The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the variance request is for some concrete in the setback between two houses. The public will not be exposed to the concrete. The concrete will be the same kind of concrete found in many other places in the community. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The use of the area adjacent to the concrete will still be our yard and our family will use the adjacent, area as such. The adjacent area will be unaffected. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: Our lot is on the corner of Braeburn Dr and Winesap Way. We have two 25 ft setbacks, or said another way, we have two front yards. The neighborhood requires that we have a minimum of 1500 sq ft of first floor living space. The house is built so it just barely fits on the lot with room for a standard 16 by 32 ft pool. We couldn't get the deck to also fit perfectly. DECISION IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Development Standards Variance Docket No. is granted, subject to any conditions stated in the minutes of this Board, which are incorporated heereiin by reference and made a part hereof.
