HomeMy WebLinkAboutMinutes BZA 04-30-90 173 II CARMEL BOARD OF ZONING APPEALS MINUTES APRIL 30, 1990 1 The regular meeting of the Carmel Board of Zoning Appeals meeting was brought to order by Gilbert Kett, President on April 30, 1990 at the Carmel City Meeting Hall at 7:16 P.M.. The meeting was opened with the Pledge of Allegiance. The board members present were: Gilbert Kett, Jim Miller, Ila Badger, and Richard Klar. Mr. Thompson was not present. The staff members present were: Rick Brandau, David Cunningham, Terry Jones, Wm. Wendling, Jr., Attorney and Dorthy Neisler. Mrs. Badger moved to approve the minutes for the March 26, 1990 meeting as presented. Mr. Richard Klar seconded. Approved 4 -0. Mr. Wm. Wendling, Jr. made some general comments regarding the swimming pools variance. It is his understanding that several people have received notices from the City indicating that you may be in violation of the ordinance requiring 6' fence to surround your swimming pool and are here to obtain a variance from that ordinance. There were several people here at the last II BZA meeting requesting the same variance. Between this time and last time he has had the opportunity to review the current Indiana Law as indicated by the Indiana Fire Prevention and Building Code that is outlined specific design requirements for private swimming pools. This law did not exist for this community prior to September 1989. Contained therein, there is a provision that provided certain technical requirements are met for pool covers as opposed to fences. Both ordinances exist, both ordinances being the 6' restriction in the zoning ordinance and our building code by reference adopt the state standards that say you cannot have or protect your pool one of four ways. The Planning Commission is the entity that recommends to the City Council what ordinance should be adopted or repealed or modified. His assignment was to evaluate which law or which ordinances should be addressed. He has recommended to the Plan Commission that the 6' ordinance that you are seeking an variance for be repealed by the City Council. He cannot tell you whether the Planning Commission will accept my recommendation nor can I tell you, or even if it does the City Council would accept my recommendation. That is a process that he feels that needs to be worked out through the City Administration and my recommendation to Board of Zoning Appeals is to suspend their rules this evening for the people that are here for that variance request and allow the procedures that need to be followed to set this matter before the City Council to make a determination as to whether it is going to be repealed or not completed. Unless someone has a strenuous objection to that he thinks that the Board of Zoning Appeals is inclined to table this for the duration while it works 1 CARMEL BOARD OF ZONING APPEALS MINUTES APRIL 30, 1990 2 its way through to the City Council. These petitioners are entitled to one continuous of 30 days and we may want to suspend the rules to allow their tabling to take place as long as necessary to get this matter taken care of. Mrs. Badger moved to suspend the rules and table all swimming pool variance request for whatever time period it takes for the City Council to act on the recommendation of the Plan Commission. Mr. Miller seconded. Approved 4 -0. G. PUBLIC HEARING: lg. 7:00 P.M., Public Hearing on Docket No. V -7 -90 a Developmental Standards Variance Application for Jon Powell and Assoc. the satellite dish installer for the Unisys Corporation located at 401 Pennsylvania Parkway, Indianapolis. Petitioner is requesting a variance from developmental standard three (3) of the Carmel /Clay Zoning Ordinance Amendment Z -211 to allow the installation of a satellite receiving antenna on the roof of a principal structure. Parcel is zoned B -5. Filed by Terry Kimerly of Jon Powell and Assoc. for the Unisys Corporation. The public hearing was opened at 7:28 P.M. Mr. Jon Powell, President of Powell and Associates, 17322 Westfield Park Blvd., Westfield, IN, made the presentation, a copy of which is on file at the Carmel Department of Community Development. A presentation packet was submitted to all board members. There were no comments from the public at this time. Mr. Brandau stated the staff did not feel comfortable that it was a total screening and that the motion should include what the findings of facts state. The public hearing was closed at 7:40 P.M. Mrs. Badger moved to approve Docket No. V 7 -90 for the Unisys Corp. with the following 2 stipulations, 1) the antenna shall be fully screened from public view from all directions at ground and road levels at the final inspection by the Department of Community Development to assure us that they are incompliance with this agreement; 2) that the City of Carmel will in no way be responsible for any damage or personal injury that might occur 175 CARMEL BOARD OF ZONING APPEALS MINUTES APRIL 30, 1990 3 from a satellite being attached to the roof. Approved 4 -0. 2g. 7:00 P.M., Public Hearing on Docket No. V -10 -90 a Developmental Standards Variance Application for Brenwick Development Co., Inc. and their residential subdivision "Claybridge at Springmill" and lots 106 and 107 in Springmill Stream section six (6) and lot 200 in Springmill Streams section eight (8) located in Carmel. Petitioner is requesting variances from sections 5.3.1 and 5.3.2 of the Carmel /Clay Zoning Ordinance to reduce the normally require accessory structure /use setback from 75 feet to 40 feet and to allow an automatic pool cover in lieu of the ordinance requirement of a six (6) foot fence enclosing all private swimming pools. Parcel is zoned S -1. Filed by Brenwick Development Co., Inc. NOTE: This item was tabled at last month's meeting and since has been withdrawn by the petitioner. Browning, respectively and their 32.866 acre tract of property located on the south side of West 116th St. between Springmill Road and Ditch Road, Carmel. Petitioners are requesting the following variances from the Carmel /Clay Zoning Ordinance: Variance I Variances from the definition of "lot" and "street" under section 3.0. Variance II Variances from section 5.4.6 to allow the Minimum Lot Width to be measured on a line other than as outlined by the ordinance. Variance III Variances from section 25.1.3 to allow six car garages and an increased maximum area in square feet. There were no comments from the public at this time. Mr. Kett noted staff recommendations. Mr. Brandau stated that at the Technical Advisory Committee meeting there were several items addressed, 1) request from the Department of the petitioner to dedicate a 40' half right -of -way the entire length of their property, then would bring the width of the right -of -way at that point of 116th Street up to our Comprehensive Plans standards. As well the installation and maintenance of a sidewalk. Mr. Nelson stated that they have agreed to do this. Legal description has already been ordered. Mr. Nelson also stated that they agreed not to agree to install sidewalks and the petitioner's thinking on this hope does not view this as arbitrary but basically at this time there is no sidewalk plan for west of 116th street, second Mr. Nelson is personally doubtful that a sidewalk plan will ever be adopted for 116th Street considering the way that area is being developed. The petitioner does not believe that their proposal development of basically just adding one more home on a 30 acre parcel of real estate is the type of development activity that promotes an increase in pedestrian traffic,the petitioner believes that requiring a sidewalk in this location is truly placing an owners burden on a property owner. Mr. Brandau stated that the other TAC concerns was the Indiana Bell request a Utility Easement be provided to each resident for access and service by the utilities in addition will be needed to provide adequate provisions to cross both creeks. If they don't grant it they probably won't get phone services. The County Surveyor requested a legal description map and need to indicate a 100 year flood level, flood fringe and flood way of the creek and the Hamilton County Soil Conservation would requested that the existing crossovers the creek will be need to be removed and proposed crossing will need to be approved by the Indiana Department of Resources. All TAC comments were satisfied thoroughly, except #2. The public hearing closed at 8:10 P.M. Mr. Miller moved to approve Docket No. V 30 -90 with individual variances 1, 2, 3, 5 be included with the dedication of right -of- way (a minimum of 40 feet). Mr. Klar seconded. Taylor Estes and their pool located at 10587 Coppergate, Carmel. Petitioners are requesting a variance from section 5.3.2 of the Carmel /Clay Zoning Ordinance to allow an automatic pool cover in lieu of the required six (6) foot fence. Parcel is zoned S -1. Mr. Toby Butler of Butler Repair Shop, 931 N. Range Line Rd., made the presentation, a copy of which is on file at the Carmel Department of Community Development. An elevation and a site plan was shown. The Technical Advisory Committee's questions have been addressed per Mr. Butler. The letter is on file that accepts the plans for the flood way. There were no comments from the public at this time. Mrs. Badger asked Mr. Butler how do they dispose of their chemicals? Mr. Butler stated that they recycle what they can and what is left over is hauled off of the property. Mrs. Badger questioned the staff if there had ever been any complaints filed? Brown for Anita Swank d /b /a Ridgewood Residential Builders. 183 CARMEL BOARD OF ZONING APPEALS MINUTES APRIL 30, 1990 11 The public hearing was opened at 9:02 P.M. Mr. Steve Brown, of Locke Reynolds Boyd Weisell, Fidelity Plaza, Tower I, Suite 210, Carmel, made the presentation, a copy of which is on file at the Carmel Department of Community Development. A view of Kingswood Development and slides were shown for a preview of fences. There were not any petitioners present for items #14g through 23g. Letters from Ralph Morgan of C.P.Morgan, Mick Scheetz of Century 21 Scheetz and Jim Canull of A.M. Real Estate were submitted for our files speaking in favor of the fences. (which is a part of the official minutes and attached to the Master Copy). Mr. Ray Roehling, 975 High Drive, spoke in favor of the development of 6' fences. Mr. Jim Miller spoke that some of these are his neighbors and he speaks in favor of the 6' fence. Mrs. Badger requested that this board request the Department of Community Development to come up with verbiage which will easily and quickly remedy this situation. Mr. Brandau stated that the staff would be happy to address the board to address some of the concerns and complaints the office has received with such type fencing. The staff has received complaints in regards to landscaping and lack of landscaping on the exterior of the fence. We do not disagree one bit, we agree whole heartily as far as staff that our ordinance needs help in that the front yard issue and the back yard issue is almost ludicrous as it stands in our ordinance right now. The staff has a position to stand as far as the ordinance. Ms. Sue McMullen, 12326 Brompton Rd, Vice Chairman of the Planning Commission, stated that she felt this is of such an issue that it should have been made a point of, not made part of a list of several things if that were the case. She does not feel that it is the intent of anyone in this community to go through this. She feels the Plan Commission and the City Council is certainly amenable to a simple redefinition of front yard. She would like to know if the staff is going to enforce the definition of front yard so effectively, what about swimming pools and accessory buildings and everything else that are in these front yards? Are you going to issue a violation also? This could have been addressed very simply. fr, 184 CARMEL BOARD OF ZONING APPEALS MINUTES o APRIL 30, 1990 12 Mr. Kett recommended that the board suggest the $100 fees be returned to the petitioners. Mr. Wm. Wendling,Jr. stated that he wants to make sure there is a difference between waiving a fee and returning a fee, as to how we can get that accomplished and Mr. Wendling would pledge that he would try to get it accomplished if it is legally possible. The public hearing was closed at 9:40 P.M. Mrs. Badger moved that these 10 petitions be tabled at such time as we hear back from our attorney. Mr. Klar seconded. Mrs. Badger withdrew her motion.
