Fund 500 As AmendedORDINANCE D- 2029 -11 AS AMENDED SPONSOR(s): Councilor(s) Snyder, Sharp and Seidensticker AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA ADDING CHAPTER 2, ARTICLE 4., SECTION 2 -138 TO THE CARMEL CITY CODE, THEREBY ESTABLISHING "THE CENTER FOR THE PERFORMING ARTS, INC. FUND #500)" WHEREAS, the Common Council of the City of Carmel, Indiana is, pursuant to Indiana Code 36- 4 -6 -18, authorized to pass ordinances and resolutions regarding the control of the City's finances and the appropriation of money; and WHEREAS, the Council wishes to express support for The Center for the Performing Arts, Inc. who's responsible for managing the arts complex for the benefit of Carmel's citizens; and WHEREAS, there currently exists no City fund earmarked exclusively for monies appropriated by the Council for support of The Center for the Performing Arts, Inc.; and WHEREAS, Fund #500 has been declared a dormant fund (Land Acquisition) and all funds have been previously transferred. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1: The foregoing Recitals are incorporated herein by this reference. Section 2: That Chapter 2, Article 4, Section 2 -138 is hereby added to the Carmel City Code and shall read as follows: "Sect. 2 -138. The Center for the Performing Arts, Inc. Fund #500) (a) There is established "The Center for the Performing Arts, Inc. Fund #500). (b) The Fund shall be administered by the fiscal officer of the City. (c) The Council shall, upon request by the Mayor and after appropriate discussion and deliberation with the President and CEO of the Center, appropriate with a majority vote the necessary funding for The Center for the Performing Arts, Inc. (d) The President Pro Tempore of the Council shall account, by separate line item, for the receipt and disbursement of all sums to and from the Fund." Section 3. That the remaining provisions of Carmel City Code Chapter 2, Article 4, are not affected by this Ordinance and remain in full force and effect. Section 4. This Fund shall be identified as Fund #500). Section 5. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 6. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor.
