic field is an ideal location for the required parking. However, there is some question
regarding the use of that field for parking for the subject office building, related to a previous variance
granted for the three office buildings to the north.
In researching both files on hand here in the City of Carmel and recorded documents in the City of
Noblesville, no record was found that would restrict parking on that site. It has been suggested that a
condition was made at the time of granting the variance, V- 177 -00, for the three office buildings to the
north. These office buildings were granted a variance permitting them a reduction in parking, to 145
spaces rather than the required 180 spaces, however, no condition for using the land to the south on the
adjacent parcel was explicitly stated during the hearing, nor was it made part of the motion to approve the
variance. In addition, conditions which are legally binding may only be made on the parcel for which the
variance or rezoning request was made.
While an opportunity exists to make up lost parking on the site, applications for variances of
development standards will still need to be filed. These variances are based on the size and configuration
of the site, and on setback issues that will arise after the dedication Of right -of -way. As the need for these
variances arises primarily from the county's road expansion projects, staff does not foresee a great deal
of difficulty in getting the requests approved, however, the final decision is of course always the Board's.
We would recommend filing for the necessary variances as soon as possible, so that work on the required
parking may begin prior to road improvements, and thus be in place when the existing parking lot is
removed.

The variances needed are as follows:

2. Parking in the required bufferyard— Chapter 27.02.03
3. Reduced lot width -75 feet instead of 100 feet Chapter 18.04.06
4. Reduced side yard and aggregate side yard— approximately 10 feet and 0 feet, from the required
10 feet and 25 feet Chapters 18.04.03 and 18.04.04

Hi, Bill
I looked over the documents, and you are on the right track with filing the Primary Plat Amendment application and
then the Secondary Plat application, to create 5 lots from 2. Since these are currently platted lots, we have to go this
route for you to create additional lots within the North Augusta subdivision.
The northern lot is zoned B -5 /Business, the southern lot is zoned 8 -7 /business, and both lots lie within the US 421
overlay zone. The lot sizes, widths, setbacks, etc. are regulated by those zoning classifications. (I will have to further
research to see if the 421 Overlay zone trumps the underlying business zones and thus regulates the lot widths,
setbacks, and sizes, but I think it does....) Here is a link to the zoning ordinance chapters online:
