DOW has been and remains committed to preservation of green space within the City of Carmel and the improvement. of Carmel residents' access to parks and greenways. As you know, DOW has leased River Heritage Park to the Carmel, and authorized it to construct River Heritage Park (the "Park and its _associated improvements on DOW property. The City occupies the Park for nominal rent ($1.00 per year), and the Lease specifically requires Carmel Parks to pay for trails and associated improvements serving the Park. Since the Proposed Path would be used to provide access to the Park, DOW contends .that. Carmel should be responsible for installation and maintenance of the Proposed Path and associated crosswalk(s). DOW further contends that neither DOCS nor the City of Carmel has the authority to require DOW to construct; the Proposed Path in connection with (or as a condition of) TAC approval of the UV Project. Section 21.05 of the Carmel Zoning Ordinance provides: An approved Special Use or Special Exception may be expanded up to ten percent (10 of the approved gross float: area without obtaining further Special Use or Special Exception if the approved use or exception is continued in the expansion, if the particular Michael Hollibaugh, Director March 15, 2011 Page 2 of 3 building height, setback, yard, parking, etc. requirements are adhered to and if the proper permits for the expansion, such as an Improvement Location Permit, are obtained. DOCS has already confirmed for DOW that the UV Project qualifies under the ten percent (10 gross floor area exception for both the existing Plant, building and the proposed UV Project expansion area. Furthermore, we can locate no provision of the Carmel Zoning Ordinance or other requirements which gives TAC the authority to require conditions on its approval of the UV Project, other than with traditional zoning requirements relating to the expansion (building height, bulk, setback, etc.) and obtaining necessary permits (e.g., an Improvement Location Pennit). Adherence to basic zoning requirements are the only criteria upon which a TAC Application is required the UV Project, and the only basis upon which TAC could reject or otherwise condition the UV'Project Application. It is therefore DOW's position that there is no basis for TAC to impose additional conditions or requirements for the UV Project (e.g., right of -way grant, Path constniction, •landscaping requirements, posting of a construction bond, etc.) in connection with TAC review. As explained in prior meetings between DOW and DOCS representatives, pursuant to requirements of federal law-relating 'to safety of drinking water, DOW is required to complete the UV Project and have it operational no later than April 1,201 In order to meet, this deadline, DOW must betin construction of the UV Project no later than April 29, 2011. If the Proposed Path were required to be included within the scope of the UV Project, DOW would almost certainly not be able t� comply with its federal mandates, particularly since additional planning and pubic bidding requirements must be satisfied by DOW in order to have adequate funding for the Proposed Path. Furthermore, the Board of Waterworks would need to approve such expenditures, particularly since they would ultimately be paid by ratepayers who would not be direct beneficiaries of such improvements. Nonetheless, DOW will agree to grant right -of -way necessary for the Proposed Path, at no cost to Carmel, with Carmel being responsible for costs to construct the Proposed Path and any related crosswalk(s) in connection with either the Proposed Path. or the existing path. The right -of -way grant could be completed in short order, subject to preparation of the survey and legal description of the right -of -way parcel.
