As stated before; the 1998 ROSO language requires a 10 -ft side yard with 20 -ft aggregate, and you are asking for a 6 -ft side yard•with 15 -ft aggregate. The Director can then make a determination. As a side note, today's current ROSO ordinance also requires a•10 -ft side yard for S -1 zoning (due to a recent ordinance amendment), not that it would apply to Camden Walk which was approved in 1998. Also, some additional review comments I have: 1) Please show a tree preservation easement along the rear yards of the lots that are adjacent to the western and southern boundaries of the plat. It needs to be on an engineered plat so he can check against utility lines for the complex. Brett stated that most of the landscaping has already been done with the original section, he asked for clarification. Scott stated that a lot of the landscaping is not in, and that some of the trees, i.e. ash, are not permitted. Scott will be making species suggestions. This project will need to come up to code. I did not understand that you were saying that the entire landscape plan was planted at the time of the original plat (Section 1). I have attached Nichole's inspection comments about'what is missing. It does not appear as if they were ever planted according to the plan. For instance, there are eight red maples proposed to be planted in front of the subdivision wall, upon inspection and on GIS it clearly shows that those trees are not there. What you are saying is that since the landscape plan covered the whole subdivision, and since something was installed at the time that Section One was built, that there should be nothing else left to install. While I appreciate those facts, the landscaping on the plan represents a commitment to the Carmel Plan Commission, and if it is currently not in place while the second Section is built, they will probably feel it is lacking. I think your options are: Have your landscape architect or contractor figure out what needs to reinstalled from Nichole's inspection list, that way the approved plan from the Plan Commission is installed (any everyone knows it); or Submit an ADLS Amendment showing -the existing landscaping as applied for My direction from the Plan Commission•is that I have some authority to accept species substitutions, and make technical calls, but they do not want me to accept less than What they have directed. We currently do not allow the planting of ash trees or other trees from our undesirable tree list (from in Carmel's Recommended Trees List). Please do not us a crabapple varieties Snowdrift or Robinson because of disease pressure, but choose a more appropriate species from either the Recommended Trees list or the Crabapple list. On the engineered site plan that the landscaping materials are put on, please include drainage easements, swales, utilities, streets, and other details as needed. Also include a graphic tree protection detail on the method used to protect the existing trees from construction damage. The proposed project falls in the unincorporated area and MS4 jurisdiction of Hamilton County. 2. The proposed project DOES NOT fall in a Carmel Wellhead Protection Zone. 3. The proposed project falls in the Fitch and Jessup Regulated Drain Watershed. 4. Please submit the following procedural items with the revised construction plans to this office, engineer's estimate, and all associated bonds for 120% of construction cost. The applications are available on our website at http: /www.co.hamilton.in.us, go to Departments, Surveyor, and Forms. The bonds shall included storm sewers, SSDs, erosion control/BMPs, and monumentation. 5. Please increase the easement on lots 61 and 62 to minimum 30 foot easement for regulated drains. Also, the easement on lot 40 and 41 needs to be at least 15 feet from the centerline of the storm sewer. 6. Hamilton County Ordinance 4- 26- 99 -C(2)d prohibits the discharge into rear yard swales. This affects lots 39 and 69 to 71. Please extend Str 863 past the lot line of lot 39 and into the common area. Str. 846 needs to be changed to a manhole and then piped to ex. Str. 845 and covered by a RDE. This also should help with the swale that only has 0.50% slope. 7. The swale on lots 66 to 71 is shown outside the proposed platted drainage easement:. 8. Since the wetland will be used as conveyance /detention of the stormwater, please, model the "basin" as depressional storageyp er the appropriate section of the HCSTSM. This ;will `include modeling the depressional storage area full before running the 100 year storm event, to calculate a 100 year elevation for the basin. This elevation will need to be compared to all flood protection grades on the plans. 9. Per the drainage calculations, pipe runs 845 -844 and 865 -864 are outside the velocity specifications in the HCSTSM. 10. To provide access to the SSD at the end of Fiddlers Court, we need access points (SSD risers or 2' x>2' box) that have been required in recent developments. If you need a reference for what we are looking for, please let me know. 11. On sheets C600, and C601, please remove the reference to Carmel Standards and backfill standards, as HCSO Detail D -23 covers the requirement on this project. 12. On sheets C600 and C601, please remove the Curb Inlet Tables, as HCSO Detail D- 18 is the new applicable standard for inlet sizing. 13. Per section 501.03 of the HCSTSM, all manholes should have 0.1' drop between the inlet and outlet pipes. Please revise the plans to accommodate this where possible. 14. The following structures should have 2' sumps per HCSO Detail D -18 and D -25: 837, 847, 851, 854, 861, and 864. 15. There are not SSD at the existing end of Towne Lane to connect to, so the SSDs from this development will just need to be capped and sloped back into Str. 864/865. 16. Please address all review comments from Bob Thompson, HCSO Phase II Program Manager. 17. Please note that additional comments may be warranted at a later date. The conclusion, after reading through all of the material regarding the primary plat approval and this secondary plat application, is that the plat approved in 1998 has to meet the requirements of the ordinance that was in place at that time. The open space ordinance in place at that time required a 10 -ft side yard with 20 -ft aggregate.'Any deviation from that would require compliance with today's open space ordinance (which requires compliance with the S -1 zoning: 10 -ft side yard, 30 -ft aggregate) or BZA variance approvals to allow a lesser side yard setback (36 lots 36 variance requests). All homes on lots in section 1 that are not compliant are considered legally non- conforming, at this point in time. I know this is not what you wanted to hear, but these are the design standards Camden Walk was approved under. Please pass this information along to your client. As stated before, the 1998 ROSO language requires a 10 -ft side yard with 20 -ft aggregate, and you are asking for a 6 -ft side yard with 15 -ft aggregate. The Director can then make a determination. As a side note, today's current ROSO ordinance also requires a 10 -ft side yard for S -1 zoning (due to a recent ordinance amendment), not that it would apply to Camden Walk which was approved in 1998. Also, some additional review comments I have: 1) Please show a tree preservation easement along the rear yards of the lots that are adjacent to the western and southern boundaries of the plat. There are many trees along those property lines that should be preserved. Or, you can pull the lots away from the outer edge of the plat and show it as a common area. 2) Also, please provide an Open Space Schedule exhibit A as found in chapter 7 of the subdivision control ordinance. Open Space should be set aside for active or passive uses, and provide a network of open space. The open space requirements emphasize the protection of natural areas, such as flood zones and woodlands, but also allow for more structured open spaces, such as parks or squares, as well as for agricultural openspace in the form of fields or pasture. Open space should be consistent with the goals, objectives policies set forth in -the Comprehensive Plan. To encourage the maximum amount of open space within subdivisions, the ordinance allows for smaller lots, and reduced yard areas. The ordinance also allows for a density increase bonus when minimum requirements for open space are exceeded. 7.00 Subdivision Open Space Design. 7.00.01 Major Subdivisions with community water and community sewer that meets the Standard Open Space Requirement (SOSR) set forth in Section 7.01 shall. be exempt from the area, yard, width, and coverage' standards set-forth in Sections 5.04.02, 5.04.03, 6.04.02, 6.04.03, 7.04.02, 7.04.03, 8.04.02, 8.04.03, 9.04.02; 9.04:03, 10.05.02, and 10.05.03 of the Zoning Ordinance, however, the minimum distance between dwellings shall be six (6) feet. 7.00.02 Minor subdivisions shall be exempt from the requirements of this Chapter. 7.00.03 Major subdivisions with a` gross density of 1.0 units per acre or Less shall be exempt from the requirements of this Chapter.
