The pool basin is within the setback lines but the corner is 1 -2 feet into the side setback. The basin /structural component of the pool is within the rules of the covenants. I have also checked with Mr. Hillman and he is in support of the 1 -2 foot overhang of the pool cement pad. I would request that if the design changes, we have the opportunity to view the plans for ARB /Board consideration and approval. We still require to review the landscape plans as available prior to implementation of the landscape plans. I have had about 10 days of back and forths with the HOA and they prefer that we move our pool inside of the setback. They do not care about the concrete decking, so I will still be asking for a variance, but it will be only for the wall and the decking. I need to have the pool folks work on a revised drawing, etc. and I just got the news at 5am today from the HOA that they are asking me to move it. Since they are one of my "neighbors" and the HOA, I have to comply O Could you let me know how I submit the revised plan when I get it and what the timing is for the March meeting. 1 apologize for such late notice. Thanks Noel "Noel, I set the back of the wall on the easement line, which is 10' off the property line, so you should be fine. You have 2' to work with to the pool decking so we can move that up a few more inches if they want during construction. The footer used for this type of wall is a commercial 53 compacted base, it is not poured concrete. We will make sure the stone begins on or just short of the easement line and build the wall up from there, so the actual wall will be about 6" in from the easement line. Hope that helps. There are no covenanted setbacks, only the city ones imposed on the neighborhood. They can refuse from an HOA standpoint. Noel I see on the recorded plat sheet 3 that there is a Declaration of Covenants and Restrictions associated with the High Grove subdivision. Although this is a private document between you and your neighbors /neighborhood homeowners association, please look thorough those and' make sure you meet the setbacks and approvals required for a pool. And, if at all possible, please provide us with a paper copy or electronic copy of that document. This is not unusual for residential properties. Since there is not an easement along the property line, the only standards that come into effect are related to drainage from each lot along the common property line. Your property and the one to the south drain to the side yard swale and then to the back of the Tots. Any improvements you make on your property cannot have an adverse affect on this drainage; nor can it result in the neighboring property to convey a larger portion of the current drainage than it does presently. I believe that the Additional Use Regulations require the accessory use to be no closer than five feet from the property line. If the improvements (including grade alteration) were restricted to be 5 -feet (or greater) from the property line, I do not expect that the improvements would have a negative impact on the common drainage between the two Tots. As such, the current proposed wall option would not work as the end of the wall is almost at the property line. As this is a pool, please keep in mind that the filter backwash must be discharged to the sanitary sewer system. The rear of the lot is a 10 ft easement, but we aren't showing any encroachment into that area. Hope this helps. If it is an easement, we will not support this encroachment. Pools represent too large of an investment to have at risk by being in an easement. I would recommend an engineered wall like Belgard's Country Manor wall. It is a pin system that will take geo -grid to help handle the Toad of the pool deck and it's also a garden wall, so if you wanted too raise the wall for seating purposes you can do that as well. Aesthetically I think it looks a lot nicer than a compac even though your neighbor will be seeing it more than you! They also have a Belair wall collection that looks nice, but is quite a bit more expensive. We have used the country manor wall in similar situations as yours and found it worked really well. If your planning on using pavers around the pool or even your house for walks, etc. this wall blends in well with pavers. The country manor is a 3 piece system that is 6 "tall 10" deep and is 7 12" and 16" wide depending on the piece. Check out www.belgardusa.com or www.belgard.biz for more info. I am NCMA (National Concrete Masonry Association) and ICPI (Interlocking Concrete Pavement Institute) certified and follow their standards and guidelines in building walls and laying pavers. I also have a 5 year degree from Ball State in Landscape Architecture and have used and trust Belgards engineered wall like the Country Manor. Attached is the biggest pool that the pool folks think they can fit with no issues (14 by 28). We were working toward a 16 by 32 for the life of our house building, and now we are quite bummed out with a 14 by 28. The 16 by 32 can fit if turn at an angle to be along the south side set back, but then have to have a non- permanent decking, ie pavers. Other than the setbacks, the only other real constraint is that I don't want to be closer than 3 foot to the stairwell on the side of the house. Let me know what you think. Thanks!
