Hi, Del do you think that this PetSuites project will move forward this month? The filing fee will be due by Noon on Friday, March 4, otherwise, we will have to table the item again. Also, below is an excerpt of the Plan Commission Rules of Procedure, for your info: Article IX. Final Disposition of Cases Section 1. After consideration of any reports and recommendations of DOCS, the final disposition of any case shall be in the form of a decision or report, setting forth, when deemed appropriate, the recommendation (if any), findings and determinations of the Commission, together with any modifications, specifications or limitations which it makes. In any case in which the Commission is required to make written findings along with a final decision, the Commission may adopt findings as submitted by the petitioner or by any interested party, with or without modifications, specifications or limitations, or the Commission may delegate to Staff and /or legal counsel the authority to prepare written findings. When written findings are required, the Commission's findings shall be executed by the president and secretary of the Commission and filed in the office of the Commission within 45 days after the date of the Commission's final decision. Section 2. The Commission may dismiss a case for lack of prosecution or lack of jurisdiction. When a petitioner has failed to appear at two consecutive meetings. the case may be dismissed for lack of prosecution. With respect to a Secondary Plat, when the Secondary Plat has been pending before Staff for three consecutive months, Staff may request that the Commission dismiss the case for lack of prosecution. Staff shall notify the petitioner by mail, not less than 10 days before presenting the request to the Commission, that Staff will seek the Commission's approval to dismiss the Secondary Plat petition. Section 3. A petitioner may not withdraw a case after a vote has been ordered by the president. Section 4. A case which has been withdrawn by the petitioner shall not be placed on the docket again for consideration within a period of six months after the date of withdrawal. A new case involving the same property that was the subject of a. case which has been withdrawn by any petitioner shall not be placed on the docket for consideration within a period of three months after the date of withdrawal. They claimed it would be impossible to maintain and possible dangerous for the animals. Also, outside the fence area goes straight into the detention pond. They also noted for example if it was a loading dock like the project across the street that they did, exceptions for unique situations could be made. (if that's even an explanation Anyhow, I re -ran some numbers (since it's been awhile) and there is an estimated additional need of 60 on the west (3' spacing) and 8 shrubs on the south. There are +30 shrubs on the southern perimeter and there is basically a double width of shrubs along the north of the building. Essentially we ask for foundation plantings, the spacing and gapage is basically up to me. Also the AC units on the SW corner are extra landscaped. This is definitely not a project that will end up over landscaped, but given circumstances and that it lies in al-1, I felt it sufficient. They did plant all native shade trees and have a note to save any existing trees possible on the perimeter (if that is possible If this will not work for the Plan Commission please let me know. The following are responses for each of your comments: 1. Additional foundation plantings have been added along the north side of the building and at the southwest corner of the building. The majority of the west and south faces of the building are located within the fenced play areas. The south play area will be enclosed by a 6' tall opaque white plastic composite fence (picture attached); therefore, the foundation of the building will not be visible. The west face (rear) of the building will be enclosed by a 6' tall black vinyl coated chain link fence. Both fence areas are to be used as play areas for the animals. Landscaping would be difficult if not impossible to maintain in these areas and could be dangerous for the animals. We would request that we not be required to install foundation plantings in the fenced areas. On the previously approved project across the street, we had pavement all the way up to the building in the rear of the retail center for loading/unloading. There was a practical reason for eliminating the foundation plantings as is the case in this situation. The landscape area along the east face of the building ranges from 13' to 18' on the north half of the building most visible from Michigan Road. The south half of the building has a 5' wide landscape area. Originally this area was 10' in width; however, we added a 5' wide landscape strip in between the parking rows in front of this area to allow for additional maneuvering area for the Fire Department. This additional landscaping is not required and we were hoping it would suffice in lieu of the required 10' adjacent to the building. In addition, this half of the building will be screened by future buildings "A" and "B If the 10' landscape strip must be required, we could eliminate the sidewalk in this area; however, we do not believe this would be a practical solution. It appears that a type "A" bufferyard for peripheral plantings would be required based on the chart in 26.04.06. The landscape plan has been updated to reflect the side and rear bufferyard peripheral planting requirements. The developer will make an effort to save trees around the perimeter of the site during construction; however, based on the grade changes and the need to transition back to existing grades around the perimeter, we can not commit to being able to do that. The western half of the site where the majority of the existing trees are located is significantly lower in elevation than Michigan Road. Therefore, the entire western half of the site is in a significant fill situation. In most cases the grade is being raised somewhere between two to four feet in order to achieve positive drainage to the storm sewer system within Michigan Road. Based on the significant changes in grade over the majority of the site, it would be impossible to save any stands of existing trees. 