Hi Jim according to the BZA attorney, you cannot amend the structures or add back on to them. These
were /are nonconforming (grandfathered) structures in a residential zone where there is not a house on the
parcel.
If they were legal structures and(had been destroyed less than 40% "by explosion, fire, flood, earthquake,
windstorm, act of God, riot or act of a public enemy" (Zoning Ordinance Section 28.07.04), then they could be
restored.
Any new construction on the parcel now needs to be in conformance with the zoning ordinance, which means
that a house has to also be on the parcel, OR you would need to seek variance approvals in 6 months (since your
variances were just denied.)
Please let me know if you plan on filing for variance approvals in 6 months.

in regards to when you can re -apply and try for another variance, the BZA rules of procedure state the following:
Section 7. A development standards variance application which has been decided adversely to the petitioner shall not
be placed again on the BZA's agenda for consideration until the legality of the BZA's decision is finally determined
pursuant to IC 36 -7 -4 -1000 et seq.; or for a period of six (6) months following the date of the adverse decision issued
by the BZA, whichever is later.
Also, I am looking into your question about restoring the existing pole barn and putting the lean -to back on. l will let you
know the answer to that, once I consult with the Planning Director.

from what I understand the building will meet the ordinance requirement of an 18 -ft building
height for an accessory structure. Well, it can actually be a little taller than that if
measured to the ridge from the ground. The zoning ordinance definitions shows: HEIGHT,
BUILDING The vertical distance from the lot ground level to the highest point of the roof
for a flat roof, to the deck line of a mansard roof and to the mean height between eaves and
ridges for gable, hip and gambrel roofs.)
To reiterate, it is the mean height between eaves and ridges for gable, hip and gambrel
roofs.

Brent,
I received a drainage complaint from the guy that owns the property (Mr. Gravelie). He feels that his property is receiving
runoff from the Korean Church on the north side of 101 Street. He said he was going to put some fill in on his lot in order
to attempt to block the drainage coming from the church if he couldn't get the church to direct their water to the east along
the north side of 101 St.
He is not in a regulated drain watershed so this office has no jurisdiction. There is not a natural surface watercourse with
defined banks that he will be blocking so the Obstruction of Private Drainage law doesn't prevent this work. It appears that
he is within the limitations of the common enemy rule for surface water coming onto his property.
The entire parcel is 1.1 acres so unless he is disturbing the entire parcel he will be disturbing less than 1 acre so I don't
think he needs a permit for that.
I believe that a side ditch along the north side of 101 St that would carry the water to the east end of 101 St would be
the best solution to this situation. I don't think that the Hamilton County Highway. Dept would install the ditch, and the
church has no interest in doing this as they do not have a drainage problem since the water gets away from their property.
Actually Gary Duncan and I were talking to this property owner the other day about this property. He owns Gravelie
Excavating and was proposing to do some work at 3808 Carwinion Way. Gary and I met with Mr. Gravelie and the
property owners at 3808 Carwinion Way and at the end of the meeting the 101 St project was brought up.

The applicant seeks the following development standards variance approval:
Docket No..11030003 V Ordinance Chapter 25.01.01.A.4: accessory structure built without a
primary structure. The site is located at 945 E. 101st St. It is zoned R-1/Residence. Filed by James (Jim)
Gravelie,.owner.
General Info Analysis:
The current existing barn (about 40 ft x 24 ft) on this parcel is
falling down and in disrepair; however, it is grandfathered, or
legally non conforming. If it is tom down, a new pole barn must
meet today's ordinance regulations. The petitioner seeks variance
approval to build a new accessory structure (pole barn) without
having a primary structure on that same parcel. The zoning
ordinance states: "No Accessory Building shall be constructed
upon a lot until the construction of the Principal Building has
actually commenced; and, no Accessory Building shall be used
unless the Principal Building on the Lot is also being occupied for
the intended purposes." Please see the petitioner's informational
packet for more detail.
The proposed pole barn is 18 -ft tall and will have dimergions of
42 ft x 64 ft..However, the zoning ordinance states that "except
that a detached garage, which is the only Accessory Building on
the lot, may_equal the maximum dimensions of twenty -four (24)
by thirty (30) feet. The petitioner will need to file for an
additional variance for the larger pole barn size. (If the
petitioner would like, he can table docket no. 111030003 V to
the next BZA meeting and have both Dockets heard at the

As a side note, the petitioner has just cleare d most, if not all, of
the trees from the site. While a landowner can do this on a
residential property without any restrictions, the seeking of
variance approval for this pole barn on this parcel does permit the
Board to impose conditions, such as planting trees along the road
rights of way. When viewing the site from I -465, One can see a
vast difference from this parcel .versus the adjacent lots that have a
tree buffer. The aerial photo to the left. shows the site with trees
before, and photos on the next page (taken from 101" Street) show
cu1Tent site conditions.
1. The approval of this nce wi no e injurious to the public health, sa ety, morals, and,general welfare of
the community because: the new,p(ile barn will meet the setbacks and height regulations of the ordinance. It is
replacing an existing pole barn that is not structurally sound.
The use and value of the area adjacent to the ,property included in the variance will not be affected in a
substantially adverse manner because: the new pole bam will meet the setbacks and height regulations of the
ordinance. It is replacing an existing pole barn that is not.structurally sound.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties
in the use of the property because: a new pole barn could not be erected on this site without first building a house.

I don't know what equipment, how large will the buildings be, how often will he retrieve this equipment,

of the storage yard, does he use this stuff every day for his business? We will be in an industrial park if this
variance is allowed.
I hope you care about the noise, the traffic of large trucks, the "look" of our neighborhood and the value
perception of our property. This is a place of good homes where children play, ride their bikes, walk to
friend's homes and other people walk here for `fun and health". What will large truck traffic do to this
street?
This is not right to put a very obvious "business" in a neighborhood of true "homes" This is what zoning
laws are for.
If we do not show up at this meeting Monday night to question and object to this, The Board of Zoning
Appeals will think it will be alright and may let this happen. This business needs to be in a place next door
To a gravel pit, not in a residential area.

Our Department is re- reviewing your petition before we finalize our department report. You show the proposed
pole barn to be 42' x 64 Is this correct? (The Zoning Ordinance states that a detached garage may equal the
maximum dimensions of twenty-four (24) by thirty (30) feet.) The larger pole barn will also need SZA
variance approval for size, which means that you would need to fill out an additional variance application and
make public notice for that docket no. too. Please let me know if.you are willing to just do the 24' x 30' pole
barn, which would not need variance approval for size.

We need to know the height, square footage, and things like that. We also need to know where it will be
