Rangeline Road Carmel, IN 46032 RE: 721 1S Ave NW, Carmel Dear David, In response to your request for clarification of the lot boundaries of the property our company owns at 721 1 Ave NW, Carmel, IN we assert the following: 1) The lot measures 116' wide (north to south along 1S Ave NW) by 165' deep (east to west). 2) Immediately east of our lot there is an approximately 21.5' wide utility alley /easement running north to south that divides our lot from those lots fronting Rangeline Road. We disclaim ownership of that easement if found in public record to be included as a part of our lot. 3) For the purpose of planning a new home on our lot we will assume a lot depth of 165' measured from the right -of -way line of 1 Ave NW when considering our lot setback lines. The site map provided by The OId Town Design Group shows the approximate location of the drain. The drain passes further East than is approximated in the Proposed Home Site Map provided. In fact, we are certain that it passes under both of the houses presently located at 721 First Avenue NW and 711 First Avenue NW. 2. The house at 721 Ave. NW was located on a lot approximately 120' 10" wide and it appears from the proposed home site map that The OId Town Design Group was intending to divide the property into two Tots, the one on the South to be 64' 9 and the one on the North to be 51' 1" with intentions to tear down the existing house and build new homes on each of the two lots. If this is the case, the house now under appeal, on the South side of the current property, will be only the first of two related zoning appeals that is to ensue on this /these property /properties. 3: In either-event, as-long as the City -of Carmel Engineering Department ensures that either one or two new houses on this property will not in any way damage or impede the future function of this drain and consequent drainage of this property /properties, and surrounding properties, we have no objections to the requested variance(s). Rangeline Road Carmel, IN 46032 RE: 721 1 Sf Ave NW, Carmel Dear David, I and writing in response to your request for information regarding our proposed plan to demolish the existing home and rebuild a new home at 721 1 S Ave NW in Carmel. The survey that was created by Weihe Engineering shows a lot depth for our property measuring 1.85.5' from the right -of -way line along 1s Ave NW. It appears that the eastern 21.5' was never dedicated as right -of -way to the City of Carmel even though that portion of the lot has been used as a utility alley for many years. Our company covenants to not construct a home or out building on the eastern 21.5' portion of the lot or make use of it as part of the lot area for the home to be constructed on the lot. For the purposes of our lot planning we will assume a lot depth of 165' measured from the right -of -way line of 1 Ave NW. However, we will reserve the right to access the aforementioned portion of the lot to make any necessary utility connections or to repair the property affected by utility connections. Further, if any adjacent property owner should seek to use the 21.5' eastern portion of the lot that we are disclaiming use of for our proposed home construction project they would first be required to seek our permission, or the permission of future owners. We are solely disclaiming the use of the area assumed to be the utility right -of -way for the purpose of the utility companies and to the City of Carmel and are not granting ownership interest to any of the adjacent property owners.
