Indianapolis, Indiana 46240 RE: CITY CODE VIOLATION — UNSAFE STRUCTURE Dear Dr. Star: I am writing to your regarding your property located at 31 First St. S.E., Carmel, Indiana, Tax Parcel Number 16-10-30-03-01-009.000. A recent site inspection was performed by this Department on May 13, 2009, in response to complaints regarding the safety of the structure. Due to the dilapidated condition of the property, a more detailed inspection of the structure was performed by a contractor of the City, McComas Engineering, on June 9, 2009. This report stated that there are virtually no areas of the building that remain watertight, and that significant deterioration of the roof framing and exterior masonry walls was noted throughout the building. Itemized structural deficiencies were noted in the McComas inspection report which will be made available to you. There were numerous deficiencies found which violate the provisions of the Carmel City Code, § 6-79 Public Nuisances Affecting Peace and Safe tv and § 6-159 Unsafe Building Regulations. It is our concern that the condition of the building has created an unsafe condition that may lead to partial or total collapse of the building shell. The City of Carmel seeks your voluntary compliance with the Carmel City code. In order to address and resolve the deficiencies it is critical that you or your representative initiate continuous construction to make necessary repairs to the structure, or begin demolition proceedings within forty-five days of receipt of this letter, not later than August 20, 2009. If you choose to repair the structure, this Department requires an engineering report on the structural integrity of the building and plan for moving forward be submitted by July 27, 2009. It has been our hope to build upon prior dealings with you, and your attorney, to find a solution that is mutually beneficial. However, for safety reasons the City has no choice but to move ahead and is no longer able to wait for you to improve your property. Due to the significant deterioration of the roof and exterior masonry walls from lack of maintenance and exposure to moisture infiltration, the abandoned church building has become so dilapidated and in such a state of disrepair that there is immediate potential for it to partially or completely collapse. The current situation is likely to become even more severe in the coming months from the effects of freezing weather. The building's deteriorated condition is such that it poses an imminent danger of failure or collapse which endangers life, health and safety of Carmel citizens. Therefore, the property is hereby declared unsafe and the building declared a public nuisance and hazard to the public health, pursuant to IC 36- 7-9 et seq., and Section 6-159 of the Carmel City Code — Unsafe Building Regulations. This letter shall serve as notice to you that the City of Carmel Legal Department has initiated the proper filing pursuant to ordinances regulating unsafe buildings.
