The applicant seeks approval to amend Section 5.1.e of Ordinance Z- 526 -09 Z- 500 -06 for Park Place Planned Unit Development in order to amend the breakdown of unit types. The site is located northeast of 116 St Guilford Rd and is zoned PUD /Planned Unit Development. Filed by E. Davis Coots of Coots Henke Wheeler for Greystone Communities, Inc. Present for Petitioner: Dave Coots, Coots, Henke Wheeler, 255 East Carmel Drive, Carmel. Overview: Ordinance Amendment approved by the Commission at 2/15/2011 Plan Commission meeting Petitioner appeared at City Council on March 7, 2011 for approval of the Amendments presented to the Plan Commission City Council amended the PUD Ordinance in Section I, second sentence by striking the words "unit mix" and substituting "individual unit types" for that language. Because of that amendment, the petitioner is required to return to the Plan Commission to approve the amendment made by City Council Motion: Brad Grabow "To approve Docket No. 10120003 OA, Park Place PUD Ordinance Amendment," seconded by Woody Rider, approved 9 in favor, none opposed. New Business Council Report, John Molitor: Legislative Up -date will be covered in the 3/26 workshop Fiscal Impact Statement (SB 550) regulates Redevelopment Commissions and Authorities; it does not directly affect Plan Commission but could have a significant impact on the City of Carmel A final judgment was obtained in the case against Mr. Lewis regarding the Johnson Drive garage; Mr. Lewis is required to demolish and remove the existing garage structure on the real estate as soon as practicable but not later than June 4 Mr. Lewis was ordered not to construct anything on the real estate that is not in compliance with the covenants and restrictions for that subdivision; Mr. Lewis is also required to pay the attorney's fees total amount of the judgment is $12,481.
