HomeMy WebLinkAboutMinutes Land Use 07-03-90LAND USE MINUTES JULY 3. 1990 COMMITTEE MEMBERS`PRESENT: Ila Badger, Ron Houck, Sue McMullen, Alan Potasnik, Chairman STAFF PRESENT: Terry ones Item I.-,'Docket-No. 40 -90 Z, request rezone of 27.04 acres to B -6. Site is located on southeast corner of Old Meridian Street and Smokey Row Road (136th Street). Site currently zoned R -2. Total project site is 39.68 acres. Site is proposed to be used for development of a mental health treatment center and the future development of ancillary and auziliary medical /health care facility. Filed by James J. Nelson for Pro -Med Limited. Mr. Nelson, representing Pro -Med Limited, gave an explanitive presentation of the rezone request. Mr. Nelson stated that of the approximate 40 acres there will be six (6) parcels: Parcel #1) Being purchased by Tri-County and 'will be the locationfor a mental health center to be known as Tri- County Center. (1 acres). Parcel #2) Will be retained by Pro -Med and will be preserved for future development consistent with the health care field. (14.8 acres). Parcel #3) Will be reserveed for signage. (.85 acres). Parcel #4 (1.9 acres). Parcel #5 (7 acres).. Parcel #6 (3 acres). Parcels #4, 5, 6): There is not a requested change in their current R -2 zoning. Parcel #6) Proposed to be utilized for a lake, both for aesthetic and drainage purposes. Parcels #5 6) Due to proximity to Meadowlark Park the petitioner did think it appropriate that some day they be made a part of. Meadowlark Park. The petioner is willing to consider this at, the appropriate time Mr: Nelson indicated that the petioner had made a commitment to the proposed site development plan" presented toy the entire Commission and Committee. Mr. Nelson stated that the parcel would be developed in substantial compliance with this development plan. Mr. Nelson stated ;tthat since part o f Parcel #2 lies within the U.S. 31 .Overlay Zone all excluded uses noted in the U.S. 31 Overlay Zone were extend over the 'entirity of Parcel #2, "so for all practicle purposes we are treating the entirity of Parcel 2 as thougfh it were within the U.S. 31 Overlay Zone or the Meridian Corridor In addition the petitioner, by way of commitment, have excluded certain permitted and special uses typically allowed in the B -6,. District, from Parcel #2. Mr. Nelson stated that any development occurs in Parcel #2 will require the review and approval of the. Carmel /Clay. Plan Commissionwith respect to architechtural design, lighting, landscape and signage. The petioner is also willing to limit the height of buildings within Parcel #2 to four (4) stories or 50', the lesser of. (tape: 115) Mr. Nelson stated that the petitioner was commiting to a tree preservation program in conjunction with substantial greenbelt areas. There is no proposal for and clearing on Parcels` #4. 5 and only what is needed for the lake on Parcel #6. As for Parcels #1 and 2 except for necessary clearing for the installation of roads, parking areas and the buildings all trees greater: than 10" in diameter will be retained. Mr. Nelson gave a brief description of how Tri- County would be Mr. Nelson explaned proposed on and `off site road improvements: Intersection of Old Meridian and U.S. 31 will mirror those being made by Flynn Zinken on the opposite side. Widening a portion of Old Meridian near its intersection with U.S.- 31 from2 lanes to 5 lanes.. Smokey Row Road widening to approximately 35' paved a distence of approximately 500' or just north of the western most entrance. Mr. Nelson stated that the petitioner had committed to the residents of Wildwood that there would be a fence between the Tri- County facility_and the south property line. Mrs. Mcmullen ask Staff if TAG concerns had been addressed. Mr. Jones indicated the items which could be had been addressed. Mrs. McMullen ask Staff to explane the concern for road improvements as indicated in the Staff Recommendations. Mr. Jones explaned that due to the configuration of, intersections and existing street patterns in the area, concern for current and future traffic flow has been a constant theme for any project propose in the vacinity. Mr: Jones, gave examples of recently proposed projects which the same type of commitment has been obtained. There then followed discussion of what type of commitment there should or would be. Mrs.. McMullen ask who or what is Pro -Med. Mr. Nelson stated it was a limited partnership, the managing general partner is Bob Hughes, and the partnership is owned by 26 local practicing physitians. Mr. Houck questioned the presentation given that evening versus the public hearing with respect to Parcel #5 being considered instead of intended as a park. Mr: Nelson responded that the applicant felt the use of that parcel as a park would be a fine addition to the project and the community. If in the future it were to become a park it would be desired by the applicant to dedicate the land for park use to the. City of Carmel, however, the applicant dose not want this type of gesture perceived as a "carrot ",,for approval of this rezone request. Therefore, there is not a commitment, at this time, as a part of this rezone request. Item 1I. Swimming pools and landscape buffering. Mr. Jones reported that Sections 5.3.2, 6.3.2, 7.3.2, 8:3.2, 9.3.2, 10.4.2, and 16.3.2 of the Carmel /Clay Zoning Ordinance had been noticed for public hearing June 19, 1990, to amend each section, (copy enclosed). There then followed 'discussion as to landscape buffering around pools. The Committee agreed that there; should be further study on this issue. The Committee requested that Staff provide all previous drafts of the swimming pool ordinance available to each member of the Committee. There will be further work on this item in upcoming Land Use Committee meetings.