3. The tree species have been revised as requested. Please see the attached revised landscape plan. 4. The "perimeter" misspelling has been corrected. Please see the attached revised landscape plan. I have reviewed the drawings and offer the following comments: URBAN FORESTRY REVIEW COMMENTS 1) 23.10.02.2 Foundation plantings shall be included along all sides of the building. Additional landscaping will=be required around the building. Also, part two of this requirement states the planting area minimum width shall be 10 feet not the shown 5 feet on the east side: 2) 23.10.02.3 Peripheral plantings will need to be addressed -chart shown in 26.04.06. Also, I believe this is a wooded western perimeter, existing plant material should be saved whenever possible and a complete natural tree lined perimeter will suffice in lieu of landscaping requirements for this area specifically. Tree preservation fencing and details and notation on the plan will then be needed. 3) The tree species selected in general do not match the requirements. For example; a paperbark maple is not a shade tree. All noted tree selections are considered ornamental trees. I. would suggest the use of some native shade trees like Tulip tree, hackberry, oaks and Bald Cypress, River Birch would be great in the back of the property around the detention pond. 4) The word Perimeter is spelled wrong in the landscaping requirement titles. The City Engineer may approve irrigation system agreements. 22. Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. 23. Dedication of right -of -way if not platted. The submittal is in need of additional information in order to be in compliance with the City of Carmel Stormwater Technical Standard Manual (the manual). Please revise the plans in accordance with the comments below. 1: After an initial review of the project and research into the project .site, several concerns have been raised by regulating authorities about the existing site and adjacent storm sewer infrastructure. One of the concerns dealt with possible downstream capacity issues with the proposed receiving system. It does not appear that the submitted drainage report provides a downstream analysis, or discussions concerning the downstream receiving system. The proposed outlet of the site's discharge is into an existing storm sewer system under the control of INDOT; therefore, please provide a copy of INDOT approval to discharge into the system. 2. Per Section 102.02.v., please revise the Existing Conditions and Demolition Plan to include the following information: e. Identification and delineation of vegetative cover such as grass, weeds, brush, and trees on the project site. g. Land use of all adjacent properties. 3. As this site consists of a pre-developed area with more than one (1) outlet, the release rate should be computed based on the pre-developed discharge area to each odder point. In addition, if it is determined that there are possible downstream restrictions /capacit. concerns, the City of Carmel may require a reduction in the allowable release rare, or for additional detention storage volume to be provided. Detention calculations are required to.be provided that indicates the orifice size required to limit release to acceptable rates, the resulting critical pond and spillway elevations, and that sufficient volume is provided to accommodate the release rate being limited to the acceptable rates (they have been provided within the submitted drainage report). The critical pond elevations resulting from this method of modeling shall be used in the MFPG /MLAG determinations. Since the resulting orifice size is less than the minimum 6-inch orifice requirement of Section of 302.06.07, the lower orifice shall be upsizecl to a 6- inch diameter orifice. Detention calculations shall be also be provided for this scenario. Please review and revise accordingly 15. Per Section 302.06.10,_of the manual, a minimum fifteen (15) feet horizontally from the top of.bankof the dry detention basin 'facility shall be dedicated as a permanent stormwater easement. Please review and revise accordingly. 16. Per Section 302 .06:11=of.the; manual,.please provide verification that an.additional ten (10) percent of available; capacity has been provided for sediment accumulation within the proposed detention system. 17. Per Section 302.06.12; detention basins are to be sized to detain the runoff from the fully developed Right -of -Way per the. city of Carmel 20 -year Thoroughfare Plan across all frontages, regardless of existing watershed, boundaries or drainage breaks /divides. Any waiver request for this design standard shall be submitted directly to the City of Carmel Engineering Department. 18. Please review the stormwater easement requirements of Section 306 and revise the plans to provide the necessary easements. 19. Please provide grate capacity calculations verifying conformance to Section 305:05. 20. Per Section 501.01, there should be no less than 2.50 feet of cover along any part of the pipe from final pavement elevation or final ground surface elevation to the top of pipe. Please review and revise all structures not conforming. Also, there should be a minimum of two (2) feet of vertical separation (outside of pipe to outside of pipe).for storm and sanitary facilities. Any waiver request for this design standard shall be-submitted to the City of Carmel Engineering` Department. .21. Per Section 501.03, a minimum drop of 0.1 foot through manholes and inlet structures should be provided. Please review and revise accordingly.
